B. Rezoning R1 to R3 - Aleutian Sub Blk 14 Lots 8-14 - Tony Perez (Case #40-A)
A current letter and petition of request by Mr. Perez was read, followed by
reading of the Ordinance. Mrs. Hajdu moved for adoption of Ord. 65-7. Seconded
by Mr. Brechan. Public hearing opened. Petition against rezoning was read.
Mr. Sundberg and Rev. Bullock spoke against the rezoning. Mrs. Holman, Mrs.
Brodman, Mr. Shone and Mr. Franklin spoke for the rezoning. Mr. Perez stated
that the City approved of it. Objections voiced were the high percentage of
property owners and residents in the area against the. rezoning; that it
constituted spot zoning; that the property is prime R-1 property; that all such
rezonings should be held in abeyance until the Comprehensive Plan comes into
effect. Comments in favor of rezoning were that apartments are an asset to an
area and not necessarily detrimental; that with the start of the low-income ASHA
apartments, the whole hillside area will eventually be R3; and the critical housing.
shortage in Kodiak. Public hearing was closed. Mrs. Hajdu commented that there
is no definite R1 pattern in the area because the City Watershed is adjoining
it, and there is a gravel pit and church nearby. Motion carried by roll call
vote as follows: Mr. Brechan - Yes; Mrs. Hajdu - Yes;; Mr. Lester - No. Rev.
Bullock raised a point of order, quoting from Ord. 64-5 which states that in case
of a protest against a change in zoning district classification signed by the
owners of 20% or more of the area of the lots immediately abutting the area
included in the rezoning or separated from it only by, an alley or street, there
must be a favorable vote of all five members of the Assembly. Mr. Lester directed
that the case be referred to the Borough Attorney to determine correct action.
C. Request for Trailer Park Permit, Lot 1, USS 3099 - Eugene and Letitia Harding
(Case #30-A)
Mr. Barr's and Mr. Carter's recommendations, letter of objection from Mrs.
Chandler, and letter describing proposed sewage treatment system were read.
Mr. Barr's objections to the sewage treatment plant were resolved in discussion
between Mr. Carter and Mr. Brasie, who will install plant. Mrs. Hajdu questioned
lack of play area, and Mrs. Harding replied that no children will be allowed in
the court. Mr. Carter and Mr. Stansbury stated that they were receiving coopera-
tion from the Hardings in complying with the ordinance. Mrs. Hajdu moved that
the trailer court be approved for the existing four trailers with no expansion unti
full compliance with sanitary requirements is met. Seconded by Mr. Brechan.
Mr. Harding stated that they hoped to tie into the sewer line from the school.
Motion carried by unanimous roll call vote.
. Rezoning R3 to Business, Townsite Blk 16 Lots 15 & 17 - Joseph Carbin and
Names Eggemeyer (Case #6-F) - Second Reading and Public Hearing
Ordinance read. Mr. Brechancmoved:-for approval of Ord -.66-7, rezoning Townsite
Blk 16 Lots 15 & 17, from R3 to Business, in the second reading. Seconded by
Mrs. Hajdu. Public hearing opened and closed without comment. Motion -carried -
by unanimous roll call vote.
VII Planning & Zoning Items
A. Subdivision, USS 3218, Tr. D, Lots 1 & 2 - Leland Franklin (Case #130-A)
Plat studied and Mr. Barr's recommendation for a re -survey read. Mr. Best
explained that the plat was surveyed by Hugh Tyler before the ordinance was in
effect, but was never recorded. The lots have already been sold by deed under
the School District. The redrawing of the plat is submitted at this time in order
that it can be recorded to back up the deeds. Mr. Tyler's drawing did not meet
the ordinance requirements for recording. Mr. Brechan moved for approval of
the final plat and request for a resolution on USS 3218, Tr. D, Lots 1 & 2.
Seconded by Mrs. Hajdu. Carried by unanimous voice vote.
B. Subdivision, USS 3218, Tr. M, Leroy Wittich (Case #136-A)
Mr. Barr's recommendation that restrictions be placed on buildings to be erected
on this property since it lies near the airport runway was read. Mr. Brechan
moved for approval of the preliminary plat of USS 3218, Tr. M. Seconded by
Mrs. Hajdu. Mr. Best explained that Mr. Wittich wished to know the Assembly's
thinking on building restrictions before he went to the expense of a final plat.
It was decided that since buildings would have to meet FAA restrictions anyway,
there was nothing further the Assembly could do concerning building restrictions
at this point. Motion carried by unanimous voice vote.
After ten-minute recess, meeting was called back to order at 10:15 p.m.

A. Rezoning R3 to R2, Townsite Blk 14, Lints 1-6, Blk 19, Lots 16-40 (Case #70)
Public Hearing
Case reviewed and ordinance read. Mr. Lester moved for adoption of Ord. 66-6-0.
Seconded by Mrs. Hajdu. Public hearing declared open. Mr. Costello, owner of
Lots 5-9, Bik 14, spoke against rezoning of Lot 6 since he wishes to build
apartments there. Mr. Saupe agreed to Lot 6 remaining R3 if remaining lots
were rezoned to R2. Mrs. Kessler spoke against the rezoning since she wants
to build apartments later. Mr. Cornelius, representing several people in the
area, spoke in favor of the rezoning. After further discussion, public hearing
was closed and motion was amended with concurrence of second to approve adoption
of Ordinance with the deletion of Lot 6, Blk 14. Carried by roll call vote as
follows:

Second Reading and Public Hearing
Ordinance was read. Mr. Lester moved for adoption of Ordinance 66-7-0. Seconded
by Mrs. Hajdu. Public hearing declared open. Ken Brandenburg, speaking for
ASHA, objected to rezoning since part of these lots will be included in Urban
Renewal area. Rezoning to Business might affect the acquisition of these lots
since the value of them might be higher if they were zoned business. Mrs.
Springhill and Mr. Craig objected because they feared taxes would be raised.
Mrs. Kessler, in favor of rezoning, objected to waiting for takeover by Urban
Renewal. Mr. Best spoke of necessity of establishing a line between the Business
and R3 areas. After considerable further discussion, public hearing was
closed and motion defeated by unanimous roll call vote. Mr. Lester made a
motion that the ordinance be rewritten to include only those lots presently
cut in half by different zoning, specifically Lots 15 and 17. Seconded by
Mrs. Hajdu and carried by unanimous voice vote.
D. Appeal to P&Z Decision on Rezoning of Erskine Addn, Various Lots Blks 5-9,
from R2 to R3 (Case Nos. 1D and 1E) - Public Hearing, and Board of Adjustment
Notice of public hearing read. Public hearing declared open. Mr. Harry
Wallace, Mr. Hohn Welch, and Mr. Harold Heglin spoke against rezoning. Mr.
James C. Merves, Attorney, representing Chris Berg and those appealing, spoke
for rezoning. Mrs. Hajdu brought out that there was a previous Attorney's
opinion against spot zoning. Mr. Starbird stated that he thought some of the
people for rezoning were already in violation of the: ordinance. Mr. Gransbury
spoke of advantage of rezoning Mr. Walls' lots to Business. Representative of
Karluk Co. stated that they are in favor of rezoning. Jim Stansbury stated
that violations of the ordinance do exist in the area. Mr. Wright spoke against
rezoning. Public hearing was closed. Mr. Lester made a motion to grant the
appeal for rezoning from R2 to R3 of the area described in the appeal. Seconded
by Mrs. Hajdu. After further discussion, motion defeated -by unanimous roll
call vote.
VI H. Request for Rezoning Erskine Blk 9 Lots 115-117, R2 to Business - Paul T. Walls
(Case #132-A)
After some discussion, Mr. Gransbury stated that the planned parking lot would
provide a buffer between the residential area and the office building, and
that the building would not be high enough to block the view. After further
discussion, Mr. Lester made a motion to deny the request for rezoning. Motion
died for lack of a second. Mrs. Hajdu made a motion:to table this case.
Seconded by Mr. Lester. Carried by unanimous voice vote.

17 C. Ordinance 66-7-0, Case No. 101 -By Rezoning Block 16, Townsite - First Reading.
Mr. Brechan moved to approve, seconded by Mrs. Hajd*. Carried unanimous on
voice vote.
D. (Not on agenda. Too late to be included ). Ordinance 66-8 Rezoning Lot 1,
Blk 8, USS 444, 2537D. Mrs. Hajdu moved to adopt first reading, seconded by
Mr. Brechan. Motion carried unanimous by voice vote. :Upon advice of Attorney,
the description should be changed from RGM Tract B to read. RGM Tract D.
VIII New Business - None
At this time Chairman White noted that the matter of Holman's Garage ordinance
violations was now being handled by Staff and indicated probability of these
violations being resolved by Staff action.
IX Chairman's Report
A. Joint Venture, City/Borough Engineer. The Chairman reviewed staff functions
as related to the officeof Borough Engineer. It was brought out that despite
occasions where possibilities of conflict of interests existed under present
arrangement, the present contractor (Jim Barr & Associates) had performed
for the Borot.,h on a highly ethical level.
For reasons of expediency and in the interest of economy, the Chairman expressed'
opinion that a combined office of Borough and City engineer would further -..
streamline City/Borough working relations along with the offices of building
official and sanitarian.
Concurrence of the Assembly was -asked for in furtherance of implementing such
an arrangement.
Upon motion of Assembly concurrence by Mrs. Hajdu, seconded by Mr. Brechan
and carried by voice vote, the Chairman was directed toypursue and complete
these arrangements.
B. Proposed Land Selection. The Chairman reviewed and summarized work done by
Staff and others in compiling information for the next selection of State
lands by the Borough for sale at the earliest possible time. Maps of the
area showing proposed selections were examined by the Assembly. Upon the
Chairman's request for Assembly approval to pursue application for selection,
Mrs. Hajdu moved to apply as recommended, seconded by Mr. Brechan. Motion
carried by voice vote.
C. (Not on the agenda.) The Chairman presented financial statement of the
Borough as of February 28, 1966. There were no comments.

I Call to Order
The meeting was called to order at 7:50 P.M. on February 17,;1966, in the Magistrate's
Court Room, Donnelley Building, Kodiak, Alaska, by the Deputy Presiding Officer,
Eldon Lester.
II Roll Call
Before roll call, Chairman White introduced Mr. Sven Haakansen to the Assembly and
audience as proposed candidate for Assembly seat vacated by Mr. Fitzgerald. Roll
call proceeded as follows:

Edwin Crittenden, Architect; Harry Carter, Sanitarian; and Jim Stansbury, Building
Inspector.
III Minutes of previous meeting of February 3, 1966, were read without comment or
correction and were approved as read by order of Deputy Presiding Officer.
IV Other Minutes
A. P&Z Commission minutes for meeting on February 7, 1966, were read. Exception
to Par. V was taken by the Borough Attorney. Minutesias read stated under
Par. V that, "Chairman Cornelius replied that the Borough Attorney has been
instructed to revise the Ordinance . . . " Mr. Madsen stated that he has not
been instructed to so do and that minutes should clarify and reflect this.
There were no further comments or action taken.
B. Kodiak Island Borough School Board minutes of meeting held on February 4,. 1966,
were read without comment.
V Referrals from P&Z Commission
A. Individual Trailer Permits. Prior to reading of memorandum, Mr. Madsen
commented that he had not read the document as called ;for in previously read
meeting minutes. A short discussion followed on propriety of reading of memo
prior to perusal by Attorney. With concurrence of Assembly members present,
action on memorandum deferred to next Assembly meeting.
At this point in the meeting, agenda item No. VIII -A was moved back for convenience
of school people present.
VIII A. Site Clearing, New Elementary School - Contract Award.', Letter to the Clerk was
read with School Board recommendation of award to low bidder, Frank Kempton,
in the amount of $15,500 and 45 days for completion. Award, as recommended by
School Board, predicated on qualifications of bidder and in proper form. Mr.
Crittenden commented on bid form and qualifications of bidder. A discussion
followed on advisability of providing for liquidated damages in the event of
work not being completed within 45 days in accordance with bid. Mr. Brechan
moved for award of contract to Frank Kempton as recommended by School Board.
Seconded by Mrs. Hajdu. Motion carried on unanimous roll, call vote.
At this time (8:50 P.M.) recess for ten minutes was declared by Deputy Presiding
Officer. Meeting reconvened at 9:00 P.M.
V B. Letter from Supt. of Schools relative to P&Z recommendation on selection of
school lands within Military Reserve was, read. Assembly members concurred on
review by Staff with report back to Assembly on status.
C Case No. 101-B, Rezoning Townsite Blk 16. Memo from Chairman of P&Z Commission

recommending rezoning from R3 to Business was read. Mr. Brechan moved, seconded
by Mrs. Hajdu, that Borough Attorney be instructed to prepare ordinance to
cover. Motion carried by voice vote.

VI Communications - Correspondence - People to be Heard
A. Chairman White introduced Mr. Jim Nordale of Local Affairs Office and Mr.
Harry Little from the audience, with comment that these gentlemen were in
Kodiak for the purpose of conducting boundary commission Ihearing, February 18,
on Borough petition to assume hospital, health and sanitation functions.
B. Letter from Governor Egan pertaining to "Operation Big Sweep" was read. A
short discussion on possibilities of service clubs participating took place.
No action taken.
C. Info copy of letter from Mr. Ben Bolden to City officials on city streets was
acknowledged and passed around to Assembly members for perusal. No action taken.
VII Old Business
A. Ordinance 66-4-0, Rezoning Thorsheim Subdivision. Second reading and public
hearing was held. Mr. Brechan moved for approval, seconded by Mrs. Hajdu.
Carried on unanimous roll call vote.
B. Ordinance 66-3-0, Rezoning Airpark Subdivision, Second reading and public
hearing were held. Mrs. Hajdu moved for approval, seconded by Mr. Brechan.
Carried on unanimous roll call vote.
C. Ordinance 66-2-0, Rezoning ASHA Lands. Second reading and public hearing were
held. Mr. Brechan moved for approval, seconded by Mrs. Hajdu and carried by
unanimous roll call vote.
D. Resolution 66-6-R, USS 3101, Lots 20A and 21A, subdivision, approval of final
plat. A short discussion on location and perusal of map were held. Mrs. Hajdu
moved for approval, seconded by Mr. Brechan and carried on unanimous roll call vote.
VIII B. Charles Edris, Approval of Building Permit. Mrs. Hajdu moved for approval,
seconded by Mr. Brechan. Carried on unanimous voice vote.
C. Ordinance 66-5-0, Rezoning USS 3098, Lots 28, 29A, 29B, Russell Wright - First
Reading. Motion to approve and advance to second reaiing and public hearing
made by Mrs. Hajdu, seconded by Mr. Brechan. Motion carried on unanimous roll
call vote (confirming an earlier action).
D. Ordinance66 -6 -0, Townsite Blk 19, Lots 16-40 and Townsite Blk 14, Lots 1-6,
Rezoning - First Reading. Mr. Brechan moved for approval and advance to
second reading, seconded by Mrs. Hajdu. Motion carried on unanimous roll call
vote (confirming an earlier action).
E. Resolution 66-5-R, Subdivision Townsite Blk. 3, Lot 11, J. Bruce Smith -
Approval of Final. Plat. Mr. Brechan moved for approval, seconded by Mrs. Hajdu
and carried on unanimous roll call vote.
IX Chairman's Report
Chairman White commented briefly on results of conference with State Department of
Highways District Engineer, Mr. Cosby Steen, which was held on February 9.
A. Chairman. White introduced Mr. Sven Haakansen of Old Harbor as proposed candidate
to fill Assembly seat vacated by Mr. Mathey Fitzgerald. Upon motion of Mr.
Brechan for appointment, seconded by Mrs. Hajdu, Mr. Haakansen was voted in on
roll call unanimous vote. The Clerk, directed by the Chairman, swore Mt.
Haakansen into office.

C. Rezoning, Blk 16 Townsite, Petition of Property Owners (Case #101-B)
Chairman reviewed case. It was pointed out that the lots involved in the
petition are outside of the New Kodiak Sub Blk 2. After some discussion,
Comm. Best made a motion that "the Planning and Zoning CoMmiSsion doe S find
a need for an additional business area, and justified by good toning practice
of following natural lot and black boundaries; does herby reboil:Mend to the
Borough Assembly the approval of rezoning those portions of lots 5, 6, 7, 8,
12, 13, 14, 15, 16, and 17 of Blk 16 Townsite now tlassiiied as R3, to
Business: Seconded by Comm. Juelson. After further discussion, motion was
carried unanimously.
VIII C. Referral from Assembly - Discussion of Requirements for Temporary Trailer Permits
Comm. Best read letter which was prepared,outlining recomkended procedures
for granting temporary trailer permits. After brief discussion, CO*, Anderson
Moved that Commission's recommendations be approved pending approval Of the
Borough Attorney. Seconded by Comm. Edris. After further discussion, motion
Was carried unanimously. Recommendations will be submitted to the Borough
Assembly .in letter form.
