Lots 1 and 2 of KEA Subdivision are rezoned from R -3 --Multi Family
Residential to B --Business.
The official zoning map shall be updated to reflect this rezoning.
Findings as to the need and justification for the change:
The rezone of Lots 1 & 2 of KEA Subdivision, U.S. Survey 1995 from, R-
3 --Multi Family Residential to B --Business, is necessary and justified
because the B --Business Zoning District permits development that:
A. is consistent with the existing zoning surrounding this site; and
B. will facilitate consolidation with surrounding business lots prior to
development; and
C. will bring the existing land uses closer to conformity and will not
create additional con -conforming land uses in the subdivision; and
D. will not generate traffic in excess of the capability of recently
improved Tagura Road.

Case 91-056. Request for the rezone of Lots 1 & 2 of KEA
Subdivision, U.S. Survey 1995 from R -3 --Multi Family Residential to
B --Business, in accordance with Section 17.72.030 (Manner of
Initiation) of the Borough Code. Lots 1 & 2, KEA Subdivision, U.S.
Survey 1995 (610 Mission and 615 Tagura).
Dear Mr. King:
The Kodiak Island Borough Assembly, at their meeting on November 21,
1991, approved the rezone request cited above.
The Assembly adopted the following findings of fact in support of their
decision:
1. Findings as to the Need and Justification for a Change or Amendment.
The rezone of Lots 1 & 2 of KEA Subdivision, U.S. Survey 1995 from R-
3 --Multi Family Residential to B --Business, is necessary and justified
because the B --Business Zoning District permits development that:
A. is consistent with the existing zoning surrounding this site;
B. will facilitate consolidation with surrounding business lots prior
to development;
C. will bring the existing land uses closer to conformity and will not
create additional non -conforming land uses in the subdivision;

site for primarily Light Industrial development. A rezone to B --Business
would be consistent with the comprehensive plan designation as well as
the zoning on surrounding parcels of land.

The purpose of this request is to rezone lots 1 and 2 of KEA
Subdivision from R -3 --Multi Family Residential to B --Business.
The history and background of the area is outlined in the staff
report that accompanies this agenda statement.

The Department of Transportation and Public Facilities (DOT&PF) has
reviewed the following plats and has the following comments:
1. Plat No. S91-031 - Replat Lot 2, Blk 3 of Miller Point
a. Sewer relocation is subject to state and federal
regulations.
b. A new driveway application is required for any new
access.
2. Plat No. S91-034 - Lot 6B, Blk 2 of Woodland Acres
These lots are not adjacent to the State roadway system.
3. Plat No. S91-056 - Lot 1 & 2 of the KEA Subdivision
No comment
A DOT&PF permit must be obtained by the applicant for any access to
a State maintained road. In order to obtain the permit, the
applicant must demonstrate that proposed access will meet DOT&PF
requirements. The applicant may apply for this permit at the local
DOT&PF Maintenance Office. The local DOT&PF Maintenance Office may
require a field inspection of the proposed access location with the
applicant to ensure that the access meets requirements. The
approval of this plat by the Department does not ensure that an
access permit will be issued. The applicant is encouraged to
contact the local DOT&PF Maintenance Office as early as possible.

commission shall be advisory only and shall not be binding upon the
assembly. When an ordinance has been forwarded to the borough assembly,
the assembly shall act in accordance with this chapter and notice shall be

COASTAL MANAGEMENT APPLICABLE POLICIES
Business Development
1. Natural Features
Dredge and fill, excavation, shoreline alteration and disturbance
of anadromous streams, tideflats and wetlands shall be
minimized when constructing and operating port, harbor, dock,
business and energy facilities - if permitted under applicable
regulations.
Consistent: Not applicable. This action does not involve

Development shall be conducted in a manner that mitigates

along the shoreline.
3. Dredge and Excavation Material
Case 91-056
Dredging and filling shall be consistent with ACMP Standards 6
AAC 80.040 (Coastal Development) and 6 AAC 80.110 (Mineral
and Mining Processing). Dredge spoil may be utilized in

4. Facility Design

protective structures shall be located, designed and maintained in
a manner that prevents adverse impacts upon water quality, fish,
wildlife and vegetative resources and minimizes interruption of
water circulation patterns, coastal processes and navigation.
Consistent: Not applicable. This action does not involve
development in or over the water.
5. Buffer Zones
Buffer zones shall be established to the extent feasible and
prudent, between business areas and major public transportation
routes and between business development and adjacent, non-
business properties in order to minimize conflicts between land
uses.
Consistent: Not applicable. This property is surrounded by
a long established business and industrial area.
6. Accessory Development
Case 91-056
Accessory development that does not require a shoreline location
in order to carry out its support functions shall be sited away
from the shoreline whenever there is a feasible and prudent
inland alternative. this category includes parking, warehousing,
open air storage, waste storage, treatment or storm runoff control
facilities or utilities.
Consistent: Not applicable. This action does not involve
accessory development.

7. Wetlands
Filling and drainage of water bodies, floodways, backshores or
natural wetlands shall be consistent with ACMP Standards 6 AAC
80.070 (Energy Facilities) and 6 AAC 80.130 (Habitats).
Consistent: Not applicable. This action does not involve
filling or draining of water bodies, floodways,
backshores or natural wetlands.
COMMENTS
The purpose of this request is to investigate the rezone of two lots from R3 --
Multifamily Residential to B --Business. The area around these lots is
predominantly commercial and industrial in nature. While a portion of this
area is designated for High Density Residential the majority of the area is
designated Light Industrial.
Issues to be considered in evaluating this rezone request include conformance
with the comprehensive plan, land suitability, recent development trends in
the area, and traffic impacts including adequate access and offstreet parking.
CONFORMANCE WITH THE COMPREHENSIVE PLAN:
The majority of this area included in this request is designated Light
Industrial. The land has been designated for multifamily residential
development for over twenty years. This land has been isolated from the
surrounding B --Business lands by the residential zoning designation it
currently has. A rezone to B --Business would facilitate the consolidation of
commercial land in this area and perhaps provide a stimulus for
redevelopment in the area. The B --Business Zoning District is a close
approximation to Light Industrial. Therefore, a rezone to B --Business would
be consistent with the 1968 Borough Comprehensive Plan.
ZONING/USE:
The land is currently used for a non -conforming power plant and bulk fuel
storage, therefore, a rezone to B --Business, while not bringing this site into
complete conformity, it would be closer to conformity than continuing these
uses in a residential zone.

LAND SUITABILITY:
This land is not entirely suitable for commercial development. However, it is
no less suitable for commercial development than it is for multi -family
residential development. Based on the lot size, lot width and topographical
considerations, the best result of a rezone to business in this area would be to
facilitate consolidation of land prior to any new development.
RECENT DEVELOPMENT TRENDS IN THE AREA:
This area is primarily devoted to commercial and industrial land uses. The
most recent development in the area is the improvement of Tagura Road and
traffic circulation in the area. Canneries and Businesses in the area are
somewhat limited from expanding due to a marked lack of off-street parking
facilities. While there have been small changes to the canneries over the
years most, if not all canneries in this area are nonconforming due to
inadequate off-street parking facilities.
TRAFFIC IMPACTS:
Development of this area for commercial use will no doubt increase traffic in
the area. The area has legal access from both Mission and Tagura Road. It is
likely that access will be from Tagura Road for any commercial development
in this area due to topography however. The amount of traffic increase is
hard to project based on all the potential uses the land could be used for if
zoned B --Business. A consolidation with surrounding B --Business zoned
lands will probably be necessary to support a business of any size due to the
off-street parking requirements for commercial uses.
SUMMARY
This request is consistent with the 1968 comprehensive plan. No
nonconforming uses will be created by this rezone. While not entirely
suitable for commercial development alone, the area to be rezoned will be
easier to consolidate with surrounding B --Business zoned lands prior to
development. Recent development has improved traffic circulation in the
area, however there is still a need for more off-street parking in this general
area. Traffic is likely to increase with any future commercial development,
however this marginal increase is not likely to exceed the capabilities of the
existing roads accessing the site.

FINDINGS OF FACT
Section 17.72.020 states that the Commission shall incorporate the following
criteria into their report to the Assembly:
1. Findings as to the Need and Justification for a Change or Amendment.
The rezone of Lots 1 & 2 of KEA Subdivision, U.S. Survey 1995 from R-
3 --Multi Family Residential to B --Business, is necessary and justified
because the B --Business Zoning District permits development that:
A. is consistent with the existing zoning surrounding this site;
B. will facilitate consolidation with surrounding business lots prior
to development;
C. will bring the existing land uses closer to conformity and will not
create additional non -conforming land uses in the subdivision;
D. will not generate traffic in excess of the capability of recently
improved Tagura Road.
2. Findings as to the Effect a Change or Amendment would have on the
Objectives of the Comprehensive Plan.
The 1968 Borough Comprehensive Plan for this area designates this
site for primarily Light Industrial development. A rezone to B --Business
would be consistent with the comprehensive plan designation as well as
the zoning on surrounding parcels of land.
RECOMMENDATION
Staff recommends that the Commission forward this request to the Assembly
with a recommendation for approval.

in repair by the Grantee and shall be limited to the uses reasonably
necessary for services vehicles to access the building located upon
the adjoining property of the Grantee. A condition of this right-of-
way is that neither Grantee nor persons using the right -of way with
the permission of the Grantee will be allowed to park vehicles or
otherwise block passage along the right-of-way..

exclusive use to the Grantee. Grantor reserves the right to travel
over the property, as well as all rights of ownership of the property.

Grantor shall not be required to perform any maintenance for the
benefit of Grantee or reimburse Grantee for any costs and expenses of
repairs and maintenance.
Grantee will at all times indemnify, save harmless, and
defend Grantor against all claims, demands, actions, or causes of
action arising or.growing out of any loss of or damages to property or
injury to or death of persons which may be due in any manner to the
use, maintenance, or repair of the right-of-way granted by this
instrument.
