He is not opposed to the land being subdivided, but to the affect the development may have on the creek and his existing well. Mike Anderson, applicant, appeared before the Commission and expressed his appreciation for the concerns mentioned. He also answered some of the questions raised previously. Mr. Anderson agreed with the postponement of his request so he can change the layout of the subdivision to address some of the concerns expressed and still get full use of his property. At that time the Commission requested additional information from the applicant, as follows: 1. An engineered drainage plan, including plans for diversion of Erskine , Creek. 2. An engineerecl foundation plan, including plans for stabilization of the hillside after excavation. A letter was sent to the applicant, who resides outside of Kodiak, as well as the local agent named in the application for this request. Staff was contacted by the agent for this request on November 4, 1993. The agent is trying to get authorization from the applicant to begin the requested engineering study. Authorization had not been received as of this writing. Due to the time required to obtain an engineering study, it does not appear Case 93-062 Page 1 of 2 P & Z; November 17, 1998 Old Business Item VII -A that the information requested by the Commission will be available by the packet review worksession on November 10, 1993. Staff therefore recommends that this case be postponed until the December 15, 1993 regular meeting in order to permit additional time to obtain the engineering data requested. If an engineering study is received prior to the regular meeting on November 17, 1993, staff will review same and revise the recommendation as appropriate. A copy of the original staff report is attached as background information for this request. RECOMMENDATION Staff recommends that the Commission postpone action on this request until the December 15, 1993 regular meeting in order to allow the applicant additional time to authorize an engineering study of the concerns expressed by the Planning and Zoning Commission. Front Yard. 1. The minimum front yard shall be twenty-five feet unless a previous building line less than this has been established, in which case the minimum front yard for interior lots shall be the average of the setbacks of the main structures on abutting lots on either side if both lots are occupied. 2. If one lot is occupied and the other vacant, the setback shall be the setback of the occupied lot plus one-half the remaining distance to the required twenty -five-foot setback. 3. If neither of the abutting side lots or tracts are occupied by a structure, the setback shall be twenty-five feet. COASTAL MANAGEMENT APPLICABLE POLICIES Residential Development 1. Location In areas with poorly draining soils, development where feasible shall be connected to a sewer line. Where this is not feasible, onsite facilities shall be designed so as not to cause conditions that will pollute rivers, lakes, and other water bodies, including the ground water supply. Open Space Green areas and open space shall be retained to the maximum extent feasible and prudent when land is subdivided. Consistent: Not applicable. This action does not involve land subdivision. Access New subdivisions or other residential developments on the shoreline shall provide usable public access to and along the shoreline, extending the length of the development, to the extent feasible and prudent. Consistent: Not applicable. This lot is not located along the shoreline. 4. Hazardous Lands Development shall not occur in hazardous areas such as avalanche runout zones, active floodplains, and high water channels to the extent feasible and prudent. Siting, design, and construction measures to minimize exposure to coastal erosion, mass wasting and historic tsunami run-up shall be required to the extent feasible and prudent. Page 3 of 6 P & Z: October 20, 1993 Public Hearing Item V1713 COMMENTS This request is intended to permit a new two-story single-family dwelling to encroach no more than twelve feet into the required 25 foot front yard setback on a nonconforming lot in the R1 --Single-family Residential zoning district. The site is presently developed with a small single-family dwelling which encroaches the entire front setback and projects three (3) feet into the High Avenue right-of-way. The plan, as submitted, shows the removal of the old dwelling unit upon completion of the new dwelling unit. Zoning compliance for this project, if approved, would indicate that the old structure must be removed prior to issuance of a certificate of occupancy for the new structure. In order for the Commission to grant a variance, all of the following must be satisfied. FINDINGS OF FACT Exceptional physical circumstances or conditions applicable to the property or intended use of development. which generally do not apply to other properties in the same land use district. The lot is constrained by the topography of the area and by a stream that crosses the rear of the lot. These exceptional physical circumstances are further complicated by the nonconforming size of the lot at only 3,447 square feet and about 45 feet in lot width. While there are many other nonconforming lots in the R1 --Single-family Residential zoning district, few are as physically constrained from development as Lot 1C, Block 13, Kodiak Townsite. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. Strict application of the zoning ordinances would allow only a 10 x 100 foot building envelope on this site. Due to the physical constraints noted above, this building envelope is not developable to any reasonable extent. Because the lot is functionally undevelopable without benefit of a variance, this constitutes an unnecessary hardship for the landowner. The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health. safety and welfare. Based on the site plan dated September 17, 1993, all other zoning requirements, such as parking spaces, rear and side setbacks and building height will be consistent with the requirements of the zoning district. The new dwelling unit will be located well away from the High Avenue right-of-way which will improve the health safety and welfare for property owner's in the vicinity. 4. The granting of the variance will not be contrary to the objectives of the Comprehensive Plan. The comprehensive plan designates this area for high-density residential. Granting a variance to build a new single-family dwelling on a small non -conforming lot will be consistent with the objectives of the comprehensive plan. 5. That actions of the applicant did not cause special conditions or financial hardship from which relief is being sought by the variance. The applicant has not created special conditions from which relief is being sought by variance. This variance request will be decided before the applicant takes any action to develop this site. 6. That the granting of the variance will not permit a prohibited land use in the district involved. Single-faxnily residential development is a permitted use in the R1 -- Single-family Residential zoning district, even on nonconforming lots of record. Proposed variance for 304 High Street, Case 93-062. My wife Sharon and I reside at 306 High Street. Our house is separated from subject property by the 30 foot High Street R.O.W. which extends steeply uphill from the dogleg in High Street. As you probably know, the house at 304 High Street is next to Erskine Creek. This creek drains a considerable watershed. The walls of the gully behind the existing house are quite steep close behind the house, and the slope extends all the way up to our house. We are concerned that excavation to make way for the new house at 304 could result in instability of the hillside. This probably pertains to section 4 of Coastal Management Policies Section, under measures to minimize risk of mass wasting. There is a soil slough on the sidehill of the gully about 50 feet north of the lot 1C property line, and at that point there is only one to two feet of soil above the bedrock. The proposed construction could also be vulnerable to sliding. We would hate to see a Cope Street landslide situation develop on the hillside below our house. If the construction includes well designed retaining walls and drainage structures, risk to us wouldAinsignificant, and we would have no objections. The site plan is sketchy, and does not have any elevation contours to indicate slope steepness. If the variance included provisions to guarantee that the hill will not be undermined, we would feel more comfortable. I believe the proposed construction will need considerable concrete work, considerable drilling and blasting, and considerable heavy equipment operations. It seems to me that there may be an access problem for excavating the new house site and constructing the new stream channel unless the existing house is demolished first. The construction, if it is done right, will be expensive.
