Rezoning R3 to R2, Townsite Blk 14, lints 1-6, Blk 19, Lots 16-40 (Case #70) Public Hearing Case reviewed and ordinance read. Mr. Lester moved for adoption of Ord. 66-6-0. Seconded by Mrs. Hajdu. Public hearing declared open.'Mr. Costello, owner of Lots 5-9, Blk 14, spoke against rezoning of Lot 6 since he wishes to build apartments there. Mr. Saupe agreed to Lot 6 remaining,R3 if remaining lots were rezoned to R2. Mrs. Kessler spoke against the rezoning since she wants to build apartments later. Mr. Cornelius, representing several people in the area, spoke in favor of the rezoning. After further discussion, public hearing was closed and motion was amended with concurrence of second to approve adoption of Ordinance with the deletion of Lot 6, Blk 14. Seconded by Mrs. Hajdu. Public hearing declared open. Ken Brandenburg, speaking for ASHA, objected to rezoning since part of these lots will be included in Urban Renewal area. Rezoning to Business might affect the acquisition of these lots since the value of them might be higher if they were zoned business. Mrs. Springhill and Mr. Craig objected because they feared taxes would be raised. Mrs. Kessler, in favor of rezoning, objected to waiting for takeover by Urban Renewal. Mr. Best spoke of necessity of establishing a line between the Business and R3 areas. After considerable further discussion, public hearing was closed and motion defeated by unanimous roll call vote' Mr. Lester made a motion that the ordinance be rewritten to include only those lots presently cut in half by different zoning, specifically Lots 15 and 17. Seconded by Mrs. Hajdu and carried by unanimous voice vote. D. Appeal to P&2 Decision on Rezoning of Erskine Addn, Various Lots Blks 5-9, from R2 to R3 (Case Nos. 1D and 1E) - Public Hearing and Board of Adjustment Notice of public hearing read. Public hearing declared open. Mr. Harry Wallace, Mr. Hohn Welch, and Mr. Harold Heglin spoke against rezoning. Mr. James C. Merves, Attorney, representing Chris Berg and 'those appealing, spoke for rezoning. Mrs. Hajdu brought out that there was a previous Attorney's opinion against spot zoning. Mr. Starbird stated that he thought some of the people for rezoning were already in violation of the ordinance. Mr. Gransbury spoke of advantage of rezoning Mr. Walls' lots to Business. Representative of Ku luk Co. stated that they are in favor of rezoning. Jim Stansbury stated that violations of the ordinance do exist in the area. Mr. Wright spoke against rezoning. Public hearing was closed. Mr. Lester made a motion to grant the appeal for rezoning from R2 to R3 of the area described' in the appeal. Seconded by Mrs. Hajdu. After further discussion, motion...defeat,ed-by unanimous roll call vote. VI H. Request for Rezoning Erskine Blk 9 Lots 115-117, R2 to Business - Paul T. Walls (Case #132-A) After some discussion, Mr. Gransbury stated that the, planned parking lot would provide a buffer between the residential area and the office building, and that the building would not be high enough to block the view. After further discussion, Mr. Lester made a motion to deny the request for rezoning. Motion died for lack of a second. Mrs. Hajdu made a motion to table this case. Seconded by Mr. Lester. J IX Chairman's Report A. Joint Venture, City/Borough Engineer. The Chairman'reviewed staff functions as related to the office of Borough Engineer. It was brought out that despite occasions where possibilities of conflict of interestsexisted under present arrangement, the present contractor (Jim Barr & Associates) had performed for the Borot,h on a highly ethical level. For reasons of expediency and in the interest of economy, the Chairman expressed opinion that a combined office .of Borough and City engineer would further streamline City/Borough working relations along with the officesof building official and sanitarian. Concurrence of the Assembly was asked for in furtherance of implementing such an arrangement. Upon motion of Assembly concurrence by Mrs. Hajdu, seconded by Mr. Brechan and carried by voice vote, the Chairman was directed to:pursue and complete these arrangements. B. Proposed Land Selection. The Chairman reviewed and ,summarized work done by Staff and others in compiling information for the next selection of State lands by the Borough for sale at the earliest possible time. Maps of the area showing proposed selections were examined by the Assembly. Upon the Chairman's request for Assembly approval to pursue application for selection, Mrs. Hajdu moved to apply as recommended, seconded by Mr. Brechan. Motion carried by voice vote. C. HOLMES JOHNSON (CASE #71-A) At their meeting on February 21, 1966, the P&Z Commission unanimously passed the following motion: "That a recommendation be made to the Assembly for approval of this rezoning by Ordinance." Minutes of Special Meeting, February 9, 1966 1 c It was suggested that the Procedures be studied by the Commissioners for discussion at the next meeting on February 28, 1966.- There were no corrections to the Special Meeting minutes. Info copy of letter and petition from Ben Bolden to the City re New Streets was passed around and perused by the Commissioners. There were no comments. VI Public Hearings A. Variance - East Addn Blk 35, Lot 7, M. Christofferson (Case #119-A) Chairman reviewed case. Comm. Anderson made a motion that the variance be approved. Seconded by Comm. Best. Chairman opened public hearing. Mr. Weisser requested more info on the case, and discussed it with Comm. Best, who disqualified himself. Mr. Breckburg asked if this variance was approved, would a similar one be turned down for someone else. Comm. Anderson replied that it was the policy not to jeopardize a person because of unusual circumstances of his lot. After further discussion, Chairman closed public hearing. Iri PLANNING & ZONING MEETING - February 21, 1966 2 VII Zoning Items - Preliminary Review A. Exception, Erskine Blk 9, Lots 105 and 106, Chris Berg, and Perry Dedrick (Case I/1 -F) Chairman reviewed case and read application letters. Comm. Anderson stated that the lots do not have enough square footage for triplexes and that they come under the Grandfather's Clause as R2, not as R3. ,It was stated that a lot size variance would be required for the buildings to be used as R3. It was suggested that a temporary permit be issued forl R3 use. Comm. Anderson objected because others in the area might try to do the same thing. Chairmansuggested that this would not happen because approvals must now be obtained from the Building Inspector and Sanitarian. After further discussion, in which the critical housing shortage was noted, Comm. Erwin made a motion that cs temporary permit fcr three years, subject to renewal, be granted to allow the use of an apartment in each basement of the present building. Seconded by Comm. Perez. Motion amended to replace the word "permit" if a more suitable word is found., -Motion carried on roll call vote as follows: YES Comm. Best Comm. Erwin Comm. Juelson Comm. Perez NO Comm. Anderson Chairman asked what procedure will be followed for future building permits. Secretary replied that a procedure is now being worked out by Jim Stansbury, Building Inspector. Comm. Best suggested that "certificate of occupancy" or "use permit" replace the word "permit""in the motion, as described under Section 18 of Ordinance 64-5. He also stated; that the Ordinance would not be jeopardized by this exception, since it is only temporary. B. Variance, Leite Blk 7, Lot 5, R. Hendricks (Case #122-A) Chairman reviewed case. Comm. Best made a motion that'a public hearing on this case be scheduled for March 14. Seconded by Comm. Perez. Motion carried by voice vote. VIII Subdivisions - Preliminary Approvals A. USS 2843, Blk 2, Lots 1, 2, 3, American Baptist Mission (Case 1179-B) B. USS 1822, Blk 1, Lots 1, 2, American Baptist Mission (Case #120-A) These two cases were discussed at the same time. Chairman read recommendations of the Borough Engineer, Jim Barr. It was pointed out to Mr. Stone, representing the American Baptist Mission, that these lots could not be sold without first having sewer and water installed on them, or a bond posted to cover the cost of installation. Mr. Stone stated that,in that case the request would probably be withdrawn. Comm. Best made a motion for approval of these preliminary plats subject to 1) Engineer's; recommendations and 2) installation of utilities compatible with the lot sizes. Seconded by Comm. Juelson. Motion passed unanimously by roll call vote. There was further discussion on ordinance requirements. IX Subdivisions - Final Approvals None X Old Business A. Trailer Court Permit, Lot 3, USS 3099, Jack Brisbane (Case 499) Chairman reviewed case. After discussion of requirements, Comm. Best made a motion that this case be approved for public hearing!on March 14, subject to the approval of the sanitary facilities by the Sanitarian, the approval of the Building Inspector, and a plat submitted by February 28 which includes all requirements of the ordinance. Seconded by Comm. Anderson. Comm. Best explained the requirements of the Trailer Park Ordinance. Motion carried by voice vote. PLANNING & ZONING MEETING - February 21, 1966 EX B. Rezoning, Townsite Blk 9, Lot 3, Dr. R. Holmes Johnson (Case 471-A) Chairman reviewed case,which was approved by a P&Z public hearing on July 28, 1965, but no ordinance was ever passed on it. Comm. Juelson made a motion that a recommendation be made to the Assembly:foriapproval of this rezoning by ordinance. Seconded by Comm. Anderson. Motion carried by unanimous voice vote. C. Reasons for Rejection of Erskine Re -zoning from R2 to R3.- Requested by Borough Assembly The following reasons were stated: 1. The lots are not large enough. If their use was ,changed from R2 to R3, the Grandfather Clause would not cover them, since they contain less than 7200 sq. ft. Many of the lots are only 5500 sq. ft,' (Comm. Anderson). 2. There was a covenant in the deed on the property, which required two lots for the construction of a duplex, which would be 111,000 sq. ft. This led the buyers to believe that duplexes would only be permitted on these larger lots. Now part of the buyers have set aside, the covenant, and rezoning would permit triplexes on small lots, which, would be objected to by those buyers still holding to the covenant"(Comm. Anderson). 3. The majority of the home owners in the area objectedto the rezoning because they had built their homes under the impression that the area would remain R2 (Comm. Erwin). 4. Rezoning to allow the Chris Berg apartments to use two additional apartments to ease the housing shortage did not seem to balance out against the great opposition of the home owners (Comm. Juelson). 5. Many of the home owners objected to having their view of the waterfront possibly obstructed by erection of triplexes (Comm. Edris). XI Planning and Staff Items Commissioners were reminded to study the P&Z Procedures for the next meeting. XII Audience Comments Mr. Kagel inquired about procedure to obtain a permit to install a trailer on Miller Point. Mr. Stansbury stated that the Assembly is now waiting for legal opinion on the trailer procedures recommended by P&Z. There was further discussion as to the difference between trailers, mobile homes, and those mobile homes so large that they are not easily moved. Mr. Breckburg brought up the subject of the Holman Case. Comm. Best stated that it would be followed up by the Assembly. Mr. Breckburg brought out the lack of ordinance enforcement, and discussion was held on this matter. Chairman explained that the procedurewould be for the Building Inspector or Sanitarian to make recommendations for enforcement to the Borough Assembly and that the Borough Assembly would recommend charges. Persons concerned would be brought before the Magistrate for violations. For this reason 1 am not fully apraised of what has transpired in th“ouncil with res- pect to this proposal. The reasons for my absences,were not voluntary but were either ao a result of my not being award that the proposal was to be discussed, or by virtue of some medical emergency having li supervened. 1, To bring you up to date on the status of any proposal, lot me say that 1 have received a letter from Cr. Elliott, 2xecutivti Director for Alaska State Rousing Authority dated August 4, 195 In which he enclosed an ownership -participation agreement whibill will soon be signing and returning to him, and in which he quoted maximum and minimum filLures for the adjoining property to the Rotary lot so that 1 would have some ideaofwhat the cost estimate ".017 purchase of land Might be. The Housing Authority has been vary helpful with respect to this project, apparently realizing that there ;s,a necessity for aelequate care for expanding Kodiak community. Th re are two major unknowns which have provided some difficulty in design and placement of the building, the first being that the righ-of-way line for Nil/ Bay Road cannot be definitely established at this tit, e, 'and the second being the fact that the final grading of the lot nits Southwest . northeast direction has not been established. Be su4so of the first of these, it i necessary for me to place my building farther back on the lot than would otherwise be necessary to insure that 1 conform with the city ordinance with respect to the placement of the but/die. The second of these necessitates a flexible basement', deign to conform to either a daylight basement or a subterranean 4sement as the case may eventually be. The first solution - that of placing the building farther from the property line than would have bon necceesary other- wise . makes it necessary for me to be sure to be able to purchase more property on the old school side of the Rotary 14. Engineer Barr recommended a special meeting on this subject and on rezoning. Commissioner Duros moved that there be a special meeting next Wednesday evening in the Courtroom after regular meeting. Mr. Russell stated that he wished the above lot rezoned from residential unclassified to commercial so that he could build a building valued at ,$34,000. Mr. Lamm advised applicant of proper procedure through public hearing. A motion to grant a public hearing on the meeting of July 7 was made by Commissioner Duros. Seconded by Commissioner Anderson and voice vote was unanimous in approval. P & Z Commission - June 22, 1965 Page 2 G. Department of Highways Request for new Depot Site - referred from Assembly. A letter from Paul H. Stover, Foreman, Maintenance Section, requested the Borough to propose two sites suitable for depot with roads and utilities available with an area of 5 acres per site. Nr. Stover stated that the Juneau office has taken over the responsibility of negotiating a.site with the Borough but that he would like prior knowledge of the areas involved before negotiation. Commissioner Anderson moved that the Borough Engineer meet with the Dept. of Highways personnel in locating two feasible sites. Seconded by Commissioner Juelson with voice vote unanimously in favor.' • Petition for vacation of alley - Carpenters Local 2162. This is a 30 foot wide alley between lots 35 and 36, Erskine Subdivision. CoMmisSioner Kraft moved to grant vacation. Commissioner Cornelius seconded. Voice vote was unanimously favorable. . Building Permit referred from City - Wu. Dam . Mr. Damery wished to move a building from Lot 56, Block 12, Aleutian Homes Sub. to Lot,10, Block 7,.Leite Addn.. for use as a storage building. V. Hearings, Ordinances, and Resolutions: A. Urban Renewal - Public Hearing. No objections being heard, Commissioner Cornelius moved to approve the plat of Blocks 4,5,6,7 and 8, New Kodiak Subdivision. Commissioner Anderson seconded and voice vote was unanimous. B. T.T. Jackson - Public Hearing. Mr. Jackson requested approval of the Commission to establish a trailer park on Lots 4, through 8, plus lot16, USS 3233, which is presently zoned residential unclassified. Nr. Barr presented a drawing of a typical trailer installation as planned by Nr. Jackson. A petition signed by adjoining property owners, and another by adjoining residents were generally favorable. A petition to deny approval was presented by the Spruce Cape property owners. It was brought out that there are presently several trailers on Mr. Jackson's property which appear to be deficient in sanitary facilities and eye appeal. Nr. Cornelius stated that he wished to go on record as requesting more public lands be made available for private use through sale. ommissioner Anderson requested that a copy ofthe plat of subdivision in question be presented. It was brought out by Mr. Barr that four copies of said plat had been presented for review at a previous meeting. Mr. Barr left to get copy of plat. June 17, 1965 i I have applied through the Alaska Housing Authority's Urban Renewal for the release of the land presently owned by the Kodiak Rotary Club upon which is located the temporary museum and which has been used as a city parking lot over the past several years. This is referred to as Lot 3.4B lin the Urban Renewal Redevelopment program. I realize - or have been led to believe - that'this particular area has been zoned for multiple housing, but feel that it is the only area in the downtown section that would be suit- able for the building of a new clinic. A new clinic is -an essential for two reasons - because the present building in which the clinic is housed is being demolished,in the near future, and because I am finding it difficult to obtain Doctors for our area withou being able to offer them the most modern facilities. The present clinic structure will handle two Doctors - though. it is crowded - but would .certainly handle no more. The facility I intend to build will house three or more Doctors. I think that the Housing Authority looks favorably upon my request, and have been informed that the Common Council of the City of Kodiak is fully in accord with this building .program for the area involved. .If the BoroLighylann*ng and Zoning Commission feels that this is a worth -while project • I would sincerely appreciate a waiver or change of Zoning Requirements for this area to enable me to construct a modern medical clinic as soon as possible.
