III MINUTES OF PREVIOUS MEETING - June 2, 1966 Mr. Lester moved that the minutes be approved as received.' Seconded by Mrs. Hajdu and carried by unanimous voice vote. IV OTHER MINUTES - School Board - June 13, 1966 Minutes were approved as read. V COMMUNICATIONS - CORRESPONDENCE - PEOPLE TO BE HEARD A. B. C. Resolution 66-22-R authorizing bond anticipation notes Resolution 66-23-R authorizing Resolution 66-21-R authorizing Governmental Statistical Corp. to handle school inter -fund loan to School Board application to EDA for hospital loan Mr. Richard Sassara of the Governmental Statistical Corp. presented the above three items. He explained that it is necessary for the Borough to borrow $750,000 in bond anticipation notes while waiting for the bond market to improve for the permanent bond sale. Since it will take threeto four weeks for the anticipation notes to be negotiated, an inter -fund loan from the Borough funds to the School Board funds must be completed to allow the School Board to meet its immediate commitments. The Borough funds will then be replaced with the proceeds from the bond anticipation notes. He further explained that a resolution is necessary in order to complete the application for the hospital loan and grant. The resolutions were read. Mrs. Hajdu moved for adoption of Res. 66-22-R. Seconded by Mr. Brechan and carried by unanimous roll call vote. Mr. Brechan moved for adoption of Res. 66-23-R. Seconded by Mr. Lester and carried by unanimous roll call vote. Mrs. Hajdu moved for adoption of Res. 66-21-R. Seconded by Mr. Brechan and carried by unanimous roll call vote. D. Resolution 66-24-R authorizing execution of a quitclaim deed and temporary construction permit to the State Department of Highways for their construction of a road on school property Resolution was read. Mr. Lester moved for its adoption. Seconded by Mrs. Hajdu and carried by unanimous roll call vote. VI PUBLIC HEARINGS A. Mr. Lester moved for adoption of Ord. 66-11-R. Seconded by Mrs. Hajdu. Public hearing opened. Letter of objection from Russian Orthodox Church was read. Mrs. Hajdu commented that perhaps Father Targonsky of the Church was not aware that his property, USS 444, Tract C, could still be used for R=1purposes, even though zoned R-3. There were no further comments and public hearing was closed. Motion carried by unanimous roll call vote, fulfilling the requirement necessitated by the Russian Church's objection. Rezoning Aleutian Sub Blk 14, Lots 8-14 from R1 o R3 - Tony Perez (Case 40-A) 1 1 Case was reviewed and the attorney's opinion read. iSince it had been determined that governmental agencies should have a voice in rezonings, the objectors to this case did not have enough surrounding area to require a five -member favorable vote of the Assembly to pass the rezoning. Therefore the previous 2 to 1 vote in favor of the rezoning which had occurred at the May 5 meeting was determined to be valid. Mrs. Hajdu moved that the affirmative action of the Borough Assembly in rezoning Aleutian Sub Blk 14, Lots 8-14, from R1 to R3, be re -affirmed at this time. Secondediby Mr. Lester. Rev. Bullock raised the point that the city watershed could not be considered as a "lot," and therefore could not be counted as having weight in the case. It was explained to Rev. Bullock that the re -affirmation was being done so that if anyone wished to appeal the decision, they could still do so within the time limit required. Motion carried by unanimous roll call vote. C. Rezoning Townsite Blk 1 Lot 10, 12, 13, 17-19; USS 1995; USS 444 Tr. C; Alas Game Reserve - Robert King and Assembly (Case 137-A) There was some discussion to change the rezoning from R2 to Business, rather than from R2 to R3, since a large percentage of the area from the hospital out to Tagura Road is business now. It was decided that since Mr. King would. be held up by re -writing the ordinance, that the :case would be continued in its present form. It was pointed out that the Russian Church had objected to their land (USS 444 Tr. C) being included in this rezoning. No action was taken to eliminate this parcel from the ordinance. The first reading of the ordinance was held. Mrs. Hajdu moved for adoption of Ordinance 66-11-0 in the/first reading. Seconded by Mr. Brechan and carried by unanimous roll call vote D. Boroggh Trailer Permit Fee Schedule After some discussion, Mr. Hajdu moved to adopt the recommendations as presente Seconded by Mr. Lester. Borough Engineer - Chairman White reported that a !letter had been sent to Jim Barr terminating his services in 30 days, and that no reply had been received from him. He reiterated that the purpose in terminating the contract was not to discredit Mr. Barr, but rather to further conseilidate the Borough and City by using the services of the City Engineer. B. Action Against Holman's Garage - Attorney Madsen reported that he had filed suit against Holman's Garage and requested that the hearing on the preliminary injunction be scheduled on June 8. XI ASSEMBLY COMMENTS - None XII ADJOURNMENT - The meeting was adjourned at 11:00 p.m. ASSEMBLY MEETING - May 19, 1966 2 be rezoned, and within 300 feet of it, that an affirmative vote of all five Assembly members would be required. He stated that it would be necessary to determine the total land area of the abutting property ()Friers who were objecting. Mr. Lester withdrew his motion with permission of Mr. Haakansen, and moved to table the case for decision at the next meeting. Seconded by Mr. Haakansen and carried by unanimous voice vote. C. Mr. Brechan moved for adoption of Ord. 66-10-0 in the second reading. Seconded by Mr. Lester. Public hearing opened. Mr. Perez spoke in favor, and Rev. Bullock against the rezoning of Blk 15 Lot 1. Mr. Brechan moved to table the case. Motion died for lack of a second: Public hearing closed. Meeting recessed from 10:10 to 10:15 p.m. Mr. Brechan withdrew his original motion, with permission of his second. Mr. Brechan moved that the case be tabled so that the Chairman might study the objections, and report back at the next meeting.g Seconded by Mr. Lester and carried by unanimous voice vote. Mx. Thorsheim then requested that the ordinance be adopted with the deletion of Townsite Blk 15 Lot 1. Rev. Bullock expressed his approval. Seconded by Mr. Lester and carried by unanimous roll call vote. VII PLANNING & ZONING ITEMS A. Exception - USS 3218, Tr. M - Leroy Wittich (Case 136-B) Application read. There was a discussion on the required number of feet away from the extended centerline of the present runway foX a, building to be erected. The minimum was decided to be 165 feet, which would place the building only 5 feet from the front property line, thus requiring a variance. Mr. Lester moved that a public hearing be scheduled for the next meeting on both the exception and the variance. Seconded by Mr. Brechan Anduarried unanimous by voice vote. VIII OLD BUSINESS A. Opinion from Borough Attorney on Exception Granted to' L., A. Hopkins to construct a men's dormitory on Blk 1, Lots 7 & 8, Townsite, was read, advising that this exception is not valid. . King and Assembly (Case 137-A) First Reading After a discussion among Assembly members, first reading was not held, since it was decided that it should be revised. After brief discussion of sewerage and street names, Mrs. Hajdu moved for approval of the preliminary plat of Baranof Heights Subdivision,lAddn #2. Seconded by Mr. Brechan. Carried by unanimous voice vote. D. Eadivision, USS 3100 Lot 18 - Marion Parker (Case #138-41) Mr. Barr's recommendations were read. After some diacuesion, Mrs.. Hajdu moved for approval of the final plat of Lot 18 USS 3100, subject to the recommendations of the Borough Engineer being met, and that the Attorney be instructed, to prepare a resolution. Carried by unanimous voice vote. IX New Business - None X Chairman's Report A. Status - Borough Engineer. Mr. White reviewed the correspondence between himself and the Borough Engineer, and stated that they were to meet to discuss the termination of Mr. Barr's contract. There are no provisions for termination other than by mutual agreement. B. Sanitarian's Report. Mr. Carter reported that his office is catching up on all existing violations. Also, a new dump site has beenselected on the proposed highway between Miller Point and Pillar Creek which should serve for about 20 years. In the meantime, arrangements are being made for a temporary one-year dump site in the Miller Point area. Mr. Carter is in the process of working with the State to determine what health powers the Borough will assume if the takeover is approved by the election. C. Board of Equalization. Mr. White reported that there are 18 applications so far for the BOE, and that Mr. Cole expects about 40, which will total about 10 per evening. An attempt will be made to schedule the cases by area. D. Mr. Brechan moved to concur with the School Board inwriting a letter of intent to the J. B. Warrack Co. accepting their low bid for,construction of Elem. School. E. Mr. Brechan moved for acceptance of the Planning Board consisting of Richard G. Berg, Chairman; Steve Collins, and Ole Johnson. Secanded by Mrs. Hajdu. Carried by unanimous voice vote.
