Childs, Pastor of the Community Baptist Church, to the Kodiak Island Borough Planning and Zoning Commission, which you forwarded under a cover memorandum dated March 19, 1973. In that cover memorandum you requested that I advise you if the proposed use was not permitted in an R-3 Zone. The letter from Pastor Childs relates the information of Community Baptist Church to provide sleeping facilities on a temporary basis to persons visiting or seeking employment in Kodiak, who have not secured other permanent living quarters. In effect, the Church is providing floor space foi sleeping bags and making toilet facilities available to yogng people in a restricted area of the Church on a limited basis. The proposed use is not authorized by Section 5-A73 for -areas zoned R-3. I have carefully reviewed each Of the permitted uses in subsections A through G, and haye determined that the contemplated use is not permitted. A summary of the subsections which might appear to authorize the use, and the reason why they are not applicable, is as follows:' (A) One -family, two-family and multiple -family dwellings. A "dwelling" is defined by Section 9-B of the ordinance as a building or portion thereof "designed and used exclusively for residential occupancy . . ." Since the building in question is designed as a church building and used primarily for other than residential occupancy, it would not satisfy the criteria for a multiple -family dwelling. Under Section 9-B, on page 5.2.6, boarding house is defined as follows: A building other than a hotel with not more than five sleeping rooms where lodging, with or without meals, is provided for compensation for three or more persons, but not exceeding fifteen persons, on other than day to day basis and which is not open to transient guests. Since the accomodations at the church are provided without compensation, and are available primarily for transient guests, they would clearly not fall in this category. (E) Assessory buildings and uses not used or operated for gain and not including guest houses or accessor living quarters. As used in the ordinance, "accessory use" means a use customarily incidental or, subordinate to the principle use of the structure. It would appear that a church is not "customarily" used as a transient housing facility. Moreover, the specific exclusion for guest houses or accessory living quarters indicates an intent to prohibit the housing accomodations in question. (F) Churches. The establishment of churches as a permitted use within R-3 zones could not be interpreted to contemplate the use of those church facilities in the manner presently in question. In view of the foregoing, it would appear that the use in question is prohibited unless the provisions of Section 10-B-2 are complied with. Subsection 2 provides that: Uses other than those specifically permitted in each of the districts may be permitted therein, provided that such uses are similar to those mentioned and are deterMined by the Planning Commission to be not more obnoxious or detrimental to the welfare of the community than the permitted uses. Letter from Community Baptist Church Re: Occupancy of living quarters in the Baptist Church during the summer. Mrs. Holt read the letter to the public for information. The zoning in this 'area is R-3. The Borough Attorney stated that P&Z could not grant an exception for this type of case but they coud grant a certain type of special policy. Mr. Erwin stated we should check with the Fire Marshall f;r any objections he might have. Mr. Erwin moved that if the Fire Marshall has no objections on the sleeping quarters in the Baptist Church, P&Z concurs with his decision. ,,econded by Mr. Terry. Motion passed by unanimous roll cal -1 vote. Letter from Rolland Jones with recommendations on'the Wakefield Subdivision - Mr. DeVaney is checking with the Engineer on the recommended changes. Mrs. Holt statedif the committee wants to concur with Mr. Jones recommendations we will notify Mr. DeVaney and Mr_.Jones as such. Mr. Terry moved that we concur with Mr. Jones proprosal and send this back to him for Replat as per the new State regulations Seconded by Mr. Erwin. Motion passed by unanimous roll call vote. The Borough Office will also check with Kyle Cherry, of the Environmental Protection Agency. WE ALSO ALLOWED USE BY PERSONS WHO CAME TO KODIAK TO WORK FOR THE SUMMER, THEY PUT DOWN THEILR SLEEPINGI BAGS ON THE FLOOR/ IN, A RESTRICTED AREA/AND THEIR STAY WAS LIMITED TO TWO WEEKS -- ONLY A'FEW STAYED THE FULL TWO WEEKS.
