Letter from Claude Hoffman, State Division of Lands, re Survey Work on Land Coming Up for Sale. Letter was read stating that contracts were being warded to Sam Best and Jim Barr for survey work in USS 3462, 3463, and 3512. Chairman White also asked. the Assembly's concurrence in approving a plan for the Highway Department to use aerial photography in surveying the proposed Otmedoi Point Road. The Borough will receive copies of the photographs. There were no objectic B. Letter from Chris Berg, Inc. re BOE Hearing. Letter was read in which Chris Berg, Inc. requested a hearing before the BOE. Mrs'. Hajdu moved that the Chairman direct the Attorneys to reply in line with their previous legal determination. Seconded by Mr. Brechan. Chairman White suggested that assess- ments on property neighboring Chris Berg's be pointed out to them in the letter. The Secretary was directed to give these assessments to the Attorneys. Motion carried by roll call vote as follows: Mr. Wright - Yes; Mr. Brechan - Yes; Mrs. Hajdu - Yes; Mr. Sutliff - No. C. Letter from Baptist Mission re Exemption from Taxes. Letter was read explaining that the Mission was not using the land for profit and therefore should be exempt from taxation on it. The attorney was requested to submit an opinion on this matter. It was suggested that it be well publicized that anyone may appeal to the BOE, but only while they are in session. ChairmanWhite stated he assured ' Mr. Stone that the new assessor will discuss the matter with the Baptist Mission in order to resolve it. VI PUBLIC HEARINGS . Second Reading of Ordinance 66-13-0 Rezoning Townsite Blk 15 from R1 to Busines Stan Thorsheim (Case 139-A) B. Ordinance was read. It was noted that it misstated; in Par. 5 from R-1 to R-3 instead of from R-1 to Business. Attorney was instructed to correct error. Mrs. Hajdu moved for adoption of Ordinance 66-13-0 in the second reading. Seconded by Mr. Brechan. Public hearing was opened'. There was a question as to the location of the property. Hearing was closed, and secretary was directed to call the roll. Notion was carried by unanimous roll call vote. Mr. Brechan yielded to the amendment of the motion, and motion carried by unanimous roll call vote. C. Request for Exception'to Build Retail Business - Airpark Blk 4 Lot 12 - George Hubbard (Case 145-A) Mrs. Hajdu moved that the exception be granted. Seconded by Mr. Brechan. Public hearing was held with no comment from the audience. Motion carried by unanimous voice vote. VII PLANNING & ZONING ITEMS A. Rezoning, Airpark Blk 4 from Unclassified to Business, on Assembly Initiative After discussion, Mr. Brechan moved that the Chairman be instructed to initiate rezoning of Blk 4, Airpark Subdivision, from unclassified to business, and that an ordinance be prepared on this rezoning. Seconded by Mrs. Hajdu and carried by unanimous voice vote. B. Request for Extension of Time on Preliminary Plat, Baranof Heights Addn 4#1 (Case 22-. Mr. Best, representing Baranof Heights, explained that a time extension of six more months before final plat must be submitted was being requested, due to tight money situation, and various other factors. Mr. Sutliff moved that the regwlst be granted. Seconded by Mr. Brechan and carried by unanimous voice vote. VIII OLD BUSINESS A. Building Inspector's Recommendations on Jack Brisbane Trailer Court, USS 3099, Lot 3 (Case 99) Mr. Stansbury's recommendation for legal action against Mr. Brisbane was read. Mrs. Hajdu made a motion that the Attorney be directed to instigate legal action against Jack Brisbane as prescribed in Ordinance 65-2. Seconded by Mr. Brechan and carried by unanimous voice vote. B. Building Inspector's Recommendations on Requwst for Temporary Permit, Donald Erdman Trailer Court, Mill Bay Road (Case 144-A) Recommendationa and agreement with Mr. Erdman for time schedule on development of court were read. Mrs. Hajdu moved that a temporary trailer court permit be granted with the proviso that the time schedule as presented by the Building Inspector be co lied with. Seconded by Mr. Brechan and carried by unanimous voice vote. C. First Reading of Ord. 66-13-0 Rezoning Townsite Blk 15 from R1 to Business - Stan Thorsheim (Case 139-A) Ordinance was read. Mr. Brechan moved for adoption of Ordinance 66-13-0 in the first reading. Seconded by Mrs. Hajdu. Carried by unanimous voice vote. X NEW BUSINESS A. Vacation of Uncollectible Taxes List of taxes was read. It consisted of several trailers which had erroneously been billed as real property prior to the incorporation of the Borough, and several bills for taxes on buildings only. Foreclosures cannot be made against these properties. Mr. Sutliff moved that the taxes on the submitted list be vacated. Seconded by Mrs. Hajdu and carried by unanimous voice vote. B. Discussion of Personnel Ordinance. Mr. White explained the need for a Borough personnel ordinance, and suggested that the Borough could ally with the City on such things as group insurance. Mrs. Hajdu suggested that the ordinance contain policy on the amount of notice required for separation of an employee, and the reasons for separation due to cause, etc. She suggested that an ordinance be drafted for presentation to the Assembly. Mr. Preston suggested that leave accrual be made retroactivefo, the present staff. Mr. White commended Mr. Preston on his take-over of the Clerk/ Toeasurer's position, and also commended the staff on its ability to carry on ASSEMBLY MEETING - J d 1966 411/k B. Trailer Court Permit - USS 3100, Lot 2 - Chuc Powell (Case 143-A) 2 Recommendationfor approval signed by the Building Inspectorand Sanitarian was read, and case was reviewed. Mrs. Hajdu commented that the ordinance was not being complied with, in that there were no engineering plans presented,'or surveying indicated. Mr. Powell explained that the construction had been started before the ordinance was passed, in 1964, and that he was complying with the ordinance in completing the court. Mr. Lester moved for approval of issuing the trailer court permit. Seconded by Mr. Brechan: .At Mrs. Hajdu's request, Mr. Lester re -worded his motion that the permit be graited when the court has met the requirements of Ordinance 65-2. Seconded by Mr. Brechan. Public hearing opened. Mr. Powell further explained the '°improvements that would be made and that the ordinance requirements are being met. Public hearing was closed, and motion carried by unanimous roll call vote. C. Trailer Court Permit - USS 3219, Blk 1, Lots 7-11 — Karl and Dere Brunstad (Case 1 Application letter, recommendations from Sanitarian and Building Inspector, and a protest letter from property owners in the area were read. Mrs. Hajdu moved that a permit be issued to operate a temporary trailer court only, subject to all conditions as set down by the Sanitarian and Building Inspector, including the time limits, and that a letter be directed to the Brunstads outlining these conditions. Seconded by Mr. Lester. It was decided that a public hearing was. not necessary in order to issue a temporary permit, but a discussion was held in which the audience participated. The many sewerage problems in the area were brought out. Mr. White commented that it will be some time before the CIty will be putting a sewer system into the area. Mr. Wright suggested that property owners in the area meet in order to plan for a possible private sewer system. At conclusion of discussion, motion carried by unanimous roll call vote. Request for Exception to Build Retail Business - Airpark Blk 4 Lot 12 - George Hubbard (Case 145-A) Application was read. Mr. Brechan moved that a public hearing be held at the next regular meeting. Seconded by Mr. Lester and carried by unanimous voice vote. C. Approval of Final Plat - Resubdivision of Erskine Addn Bik 6 Lots 8-10 - Alf Madsen and Lorraine Felton (Case 146-A) Jim Barr's recommendations were read, recommending that this plat be considered a preliminary rather than a final plat. Mrs, Hajdu moved for approval of this plat as a preliminary plat. Mr. Best explained that there may be some errors in distances because the plat has not yet been laid out in the field. He suggested that the plat be given tentative approval as a final plat. Then the survey work could be completed at the same time that a resolution is prepared. He requested the Attorney's assistance in determining whether or not a vacation is required. Mrs. Hajdu withdrew her original motion and moved that this plat be given tentative approval as a final plat, pending corrections, and that a resolution be drawn up for its approval. Seconded by Mr. Brechan, and carried by unanimous roll call vote. D. Trailer Park Permit - USS 3100 Lot 4 - Donald Erdman (Case 15-E) Sanitarian's and Building Inspector's recommendations were read. Mrs. Hajdu moved that Mr. Erdman be granted a temporary permit'to operate his trailer court with the existing number of trailers. Seconded by Mr. Lester. There was a short discussion on whether Mr. Erdman desired a temporary or permanent permit. He stated that he preferred a temporary one. Motion carried by unanimous roll call v+ E. Trailer Park Permit - Allman Addn Blk 3 Lots 19-23;. Allman Lalande Blk 1, Lots 13 & 14; East Addn Bik 42 Lots 3-8 - Donald Erdman (Case 144-A) Application and recommendations of Sanitarian and Building Inspector were read. Mrs. Hajdu requested that the Building Inspector prepare a time schedule for compliance of sewer and spacing requirements so that a temporary permit can be issued based on this schedule. This would be a continuation of the business area which was recently rezoned (Thorsheim Subdivision Lot 18, Sub Lots 1-7) and would result in the land being used for purposes for which there is a definite need in Kodiak. Mrs. Hajdu moved for adoption of Resolution 66-19-R. Seconded by Mr. Brechan and carried by unanimous roll call vote. F. Assessor's Certification of BOE Minutes and Total Assessed Value of Borough Certification was read. Mrs. Hajdu moved for acceptance of the valuation as submitted by the Assessor. Seconded by Mr. Haakansen and carried by unanimous roll call vote;-. VI D. Request for Rezoning, Townsite Blk 15, R1 to R3 - Stan Thorsheim (Case 139-A) Mrs. Hajdu commented that this would be spot zoning, since there is no other R3 zoning surrounding the property. Mr. Madsen agreed. Mr. Lester moved that an ordinance be prepared for the rezoning. Seconded by Mr. Brechan. Mrs. Hajdu pointed out that there would be no advantage in preparing the ordinance if there was doubt that it would be passed. Mr. Thorsheim suggested that the property be rezoned as Business, rather than R3, in which case it would not be spot zoning. Mr. Lester withdrew his motion, with Mr. Brechan's consent. Mr. Brechan moved that the case be tabled until a formal request for rezoning to Business was submitted by Mr. Thorsheim. Seconded by -Mrs. Hajdu and carried by unanimous voice vote. VII PUBLIC HEARINGS A. Exception and Variance, USS 3218, Tr. M, Lot 2 - Leroy Wittich (Case 136-B) Mrs. Hajdu moved for approval of the exception and variance. Seconded by Mr. Lester. Public hearing was held with no comments from the audience. Motion carried by unanimous roll call vote. B. Vacation of First Avenue, East Addn Blk 30 Lots 15, 16, 17 - Louis Iani and Fred Brechan (Case 128-A) Case was reviewed. Mrs. Hajdu moved for acceptance of the vacation. Seconded by Mr. Haakansen. Public hearing was held with no comments from the audience. Motion carried by unanimous roll call vote. VIII OLD BUSINESS B. Rezoning East Addn Blk 30, Lots 15-17, R2 to R3 - Louis Iani and Fred Brechan (Case 128-B) There was considerable discussion on whether governmental agencies owning property should or should not have a voice in approving of or objecting to rezoning of property. Mr. Madsen felt that governmental agencies should not have a voice, but that non -tax paying private agencies should have. Mrs. Hajdu and Mr. Wright felt that since the City had voiced objections to zoning matters in the past, they should also have a voice in being in favor of them. There was also discussion on which group of property owners,'by objecting to a rezoning could require a favorable vote of all five members of the Assembly --those within 300 feet of the exterior boundaries of the property involved, or only those abutting the involved property, or separated therefrom by a street or alley. Mr. Madsen was of the former opinion, and a lawyer retained by Mr. Brechan was of the latter opinion. Finally, Mr. Lester moved for adoption of Ordinance 66-9-0, approving the rezoning. Mrs. Hajdu seconded. After further discussion, Mrs. Hajdu requested that a policy be determined on whether governmental agencies should have a voice in such matters or not. The roll was called, and Mr. Wright:, Mrs. Hajdu, Mr. Brechan and Mr. Lester were in favor of governmental agencies having a voice, and Mr. Haakansen was against. Since, it was agreed that governme agencies should be counted, the objectors in this case did not cover enough area to require a five -member favorable vote of the Assembly to approve the rezoning. After a continuance of the public hearing which had been started at the previous meeting, at which time Mr. Eggemeyer added Mr. Olsen's name to the list of protesters, Mr. Lester's motion for adoption of the Ordinance approving the rezoning was carried by unanimous roll call vote, with Mr. Brechan abstaining since he had previously disqualified himself. The meeting recessed from 10:00 p.m. to 10:10 p.m.
