meeting opened. The Chairman made two comments: 1) If we are taking the
average setback of houses on this street and using this as a criteria, we are
looking for orderly development - esthetic approval. 2) The intent of the
Code was for uniformity. Also, the bank in front of Mr. Bulen's home is for
a retaining wall. Mr. Logan moved to approve a setback variance of 12for
Lots 10 and 11, -Block 35, East Addition (William Bulen). Mr. Pugh seconded
the motion. Motion passed by unanimous roll call vote.
Portion of Lot 12, Kodiak Townsite. Request for approval of a Home Occupation,
Lynda:Shepard. Mr, Mulitalo stated that Mrs. Shepard plans to conduct a
thrift shop in her home. In reviewing the request, the following observation
are to be noted: 1) The Lot is only 3300 square feet, 2) There is no access
road to the property, and 3) The proposed business will bring traffic, and
parking is a problem. Staff recommends the Commission deny the request. The.
Chairman closed the regular meeting and opened the public hearing.
Lynda Shepard: Letter had been received from ASHA noting that requested access
is dedicated for public use. Mrs. Shepard stated that parking on Brooklyn
Terrace is for public use. There would be no employees hired for the Thrift
Shop.
Rob Shepard: Only access to the property is stairs on. the Springhill proiPerty.
Plans are to build stairway on ASHA property. Does not see parking a problen4
Feels there is a need for a Thrift Shop in. Kodiak.
Mrs. Betty SPringhill: Opposed. Has property adjacent to Shepards'. Parking
will be a problem. Mrs. Springhill stated that the front half of -their lot i$
zoned Business Commercial and back half is zoned R-13. Only objection is
multiple parking problem.
Hazel Ardinger: Not really opposed. Owns the lot above and to the back.
Only concern,is fire, as buildings are close in proximity.
Public hearing closed and regular meeting opened. Mr. Pugh moved to approve
the request for a home occupations for a portion of Lot 12, Kodiak Townsite
Subdivision (Lynda Shapard). Mr. Busch seconded the motion. Discussion
followed. Mr. Pugh stated portions of Chapter 17 of the KIB Code be read into
the record. Also suggested the Commission contact the City Manager regarding'
parking in Berg Motors' area. Mr. Mulitalo stated that the application does
_not come under Home Occupations, rather, under Section 17 Item D. Motion
failed 4-3 with Mr. Anderson, Mr. Ball, Mr.. Erwin, and Mr. Williams casting
NO votes.
• Rezone Lots 27 A and B, USS 3098 from Unclassified to Business (Craig Bishop)1
M. Milligan stated that the request for rezoning is from Unclassified to
Business. The petitioner owns 1.24 acres contained within two lots located
on Mill Bay Road outside the City limits. The property is adjacent to the
City of Kodiak's Public Works Shop. The property has Service Recreational
zoning abutting to the rear, East Elementary, and Business zoning
classification which is the City Shop. It has mixed residential uses located•
across the street from the airport. Immediately adjacent from south side of
the street is Residential, zoning. Mr. Milligan stated that the case is being
presented as an adjustment to an existing zoning district boundary. A devel-
opment plan was presented to the Commission.
The Chairman opened the public hearing.
Mr. Craig Bishop: Stated his intention is to build a two-story building as
outlined in the submitted Plan. Buildings will be setback more than the
required distance.
Opposed: None.
Mr. Busch moved to rezone Lots 27A & B, USS 3098 from Unclassified tp Business
(Craig Bishop). Mr. Anderson seconded the motion. Motion passed 6 to 1 with
Mr. Logan casting the NO vote.
D. Rezone Lot 10, Kodiak Townsite from R-3 to Business (Dave Bean).

Motion passed with unanimous roll call vote.

•Mr. Milligangave the staff report and stated that the petitioner is
...requesting a variance from the requirements of Section 17.57.010 B 11 of
the Kodiak Island Borough Code.of.-Ordinances which requJres that'hotels
provide parking. at the ratio of one.space for..every three rooms. The
.,,request for. parking is at the ratio of one space persix rooms.'The'devel-a
oper:is proposing to construct' a motel.onthe, property that will. have. .
banquet facilities, restaurant, .bar, .barber: shop, .and hotel- guest -rooms.-
The four -conditions required for variance have been meta Chai_rman.Williams

proposal, presented a brief summary. Site plans and floor plans. were _

concerned with parking, and circulating traffic.

Motion—passed-5—to 2 with Mr Erwin and .Chairman Williams casting. the NO-,
votes. Discussion followed.., Mr. Logan,• in comparing the other hotels in
Kodiak, with parking spaces available, stated that they are not. consiStenf
with the -code. He also stated that Mr. Mayberry comes closer to.conssteney
:with the needs of the community than any other business. Chairman Williams
pointed.out that the businesses -mentioned may well be nonconforming uses.:

Mrs. Lynda Shepard is requesting permission from the Planning and Zoning
Commission to permit her to operate a Thrift Shop in her home.
Mr. & Mrs. Shepard own the dwelling known as the Banana House. This
property is located behind the Captain's Keg Restaurant, portion of Lot 12
Blk 16 Kodiak Townsite. The property is zoned R-3.
In reviewing this application, we have made the following observations:
1. There is no access road to the property.
2. The lot is approximately 3,300 square feet.
3. The type of business proposed will bring traffic to the area.
4.. The lot is surrounded. by R-3 properties.
5. Parking is a problem in this area.
Section 17.18.010 3 (D) says that other uses may be permitted in R-3
district based in the type of service or goods sold, in the number of persons—r'
employed, in the number and types of vehicles attracted to the premises and in
the effect upon adjacent areas. The P. & Z. Commission after a public hearing
can make that determination based on the conditions as we have outlined.
Staff recommends that the petitioner's request be denied.

requesting access to your property which apparently is designated
as Lot 12E, Block 16, Townsite Addition to the City of Kodiak.
We are enclosing for your information allegible copy of Plat 72-2
indicating the boundary line of the New ,Kodiak Subdivision (which
is the R-19 Kodiak Urban Renewal Project) near or adjacent to your
property. Referring to Plat No. 72-2 and the Land Disposition Plan
it seems apparent to us that the specific area you are requsting
access through has been dedicated for public use. For your easy
referral, we have marked the area in red.
Concerning your question relative to operating a small thrift shop
from your residence, we can offer no assistance. That, is a local
matter that should be referred to the City and Kodiak Island Borough.
It is suggested that you make your request to the Cit?of Kodiak
who has jurisdiction over land designated for public use.
We are transmitting a copy of this letter to the City of Kodiak
for their information.
