Rezoning R1 to R3 - Aleutian Sub Blk 14 Lots 8-14 - Tony Perez (Case #40-A) A current letter and petition of request by Mr. Perez was read, followed by reading of the Ordinance. Mrs. Hajdu moved for adoption of Ord. 65-7. Seconded by Mr. Brechan. Public hearing opened. Petition against rezoning was read. Mr. Sundberg and Rev. Bullock spoke against the rezoning. Mrs. Holman, Mrs. Brodman, Mr. Shone and Mr. Franklin spoke for the rezoning. Mr. Perez stated that the City approved of it. Objections voiced were the high percentage of property owners and residents in the area against the. rezoning; that it constituted spot zoning; that the property is prime R-1 property; that all such rezonings should be held in abeyance until the Comprehensive Plan comes into effect. Comments in favor of rezoning were that apartments are an asset to an area and not necessarily detrimental; that with the start of the low-income ASHA apartments, the whole hillside area will eventually be R3; and the critical housing. shortage in Kodiak. Public hearing was closed. Mrs. Hajdu commented that there is no definite R1 pattern in the area because the City Watershed is adjoining it, and there is a gravel pit and church nearby. Motion carried by roll call vote as follows: Mr. Brechan - Yes; Mrs. Hajdu - Yes;; Mr. Lester - No. Rev. Bullock raised a point of order, quoting from Ord. 64-5 which states that in case of a protest against a change in zoning district classification signed by the owners of 20% or more of the area of the lots immediately abutting the area included in the rezoning or separated from it only by, an alley or street, there must be a favorable vote of all five members of the Assembly. Mr. Lester directed that the case be referred to the Borough Attorney to determine correct action. C. Request for Trailer Park Permit, Lot 1, USS 3099 - Eugene and Letitia Harding (Case #30-A) Mr. Barr's and Mr. Carter's recommendations, letter of objection from Mrs. Chandler, and letter describing proposed sewage treatment system were read. Mr. Barr's objections to the sewage treatment plant were resolved in discussion between Mr. Carter and Mr. Brasie, who will install plant. Mrs. Hajdu questioned lack of play area, and Mrs. Harding replied that no children will be allowed in the court. Mr. Carter and Mr. Stansbury stated that they were receiving coopera- tion from the Hardings in complying with the ordinance. Mrs. Hajdu moved that the trailer court be approved for the existing four trailers with no expansion unti full compliance with sanitary requirements is met. Seconded by Mr. Brechan. Mr. Harding stated that they hoped to tie into the sewer line from the school. Motion carried by unanimous roll call vote. . Rezoning R3 to Business, Townsite Blk 16 Lots 15 & 17 - Joseph Carbin and Names Eggemeyer (Case #6-F) - Second Reading and Public Hearing Ordinance read. Mr. Brechancmoved:-for approval of Ord -.66-7, rezoning Townsite Blk 16 Lots 15 & 17, from R3 to Business, in the second reading. Seconded by Mrs. Hajdu. Public hearing opened and closed without comment. Motion -carried - by unanimous roll call vote. VII Planning & Zoning Items A. Subdivision, USS 3218, Tr. D, Lots 1 & 2 - Leland Franklin (Case #130-A) Plat studied and Mr. Barr's recommendation for a re -survey read. Mr. Best explained that the plat was surveyed by Hugh Tyler before the ordinance was in effect, but was never recorded. The lots have already been sold by deed under the School District. The redrawing of the plat is submitted at this time in order that it can be recorded to back up the deeds. Mr. Tyler's drawing did not meet the ordinance requirements for recording. Mr. Brechan moved for approval of the final plat and request for a resolution on USS 3218, Tr. D, Lots 1 & 2. Seconded by Mrs. Hajdu. Carried by unanimous voice vote. B. Subdivision, USS 3218, Tr. M, Leroy Wittich (Case #136-A) Mr. Barr's recommendation that restrictions be placed on buildings to be erected on this property since it lies near the airport runway was read. Mr. Brechan moved for approval of the preliminary plat of USS 3218, Tr. M. Seconded by Mrs. Hajdu. Mr. Best explained that Mr. Wittich wished to know the Assembly's thinking on building restrictions before he went to the expense of a final plat. It was decided that since buildings would have to meet FAA restrictions anyway, there was nothing further the Assembly could do concerning building restrictions at this point. Motion carried by unanimous voice vote. Seconded by Mrs. Hajdu. Public hearing declared open. Ken Brandenburg, speaking for ASHA, objected to rezoning since part of these lots will be included in Urban Renewal area. Rezoning to Business might affect the acquisition of these lots since the value of them might be higher if they were zoned business. Mrs. Springhill and Mr. Craig objected because they feared taxes would be raised. Mrs. Kessler, in favor of rezoning, objected to waiting for takeover by Urban Renewal. Mr. Best spoke of necessity of establishing a line between the Business and R3 areas. After considerable further discussion, public hearing was closed and motion defeated by unanimous roll call vote. Mr. Lester made a motion that the ordinance be rewritten to include only those lots presently cut in half by different zoning, specifically Lots 15 and 17. Appeal to P&Z Decision on Rezoning of Erskine Addn, Various Lots Blks 5-9, from R2 to R3 (Case Nos. 1D and 1E) - Public Hearing, and Board of Adjustment Notice of public hearing read. Public hearing declared open. Mr. Harry Wallace, Mr. Hohn Welch, and Mr. Harold Heglin spoke against rezoning. Mr. James C. Merves, Attorney, representing Chris Berg and those appealing, spoke for rezoning. Mrs. Hajdu brought out that there was a previous Attorney's opinion against spot zoning. Mr. Starbird stated that he thought some of the people for rezoning were already in violation of the: ordinance. Mr. Gransbury spoke of advantage of rezoning Mr. Walls' lots to Business. Representative of Karluk Co. stated that they are in favor of rezoning. Jim Stansbury stated that violations of the ordinance do exist in the area. Mr. Wright spoke against rezoning. Public hearing was closed. Mr. Lester made a motion to grant the appeal for rezoning from R2 to R3 of the area described in the appeal. Seconded by Mrs. Hajdu. After further discussion, motion defeated -by unanimous roll call vote. VI H. Request for Rezoning Erskine Blk 9 Lots 115-117, R2 to Business - Paul T. Walls (Case #132-A) After some discussion, Mr. Gransbury stated that the planned parking lot would provide a buffer between the residential area and the office building, and that the building would not be high enough to block the view. IX Chairman's Report A. Joint Venture, City/Borough Engineer. The Chairman reviewed staff functions as related to the officeof Borough Engineer. It was brought out that despite occasions where possibilities of conflict of interests existed under present arrangement, the present contractor (Jim Barr & Associates) had performed for the Borot.,h on a highly ethical level. For reasons of expediency and in the interest of economy, the Chairman expressed' opinion that a combined office of Borough and City engineer would further -.. streamline City/Borough working relations along with the offices of building official and sanitarian. Concurrence of the Assembly was -asked for in furtherance of implementing such an arrangement. Upon motion of Assembly concurrence by Mrs. Hajdu, seconded by Mr. Brechan and carried by voice vote, the Chairman was directed toypursue and complete these arrangements. B. Proposed Land Selection. The Chairman reviewed and summarized work done by Staff and others in compiling information for the next selection of State lands by the Borough for sale at the earliest possible time. Maps of the area showing proposed selections were examined by the Assembly. Upon the Chairman's request for Assembly approval to pursue application for selection, Mrs. Hajdu moved to apply as recommended, seconded by Mr. Brechan. Motion carried by voice vote. C. II Roll Call Before roll call, Chairman White introduced Mr. Sven Haakansen to the Assembly and audience as proposed candidate for Assembly seat vacated by Mr. Fitzgerald. A short discussion followed on propriety of reading of memo prior to perusal by Attorney. With concurrence of Assembly members present, action on memorandum deferred to next Assembly meeting. Site Clearing, New Elementary School - Contract Award.', Letter to the Clerk was read with School Board recommendation of award to low bidder, Frank Kempton, in the amount of $15,500 and 45 days for completion. Award, as recommended by School Board, predicated on qualifications of bidder and in proper form. Mr. Crittenden commented on bid form and qualifications of bidder. A discussion followed on advisability of providing for liquidated damages in the event of work not being completed within 45 days in accordance with bid.
