These recyclable items include: cardboard, newsprint, white and color paper, aluminum, plastics and other non putrescible items. Your organization's efforts to make recycling more convenient for residents are applauded. Convenience is one of the ways to change the culture of how waste is disposed of around Kodiak, and your, woden "containers" make that convenience possible. Specifically, our power to collect garbage, rubbish and other solid waste is set up to operate as a municipal utility as regulated by KIBC 8.20. That power gives the Borotigh control over the collection and disposal of solid waste on the road system. That is, not just anyone can decide to collect garbage or operate a landfill on their own. In fact, the code prohibitsthat from occurring. It states that "no person may transport rubbish or trash to any location off-site for the purposes of disposal (e.g. burning, land filling, etc."). That is a duty and responsibility reserved to the Borough Assembly and who they choose to work with. The Assembly has made a conscious decision to work with Threshold Services, Inc. on promoting recycling., As you know, the Assembly has funded your organization in an effort to effectively remove certain classes of items from the waste stream, thereby saving valuable landfill space. Therefore, I view these recycle sheds as a "container" to deposit the types of rubbish that can be recycled. Their purpose is similar to a dumpster. The difference is that dumpsters are generally containers where putrescible material is collected while your containers collect those non- putrescible materials that can be recycled. Based on the above, your recycle sheds will not require a zoning complianCe permit under Title 17, but are viewed as a solid waste container under Title 8 of the Borough code. This decision does not have any bearing on the need to acquire any building permits that!may be needed. Should you have any questions, please call me. I was unaware that the plans needed to be sent to ICBG for review prior to the City issuing a building permit for construction. I do see a problem with the month turn around for the review. JIM NAGAN, resident of Cove Trailer Court for four years, appeared before the Commission to voice his objection to the request. MR. JOHN WITTIVEEN, previously.a resident of Cove Trailer Court, stated that this was a human issue concerning the displacement of the residents and went on record in opposition to the request to rezone. MR. ED JACK, neither for nor against the rezoning, stated that the property is listed as a flood plain and if there is any plan to develop multiple housing, the Commission should be advised that such a listing precludes housing, except under Grandfather rights. MR. TOM HEALEY, indirectly affected by a previous rezoning request, spoke of the human issue involved and was opposed the the request. MR. DAVID COOK, representing the Kodiak Baptist Mission (leases property adjacent to the parcel up for rezoning), preferred main- taining the property in a residential setting rather than Business. The Mission maintains a residential child care facility on the adjacent property. MS. Pursuant to your request for information on the setbacklrequire- ments for a proposed 60' X 100' structure to be located on lot 30, block 1, Kodiak Townsite Alaska, USS 2537B, please be advised of the following: If the lots owned by Ms. Christoffersen and Mr. Colvaho are purchased, the total land area available would be 24!,475 square feet.1 Please note that the smallest parcel owned by Ms. Christoffersen is only 600 square feet and is located at the north-easterly portion of lot 30, and is not contiguous to the other three parcels under consideration. I have not used this parcel for figuring the required setbacks, but have used this land area for full -filling required off street parking spaces. The setback requirement for a building in the R-3 mulltiafamily residential district are: Front yard: 25 feet minimum unless any adjacent structures are built closer to the front property line, then an:avrage may be taken to establish the front yard setback required. Side yard: 10% of lot width, in this case, 10% of an average lot width of 132' gives a side yard of 13.2 feet. Rear yard: 25% of lot depth, but need not exceed 25 feet. The average lot depth for the parcels proposed is 21'6 feet, the required setback would be the 25 foot minimum as 25% of 216 feet is 54 feet. Your required off street parking for a 6,000 square foot (60' X 100') structure used for a "Senior Citizen Center/,Protected Residential Care Facility" would be one space, 160 square feet in area (8' wide by 20' feet long) for every room used for • Kathy Graham Page 2 January 26, 1982 residential purposes. Please note that recreational areas and storage facilities within the building are figured by a different criteria. Each separate use may or may not have its own parking area requirement depend- ing on the specific use intended. It is safe to assume one space for each residential room provided. Specifics can be determined after the exact use for each area within the structure is known. With regards to lots 9, 10 and 11 in this same area, please be advised that they are zoned business and contain a total of 51,511 square feet in land area. Within this zoning district your intended use of the lots is not expressly permitted as a use, and you would therefore be required to go before the Planning and Zoning Commission for -and exception to allow residential use of a business zoned lot (s) without also providing a business use concurrently within the same structure. Another avenue to pursue would be to apply to rezone lots 9, 10 and 11. Or lastly, simply provide fora business use within the same structure. Whatever way you go, your required setbacks for a structure on this lot are as follows: 1. If a business use is not provided within the proposed structure then the normal residential zoned setbacks are required (Same requirements to be used as in lot 30) and 2. Those discussions spawned the need for adequate planning 'up front' on whatever course of action might be taken by the community. To that end the Senior Citizens of Kodiak established a Steering Committee for the examination of various housing/pioneer home/senior center alternatives or combinations. That committee (membership roster is attached) has met twice, September 18 and December 30. Its focus to date has been on producing a survey of seniors to determine the need for housing alternatives. That has been accomplished. The board! of the Senior Citizens of Kodiak are now negotiating with CoMmunity and Regional Affairs for a planning grant not to exceed $50,000 to study housing/senior center needs including site selection, etc. B. Proposed Development Plan including Property Acquisition Priority #1 --Acquisition of adequate land and the construction of a" senior center/protected residential care faci1ity. A. The center's first choice for a site is the adjacent property situated_across Erskine Ave. from Bavyiew Terrace Apartments. The present owners are: Ms. Annie Christoffersen (3 parcels) and a Mr. Corvaho (1 parcel). A rough estimate of the ajoining parcels yields 19,259 sq. ft. The legal description of the property is.Lot.30, Blk #1, Original Kodiak Townsite. (see attachment) B. The board would propose to use the planning funds to explore various combinations of facilities on this parcel. At this point the board sees a need for a building, 2 stories, with dimensions of 100.'
