Appeal of an administrative decision to deny a building permit based on a lack of zoning compliance, Section 17.68.020 (Appeals from Administrative Decisions). Regular Session closed: Public Hearing opened: NO COMMENTS Public Hearing closed: Regular Session opened: COMMISSIONER JAMES felt that a building without a certificate of occupancy should not be called a residential building. If the old structure was removed before the certificate of occupancy was issued for the new structure there shouldn't be a problem. COMMISSIONER KNIGHT stated that there is a need to replace nonconforming structures and this is one way of doing it, but there should remain the ability to place restrictions and conditions. Ms. Freed explained that staff would use this as a precedent for interpretation of the Code, so that if someone else came in with a similar request Staff would feel compelled to go ahead and issue a building permit. But at the same time, Staff would use the conditions that may be established for this case as a basis for issuing a building permit. Mr. Wilton White stated that the old structure must be removed before the new structure can be completed because it encroaches into the area occupied by the old building. They would hope to complete the project by spring. COMMISSIONER KNIGHT MOVED TO UPHOLD THE ADMINISTRATIVE DECISION. The motion was seconded and CARRIED with Commissioner Gregg voting NO. COMMISSIONER KNIGHT MOVED TO GRANT RELIEF to allow a building permit to be issued for construction of a new dwelling, with the certificate of occupancy not to be issued until the old structure is removed, and that the old structure shall be removed within one year. The motion was seconded and CARRIED by unanimous roll call vote. COMMISSIONER JAMES MOVED TO ADOPT AS FINDINGS OF FACT: 1. A structure is not a residential structure until a certificate of occupancy is granted. 2. The removal of a nonconforming structure and replacement with a conforming structure is an improvement of the community. The motion was seconded and CARRIED unanimously by a roll call vote. (Jill and Alan Skaw) The information provided in the September 11, 1984 Staff Report is erroneous; specifically the front yard setback figure of 22 feet. Confirmation of the setback, provided by the road construction documents of Thorsheim Street, on file with Larry Monroe, City Engineer, identify the set- back as four feet. Though the building sits back off the road by 22 feet, the right-of-way extends beyond the width of the road. The statements made in the Staff Report, addressing the four criteria to be met in order to grant a variance, remain valid. An additional comment to be incorporated in the section pertaining to exceptional physical circumstances, should also state that including the right-of-way there is approximately 22 feet from the building to Thorsheim Street. Zoning History: The 1968 Comprehensive Plan designates this lot as single-family residential. The Official Zoning Map designates this area as R2, although departmental files show no activity to support this map designation. 7. Location: 302 Thorsheim Street, Part of Lot 1, Block 13, Kodiak Townsite Alaska Subdivision. 8. Lot Size: 4,443 square feet. 9. Existing Land Use: Single -Family Residential. 10. Surrounding Land Use and Zoning: North: Part of Lot 1, Block 13, Kodiak Townsite Alaska Subdivision. Zoning -R2, Use -R1. South: ;Thorsheim Street. East: Part of Lot 1, Block 13, Kodiak Townsite Alaska Subdivision. Zoning -R2, Use R1. West: High Street 11. Comprehensive Plan: The Comprehensive Plan designates this area for "High Density Residential" development. 12. Applicable Regulations: Chapter 17.19 (R2 -Two -Family Residential) Section 17.19.040A states that the front yard setback required shall be 25 feet. Chapter 17.36 (Existing Nonconforming Uses & Structures) Section 17.36.040B (Nonconforming Structures) states: "Should a structure be destroyed by any means to an extent of more than 50% of its replacement cost at the time of destruction, it shall not be reconstructed except in conformity to the regulations for the provisions of this title." COMMENTS: The applicant is proposing to tear down the existing structure and utilize the existing foundation. The foundation is 22 feet from Thorsheim Street and a structure built on this foundation would encroach 3 feet into the required front yard setback. In granting a variance the following critieria must exist: 1. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. The foundation currently sits above Thorsheim Street and is separated from the road by a drainage channel. The bottom floor of the existing structure is not 8 feet high. The main purpose for reconstructing the existing building is to allow for standard 8 foot ceilings. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. The lot is substandard and by meetihg.the required front yard setback, the rear yeard setback required can not feasibly be met. 3. The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety, and welfare. Though the view of the adjacent neighbor will be obstructed by the new structure, it has been obstructed for years by the existing structure. The height of the new structure will be the same as that of the old structure. 4. The granting of the variance will not be contrary to the objectives of the Comprehensive Plan. The granting of this variance is consistent with the objectives of the Case 84-101 -2- September 11, 1984 Comprehensive Plan. RECOMMENDATION: Staff recommends approval of this variance request as it meets all the requirements of Chapter 17.66 Variances.
