Box 1504 Kodiak, AK 99615 710 MILL BAY ROAD KODIAK, ALASKA 996,15.6398 April 11, 1996 Re: Zoning Violations, Noise Complaint Lt. 1, Bk. 4, Monashka Bay Subdivision (1412 Sawmill Circle) Dear Mr. Grothe: Recently, I received some complaints about your tenants at the above-mentioned location occupying a travel trailer and running a generator at all hours of the day. According to Kodiak Island Borough Code section 17.53.050, occupation of a rec'reati'onal vehicle on a residential lot is allowed only after a zoning compliance permit has been issued, if required off street parking spaces are not occupied and if the trailer is not located,in the road right- of-way. If all of these conditions are met, the trailer can remain onthe lot for not more than sixty (60) days in each twelve (12) month period. Therefore, even if all of the above-mentioned conditions are met, the trailer must be moved from the lot no later than June 10, 1996. Although the borough has no policy regulating noise, your neighbors would appreciate if the use of the generator was discontinued or limited. Another zoning violation on the property is the occupation of the two cabins on the lot. According to.KIB Assessing files, both cabins were being rented out in' 1993. This is a violation of the description and intent of the Rural Residential One (RR -1) Zoning District, Kodiak Island Borough Code section 17.17.010, which only allows one dwelling unit per lot. In addition, no zoning compliance or building permits mere ever issued for either of the cabins and there is some question as to the existence' of a required septic system on-site to serve either of the cabins. Page 1 of 2 In summary, to resolve these zoning violations, a zoning compliance permit must be obtained for the travel trailer, limiting its stay on the property to no more than sixty (60) days. You also must obtain zoning compliance and building permits for the structures built illegally on the lot in 1982. To ensure that only one dwelling is being occupied, I will need to inspect both cabins. Finally, the Alaska Department of Environmental Conservation may require that a septic tank or some other sanitation system be installed to serve the lot.
