Does the borough have the resources to do something like an as -built? I'm thinking that it would be good to identify what is on state land and what is on Ferris land. From the photos„it looks like a significant portion of the junk is on state land. I did some legal research - there is not a lot of Alaska law on this point but Alaska RR Corp v. Native Village of Eklutna, 43 P.2d 588 (Alaska 2002) holds that unless the state is making use of its land for state government purposes, it is subject to municipal zoning ordinances. So, if we can get the as -built (maybe "as -trashed"), the next step would be to send to DOT (the commissioner and the attomey general) an administrative decision similar to the 10/22/02 one to Mr. Ferris. Actually, it may be appropriate to list both on one decision and then to send it to both. This will snake greater sense if there are items straddling the line. Please let me know what you think. I have called Martin Lydick with the borough planning and zoning, and he suggested that my' first step would be to lodge a formal complaint with the Kodiak Police Department. Mr.' Lydick expressed his own frustration with the problem. He suggested I take pidtures of the vehicles and get license numbers. Enclosed you will find that information. This problem has been frustrating me for years. When people visit our community, they are charmed with its natural beauty and shocked by the trash. I agree with their assessment. If we want to develop our tourism, we must get our city cleaned up. It is frustrating to participate in the Kodiak clean up year after year for 22 years and then see the same large junk not moving. I have spoken to other communities about how they handle the problem, and they all talk about strict rules for property owners. The problem is more than one of aesthetics. When trash is allowed to accumulate, it attracts more of the same. Years ago we had a graffiti problem in this town. One of the ways we were able to slow it down was to immediately remove it or cover it. The same applies to trash and abandoned vehicles. This is also a health hazard. Rats breed in areas of trash. I noted several of the vehicles were full of alcohol bottles. There is broken glass around the vehicles, and I notice several have recently had their windshields broken out. This is known as an attractive nuisance. I also found new toys around the wrecked vehicles indicating that children play there. It is very unsafe. Even walking around taking pictures was dangerous because of the hidden trash and glass. I keep my own property clear of junk and trash, and I expect other property owners to do the same. It is the responsibility of ownership. If there is anything more I can do to assist with this problem, please don't hesitate to call. I would like to be kept informed of how this problem is being rectified. I have called Martin Lydick with the borough planning and zoning, and he suggested that my first step would be to lodge a formal complaint with the Kodiak Police Department. Mr: Lydick expressed his own frustration with the problem. He suggested I take pictures of the vehicles and get license numbers. Enclosed you will find that information This problem has been frustrating me for years. When people visit our cominunity, they are charmed with its natural beauty and shocked by the trash. I agree with their assessment. If we want to develop our tourism, we must get our city cleaned up. It is frustrating to participate in the Kodiak clean up year after year for 22 years and then see the same large junk not moving. I have spoken to other communities about how they handle the problem, and they all talk about strict rules for property owners. The problem is more than one of aesthetics. When trash is allowed to accumulate, it attracts more of the same. Years ago we had a graffiti problem in this town One of the ways we were able to slow it down was to immediately remove it or cover it. The same applies to trash and abandoned vehicles. This is also a health hazard Rats breed in areas of trash. I noted several of the vehicles were full of alcohol bottles. There is broken glass around the vehicles, and I notice several have recently had their windshields broken out. This is known as an attractive nuisance. I also found new toys around;the wrecked vehicles indicating that children play there. It is very unsafe. Even walking around taking pictures was dangerous because of the hidden trash and glass. I keep my own property clear of junk and trash, and I expect other property owners to do the same. It is the responsibility of ownership. If there is anything more I can do to assist with this problem, please don't hesitate to ca I would like to be kept informed of how this problem is bemg rectified. A decision of the community development department director is final unless appealed to the Planning and Zoning Commission within ten (10) working days of receipt of notification of the decision. B. An appeal is commenced by filing with the community development department a written notice of appeal, specifically stating the reason for the appeal, the relief sought, and payment of the appropriate fee ($150.00). Upon commencement of an appeal, the decision appealed from is stayed until the decision on appeal becomes final. Failure to comply with the requirements of the Kodiak Island Borough Code may subject the property owner to certain civil penalties. Per KIBC 17.75.030 [Penalties and remedies.] A. A person who violates any provision of this title, an order issued under subsection 17.75.010(A) of this chapter or any term or condition of a conditional use, variance or other entitlement issued under this title, is guilty of a misdemeanor and upon conviction is punishable by a fine of not more than three hundred (300) dollars, in addition to the surcharge required to be imposed under AS 12.55.039. B. C. Each act or condition violating this title, any order issued under subsection 17.75.010(A) of this chapter, or any term or condition of a conditional use, variance, or other entitlement issued under this title, and each day during which the act or condition exists, continues, or is repeated, shall be a separate and distinct violation. Failure to comply with the mandates of this determination within thirty (30) days, (by December 19th 2001), will require that this file be forwarded to the Borough Attorney for further legal action.
