Rezoning R3 to R2, Townsite Blk 14, Bots 1-6, Blk 19, Lots 16-40 (Case #70) Public Hearing Case reviewed and ordinance read. Mr. Lester moved for adoption of Ord. 66-6-0. Seconded by Mrs. Hajdu. Public hearing declared open. Mr. Costello, owner of Lots 5-9, Blk 14, spoke against rezoning of Lot 6 since he wishes to build apartments there. Mr. Saupe agreed to Lot 6 remainingiR3 if remaining lots were rezoned to R2. Mrs. Kessler spoke against the rezoning since she wants to build apartments later. Mr. Cornelius, representing several people in the area, spoke in favor of the rezoning. After further discussion, public hearing was closed and motion was amended with concurrence of second to approve adoption of Ordinance with the deletion of Lot 6, Blk 14. Rezoning Clinic Property (Townsite Blk 8 Lot 1 and USS 444 Tract D) from R3 to Business (Case #71-A) - Request withdrawn and ordinance cancelled. C.= Rezoning Townsite Blk 16 Lots 5-8,and 12-17 from R3 to,Business (Case 1101-B) Second Reading and Public Hearing Ordinance was read. Mr. Lester moved for adoptinn of Ordinance 66-7-0. Seconded by Mrs. Hajdu. Public hearing declared open. Ken Brandenburg, speaking for ASHA, objected to rezoning since part of these lots will be included in Urban Renewal area. Rezoning to Business might affect the acquisition of these lots since the value of them might be higher if they were zoned business. Mrs. Springhill and Mr. Craig objected because they feared taxes would be raised. Mrs. Kessler, in favor of rezoning, objected to waiting for takeover by Urban Renewal. Mr. Best spoke of necessity of establishing a line between the Business and R3 areas. After considerable further discussion, public hearing was closed and motion defeated by unanimous roll call vote. Mr. Lester made a motion that the ordinance be rewritten to include only those lots presently cut in half by different zoning, specifically Lots 15 and 17. Seconded by Mrs. Hajdu and carried by unanimous voice vote. D. Appeal to P&Z Decision on Rezoning of Erskine Addn, Various Lots Blks 5-9, from R2 to R3 (Case Nos. 1D and 1E) - Public Hearing and Board of Adjustment Notice of public hearing read. Public hearing declared; open. Mr. Harry Wallace, Mr. Hohn Welch, and Mr. Harold Heglin spoke against rezoning. Mr. James C. Merves, Attorney, representing Chris Berg and those appealing, spoke for rezoning. Mrs. Hajdu brought out that there was a previous Attorney's opinion against spot zoning. Mr. Starbird stated that he thought some of the people for rezoning were already in violation of the ordinance. Mr. Gransbury spoke of advantage of rezoning Mr. Walls' lots to Business. Representative of Karluk Co. stated that they are in favor of rezoning. Jim Stansbury stated that violations of the ordinance do exist in the area. Mr. Wright spoke against rezoning. Public hearing was closed. Mr. Lester made a motion to grant the appeal for rezoning from R2 to R3 of the area describediin the appeal. Seconded by Mrs. Hajdu. After further discussion, motion._. defeated -by unanimous roll call vote. VI H. Request for Rezoning Erskine Blk 9 Lots 115-117, R2 to Business - Paul T. Walls (Case #132-A) After some discussion, Mr. Gransbury stated that the planned parking lot would provide a buffer between the residential area and the office building, and that the building would not be high enough to block the view. After further discussion, Mr. Lester made a motion to deny the request for rezoning. Motion died for lack of asecond. Mrs. Hajdu made a motion to table this case. Seconded by Mr. Lester. I • 9 ASSEMBLY MEETING - March 17, 1966 2 was suggested that the present hospital property, which is stated owned, could be transferred to the City or Borough and sold to raise; funds. The site was discussed, and it was agreed that no site will meet all, requirements. After further discussion, Mr. Lester made a motion that a $300,1,000 bond issue to support the Borough's share of the financing be placed on the ballot when the election is held on approval for the Borough hospital. Seconded by Mrs. Hajdu and carried unanimously on roll call vote and so ordered. i A. Letter from Wakefield Fisheries re Land Acquisition in Port Lions Area Letter and a second letter on same subject were read for information purposes. No action taken. C. Letter from City re Temporary Exception Granted to Wright & Welborn by P&Z Commissio Chairman White read letter requesting that the Assembly reverse P&Z's decision on the case. Chairman White objected to the granting of a temporary exception, stating that this is not covered in the ordinance. After further discussion, Mrs. Hajdu made a motion that the P&Z decision be reversed because it is actually a re -zoning, regardless of what it is called. Seconded by Mr. Lester. Mrs. Hajdu expressed concern about the granting of exceptions, and felt they should be rezonings instead. Chairman White stated he felt that granting temporary permits was a way of rezoning without going through the proper rezoning procedure through the drawing up of an ordinance. Attorney Madsen stated that P&Z can always be overruled by the Aasembly if it is deemed necessary. Comm. Best stated from the audience that by granting an exception in this ease, certain conditions could be added to it, whereas if the area had been rezoned, no such controls could have been stipulated. After considerable discussion, Mr Wright disqualified himself, and motion carried on roll call vote as follows: Yes No Haakansen Lester Hajdu It was brought out that although the city had been notified of the case, the notice had been caught up in the heavy receipt of mail at the City office. In the future the City will be notified by telephone as well as by mail. It was suggested that Wright & Welborn apply for a rezoning of the area to industrial. Mr. Wright stated that time did not permit their waiting even two or three weeks. Mr. Lester made a motion that the Assembly re -consider the action just takes, leaving the two provisions put in by P&Z and adding an additional one that use of the land be discontinued if it interferes with the action of the airport. Motion died for lack of a second. Mrs. Hajdu made a motion that the Borough Attorney be directed to meet with the P&Z Commission and come up with revisions to the ordinance that would make sense to everyone. Motion died for lack of a second. After further discussion, a ten-minute recess was called at 10:10 P.M. Old Business A. Ordinance 66-5-0, Rezoning USS 3098, Lots 28, 29A and 29B,from Unclassified to Business, Russell Wright (Case #38) -Second Reading and Public Hearing Ordinance was read. Mrs. Hajdu made a motion for its adoption, seconded by Mr. Lester. Public hearing was declared open and there were no comments. Hearing was closed, and Mr. Wright disqualified himself. Motion carried by unanimous roll call vote. B. Ordinance 66-6-0, Rezoning TownsiteBlk 14, Lots 1-6, Blk 19, Lots 16-40, from R3 to R2, Petitioners (Case #70) - Second Reading and Public Hearing Ordinance was read. Mr. Lester moved for adoption, seconded by Mrs. Hajdu. Public hearing was declared open. Area was pointed out on map. Mr. Costello, from audience, objected to rezoning as he wishes to build an apartment building on Lots 7 and 8 of Blk 14. Mrs. Kessler stated that she wishes to withdraw her signature from the original petition requesting rezoning since this area now is the only one remaining for apartments, and there are some lots large enough for this purpose in the area --Lots 37-40 of Blk 19. Chairman White read a letter from the City requesting that a decision on the case be deferred until the next meeting so that the City Engineer and City Manager may fully evaluate the effects of the proposed rezoning. Public hearing was closed. Mr.ILester withdrew his motion with Mrs. Hajdu's permission. Mr. Lester moved that action be deferred on the case until the next meeting. Chairman White introduced Mr. Sven Haakansen of Old Harbor as proposed candidate to fill Assembly seat vacated by Mr. Mathey Fitzgerald. Upon motion of Mr. Brechan for appointment, seconded by Mrs. Hajdu, Mr. Haakansen was voted in on roll call unanimous vote. The Clerk, directed by the Chairman, swore Mr. Haakansen into office. KODIAK ISLAND BOROUGH ASSEMBLY REGULAR MEETING - MAY 6, 1965 ("1 The meeting was called to order by Presiding Officer Russell Wright at 7:30 p.m. in the Courtroom. PRESENT WrightRussell Fred Brechan Wilton White ABSENT Tony Perez Dick Pace' Also present: Borough Chairman Pow.11 and Attorney Madsen Minutes of the 'Previous meeting of April 15 were read and approllred as read. Final approval of the Herman Vest Subdivision request was submitted to the Assembly. Assemblyman Brechan moved that lot 12 USS 3101 be approved seconded by Assemblyman White. Passed unanimously. Then followed the publich hearing on Ordinance 65-3, building, electrical and plumbing codes. The general consensus of the audience participation were in favor of the Ordinance. After a lengthy discussion Assemblyman White moved that Ordinance 65-3 be adopted as presented, seconded by Assemblyman Brechan. Passed unanimously on roll call vote. Resolution 65-6 was brought before the Assembly and after discussing the various Borough officers and personnel to be covered under surety bond, the Assembly asked the Chairman to check with the City and other Agencies as to the normal amount of surety bonds needed. Assemblyman Brechan moved to adopt Resolution 65-6, seconded by Assemblyman White and passed unanimously. A request for rezoning of lots 1-16, Block 14 and lots 16-40, Block 19, Kodiak Townsite by Lynn Saupe referred from the Planning and Zoning Commission for the Assembly for final approval was taken up. Assemblyman Brechan Moved to concur with the Planning and Zoning Commission in rezoning the area requested, seconded b_eissemblyman White and passed unanimously. Don Erdman's request for placing an additional trailer on lot 4, USS 3100 was presented and it was felt that this should be developed under the terms of the Borough's Trailer Park Ordinance and that Mr. Erdman be allowed to place a trailer there on the same basis as other trailers before in the outlying areas for a period of one year from March 27, 1965. The Chairman was so advised to instruct the Planning and Zoning Commission and Mr. Erdman. A letter from Claude Hoffman, Cadastral Engineer, State Division of Lands, was read to the Assembly requesting a variance in the Borough Subdivision Ordinance 64-4 to allow a lesser number of monuments to be placed than the ordinance called for. After discussion on the Planning and Zoning Commission's action of the previous evening, Assemblyman White moved that their request for the variance be denied, seconded by Assemblyman Brechan, and passed unanimously on roll call vote. Vouchers 418 through 440 were approved as presented. There being no people in the audience to be heard Chairman Powell brought up for discussion a moving of building from the urban renewal area into the East Addition particularly buildings which were previously used for multiple dwelling use because the East Addition is zoned for single family dwelling units only. One comment was made that the buildings should meet the building code for the area they are going into. KODIAK ISLAND BOROUGH ASSEMBLY May 6, 1965 PAGE 2 Assemblyman White brought up the City's position on waiving taxes on personal property within the City limits. Chairman Powell stated he felt the City should wait until the City and Borough budgets and the assessments were complete before the City should make a decision on this matter. The assemblymen also discussed the assessment program and the Board of Equilization which was to begin May 10 and because of the late mailing of the assessment notices the date for the Board of Equilization to begin meeting was changed to May 20. There is a need for; expression of Borough plans so that they can be included in the state comprehensive plan. It was felt by Nr. Smith and I1r. Lots 44,45,46, and 47 Block 19, Kodiak Townsite are presently zoned as multi -housing and a verbal request by Bruce Smith for a waiver of the rear yard requirement of 25 feet was made. Commissioner Felton moved that he be permitted to decrease the rear yard requirement to 15 feet. Seconded by Commissioner Anderson and carried Chuck Edris made a verbal request to place a temporary trailer on Lot 26, USS 3099, during construction of a house for Mr. Johnson. A sketch ofth�le lot showing a present dwelling and trailer in addition to the trailer in question, all feeding a. single septic tank, was presented. The house to be constructed�is on a different lot. Commissioner Franklin moved that permission be granted, on�a temporary basis not to exceed two years from March 27, 1964, provided that approval of the State Sanitarian is obtained. The hearing on Naughton Brothers Inc. request for a variance on Lot 1, USS 3462 to permit R3 construction was held. Hearing no objections, Commissioner Franklin moved that the request for variance be approved. Seconded by Commissioner Cornelius and carried unanimously. The hearing on Dal Valley's request for a variance on Lot 1,2,13 and 14, Block 6, Leite Addn. to permit R3 construction was held. John Sautner asked about taxes and future variations in the area. The hearing on Allen Bayless' request for a variance on Lot 28,, USS 3099 to permit commercial development. Engineer Barr spoke against individuaIJ, variances instead of zoning changes. The request for variance was approved unanimously. A hearing was held on DeWitt Fields! petition to permit construction of a construction camp and trailer court on Lot 1, USS 3100. The request for variance was approved unanimously. No hearing was held on Carl Speight's request for a variance on Lots 7, and 8, East Addition Extension, Block 38. Commissioner Anderson moved that the exception requested by Carl Speight to permit a 15 foot rear yard for Lot 4, Block 52, East Addition be approved. Seconded by Commissioner Cornelius and carried unanimously. /A letter from Claude Hoffman, ADL, dated April 23 was read requesting a waiver on the Borough monument requirements for USS 3462. After discussion, Commissioner Franklin moved that the variance be granted due to the desire of the community - to have these lots available as soon as possible and is because of current lack of monuments and for no otherreason. Seconded by Commissioner Duros and lost. ADL is to be informed. (3 to 2 vote.) A discussion of the Alaska Dept. of Highways proposal for a maintenance_shop in USS 3469 was introduced by Borough Chairman Powell. The Alaska Division of Lands is proceeding with the preparation for sale and requests no action. Commissioner Cornelius moved that no-Nariance be granted other than for residential use with the area of USS 3469. Seconded by Commissioner Anderson and carried unanimously. Borough Chairman Powell opened a discussion on moving of buildings from the Urban Renewal area to the East Addition. He also raised the question of moving of houses from Afognak. Ed Cgborn appeared stating that he had sent a request for permission to build a concrete block building on Lot 19, Block 1, Kodiak Townsite for'use as a shop and for some reason it was not on the agenda. Commissioner Felton moved that an exception be made permitting this replacement construction. Commissioner Franklin seconded and carried unanimously.
