WHEREAS, AS 07.15.340 empowers the Borough to enact a zoning ordinance and provide for its administrat and amendment, and WHEREAS, the Kodiak Island Borough ha adopted Chapter.5 of its Code of Ordinances and Re ion, enforcement: s pursuant theret solutions, which provides for planning and zoning provisions and procedure, and, WHEREAS, according to the comprehensive plan adopted by the Kodiak Island Borough, Lot Twenty-six (26) Block One (1) the Kodiak Townsite has been classified business and WHEREAS, the Kodiak Island Borough P1 Commission has recommended that said lot be reclas anning and Zoning sified from business to R-3 as the property is contiguous to an R-3 zone and according to the comprehensive plan for 1999 it can be used as a buffer zone between industrial and residential and therefore this rezoning will not be contrary to the objectives of the plan and further the property is and has always been used for residential: purposes and is now owned and has always been owned by the same family which due to an increase in the size of the family require a larger residence and the family can better afford to build a larger home on the existing land than it can to purchase a large home at this time and it has been determined that the public necessity, convenience, general welfare and good zoning practic requires that reclassification, NOW,. The Old Harbor Council felt that the $4,000 spent on repair of the school room was wasted and the class room is still not up to par, many items that needed repair a year ago are still in need of repair. It was felt that this was the School Board's problem and that the Assembly should not take any action on this but just to obtain information as to the decision of the School Board. E. Letter from Mr. Dave Cluckey re Fire at Akhiok School. The letter was read stating that Mr. Mike Farsovitch's house was destroyed by the fire that originated in the School and he had been assured by several individuals that his house would be rebuilt. As of this date nothing has been done and sAr. Farsovitch has been shunted from house to house in the village. He has rented a house and would like for the Borough to replace his home and some of the iters that he lost in the fire as he feels the Borough bears a certain amount of responsibility. A list of the items was included.; LIF. Barr stated he would agree that we should help Mr. Farsovitch get help from some other agencies. This has been taken to BTA and other agencies but no answer has been received. Mr. Farsovitch is asking for between $1,000 to $2,000. Mrs. Hajdu suggehted that we take this letter to Roy Madsen to see if we have any possible legal responsibility and then the Assembly should think it over to decide if we have a moral responsibility even if we do not have a! legal responsibility. VI PUBLIC HEARINGS VII A. ORDINANCE NO. 68-30-0 rezoning of Townsite Addn, Lot ,26, Bik 1, from Business To R-3, William Hartman (Case 117-D) The Ordinance was read by title only. Mk. Barr moved for the adoption of Ordinance 68-30-0 Viand seconded by-Mts. Hajdu. The meeting was recessed and the public hearing opened. For the info nation of the audience the case was reviewed_statirg' Mr. Hartrnan's family was increasing and therefore a larger home was needed. lIt was questioned as to whether or not the lot was large enough to accommodate a larger home. It was noted that this was not the problem; the problem was that he would not be conforming to use as it is now zoned business.; The public hearing was closed and the meeting reconvened. The question was called for and the tion passed by unanimous roll call vote. PLANNING & ZONING ITEMS A. Ordinance No. 68-31-0 Rezoning East Add., Biks 36, 44, 45, 40, 43, 46 and 47 from R-1 to R-2 (Case 209-B) The ordinance was ready by title only and it was noted that this was initiated at the Assembly's request and has not yet been to P&Z but could be passed subject to the approval of P&Z. Mrs. Springhill stated she would like to have this go to P&Z before coming before the Assembly. Mr. Arndt moved for the adoption of Ordinance NO. 68.130-0, seconded by Mrs. Hajdu. Mor. Bullock felt that this should be talked about and taken under more consideration as many people have stated that this is a very large portion. The map was studied. Mrs. Springhill asked if the people who objected before would have to go around with another. petition and was informed that they may come to the meeting and voice their objections rather than sign a petition. 1r. Powell thought that FHA was in favor of keeping zoning sepa- rate and would finance heaves in this area more easily, it were low density. Mrs. Hajdu pointed out that Mr. Gagnon had stated that current thinking is to make one residential zone for all type of residences., Mr. Britton stated that if the zonings are taken as requested there will be a slow development and one could see how it is going in certain areas. The question was called for and the vote was as followsg Mt. Barr NO; Mrs. Springhill Weighted NO; Mr. Bullock Weighted NO; Mrs. Hajdu YES and Mr. Arndt YES. The Ordinance was defeated in the first reading. Mrs Springhill moved! that the proposal for rezoning be presented to P&Z for consideration and recommendations. Seconded by Mrs. Hajdu and passed by unanimous voice vote. VIII OLD BUSINESS A. Resolution 68-43-R requesting Adequate Snow Removal by State Highway Department. The resolution was read stating that the Highway Department is responsible for snow removal and that this was not being done. Mt. Taylor wanted to know why the road to Bell's Flats was not plowed as they are a part of the Borough. It was pointed out that the Borough does not have the road power -and that this is up to the State and they should check with Mr. Hillbish and the Department of highways. r. Letter from Roy Madsen re dismissal of court infeecticn - Jackson Trai].er Court - The letter was read asking if the Borough had any objections to the dismissal of the Order granting the injunction in this matter. Mrs. Hajdu asked about the Affidavit and that it be read. There was nd copy of the Affidavit and Mrs. Naidu stated her lawyer had enclosed the Affidavit along with her letter and she felt that the Assembly should see the Affidavit. Nts. Hajdu suggested that this item be tabled until the Affidavit submitted balite Jackson could be reviewed by the Assembly. Since a copy of the needed paper was in Mrs. Hajdu's office it was decided that sayeone should obtain same and return to the meeting. VI PtBLIC HEARINGS vgt A. Ordinance 68-29-0 re Tax nefermeeee for Senior Citieens, Second Reading. The ordinance was read by tiL only. Mrs. Sprieghill moved for adoption of Ordinance 68-29-0 granting Tax Deferments for Senior Citizens in the second reading. Seconded by Mr. Barr. The rmting was recessed arid the public hear- ing opened. Dic. Best briefly e=15ined the ordinance for the audience - it is an ordinance for people over 65 aears of age with an income of no: more than $3,000 and &awing for a deferment cf no wore than $250. The taxes will be a lien on the property and just allows the person to continue to live in his home under conditions of deferment. Mr. Stansbury asked if there would be penalties incurred over a period of several years if the taxes were deferred and was infaemed that this was not the intent. It was noted that at the present mill rate this would be about two cents on the dollar. The : public hearing was cloned and the meeting reconvened. The question was calla ed for and the motion passed by unanimous roll call vote. FLAMING & ZONING ITEMS A. Ordinance 68-28-0 rezoning Blocks 36 & 44, East Addn, from R-1 to R-2, Petiticners (Case 209-A) The ordinance was read by title only and it was noted that this item was tabled last meeting for lack of a full Assembly and since there are only four members present now it may have to be tabled until next meeting. A telephone call was made and the fifth Assembly man will be present. Case was set aside until that time. • First Reading Ordinance 68-30-0 rezoning Lot 26, Bik, I, Townsite Addn, IREFETISiness to R-3, WilliamBartean, (Case 117 -D77 -The ordinance was read by title only. Mrs. Springhill moved for adoption of Ordinance 68-30-0 in first reading. Seconded by Mr. Barr, Mrs. Hajdu stated that this seems to be in the area that upgrading is needed and that this action would reduce the zoning. The question was asked why this case could not be handi as a variance as had been done in other cases. The zoning map was reviewed, and discussed. Mr. Barr stated that he was more in favor of a variance as this would give better boundaries. Ufz. SE;:citi7.1 stated:that there were n objections from anyone in the area. The question was called for and the motion was passed by unanimous roll call vote. C. Ten -tive Final Plat Subdivision, Tidelemds, Tract ak Parcels A-E, City (Case 211-A). The plat was studied and it was noted that this was the Old City Dock area. The Borough Engineer still needs to sign the plat. Mrs. Hajdu moved for adoption of tentative Final Plat Subdivision, Tidelands, Tract 3A, Parcels subject to the approval of the Borough Engineer. Seconded by Mrs. Springhill. The question was called for and motion passed by unanimous roll call vote. CLD BUSINESS A. Letter from R. W. Fischer re re -mapping. The letter was reviewed; a quotation of a maximum of $1,200 for a 200 scale map was given. This type of map would be very desirable and would increase the effectiveness of the Assessing' Departeent. This is a type of work that can be done locally. Mr. Best feels this should be done in the budget; however it could not be done immediately and be available for use this year. Mrs. Hajdu, wanted to know if this re-mspeing would cut down on tha amount we are paying the Assessor. It was noted that it would cut down on the day to day time. Mrs. Hajdu moved to place this item aside for consideration in n.xt year's budget requests and also to ask for quotations from local people. Seconded by Mr. Arndt. Mrs. Springhill moved for the adoption of Ordinance 68-26-0, seconded by Mr. Arndt. Meeting recessed and public hearing opened. There were no comments or objections.. Public Hearing closed, meeting recon- vened. The question was called for and motion passed by unanimous roll call vote. E. Ordinance 68-26-0 Creating Water Service Area Outside City. The Ordinance was read. Mrs. Springhill moved for adoption of the ordinance, seconded by Mr. Arndt. The meeting was recessed and public hearing opened. Mr. Chase asked if collection would be made by the City or the Borough. He was informed thattol- lectioh.would betaken by the Borough although may be, contracted through the City. The city did install the lines. Mr. Gregory asked if the property `. owners would be asse.sed for the lines all' ready,installed.._ e Mr. Barr said yes if the Borough had to buy them from the City. It was stated that the origi- ta.l,:cosfc would probaly be" pro -rated over a period of a year. There are about 30 users and so far the cost is about $10,000 divided among the users would be about $330 a lot. The installation cost would go to all owners involved but administration costs only to users of the water. Mr. Keiser stated that when it comes to an agreement with the city the Borough should keep in mind that perhaps if a water shortage occurred the City might turn the water off. Mr. Barr said that if an agreement cannot be reached the whole thing will have to fold up. Public hearing was closed, meeting re- convened and the question was called for: Motion carried by unanimous roll call vote. F. Amended Ordinance 68-25-0 Amending Personnel Reg The ordinance was read by title only. Mrs. Springhill moved for adoption of Ordinance 68-25-0, seconded by Mr. Arndt. Meeting recessed and public hearing was opened. Mr. Chase questioned why the Borough did not have to pay time and a half for over time. Suggested that this should be checked out by the Attorney. Public hearing closed and meeting reconvened. Mrs.-.Springhill:moved_to amend her motion to include this is .sugject. to final approval of the Attorney with regard to overtime pay. Mr. Arndt seconded the amended motion, the question was called for. Motion was passed by unanimous roll call vote. VI PLANNING & ZONING ITEMS • A. Mrs. Springhill reviewed the ordinance. Mr. Chase felt that this would be unfair to the people inheriting the property to have to pay the taxes and buy back the house along with paying an inheritance tax. It was pointed out that; only those senior citizens applying for this deferment would be so treated. Mrs. Springhill moved for the adoption of Ordinance 68-29-0 in the first reading, seconded by Mr. Arndt. The question was called for and motion passed by unanimous roll call vote. - B. Box 1246 Kodiak, Alaska 99615 September 4, 1968 Dear Mr. Chairman and members of the Borough Assembly: I write this letter seeking permission to build a larger house on my Lot 26 Bik 1, Townsite Addn. This lot is situ4ed just past the hospital on tat portion of groung separating Tagura Road and Upper Tagura Road. My present house is only 15' x 25' with only one bedroom and quite inadequate for my wife and I and two small girls with another child expected in February, 1969. I was born and raised on this same ground upon wf which I now occupy. At one time; my family hada large -four bedroom home here but we -were cl&aned out by a fire in 1940. I simply cannot afford to buy another larger house elsewhere. However through a Veteran's loan I can have a 24' x 38' house built on Ty lot. Sincerely, William F. Mr. 1;elch moved for a public hearing to be held at the next meeting. notion died for lack of a second. It was then found that a plat had not been si.thmitted with An Chase's application. Since a plat is One of the requirements* for an application for a variance, the Commission,agreed to table further action on the request until the next meeting, pending submission of the required plat. ! _Reguest for Variance - Lot 26, Block 1, Tcwnsite Addn - William F. Hartman lerase 117-D). Mr. Hartman's letter of application wasi read. Mr. Stansbury stated that this case waz similar to that of Mr. Chase, since Mr. Hartman is trying to enlarge a building which has a non -conforming use. It was pointed out that the Attorney felt that a residence could legally be permitted in a business zone. however, the Commission felt that the Zoning Ordinance did not permit residences in business zones. It was suggested that Mr. gartman's lot be rezoned to 117-3, since it is contiguous to R-3 zoning, and since this would -; permit him to enlarge his house. Mr. Brothers moved, seconded by Mrs. Gellis, that Mr. hartman's applicatthon be changed from that of 1 a variance to rezoning from Business to R-3, and that a public hearing be held on this rezoning at the next meeting. Motion carried by unanimous roll call vote. VIII SUBDIVISIONS, PRELIMINARY REVIEW A. Request for Vacation and Replat of Entire Urban Renewal Project. A letter from ASHA outlining the suggested procedure for accomplishing this was read. The letter suggested that actual survey not he required until the lots are sold. This procedure would allow some title transfers which are now being held up because certain blocks have not been platted and recorded. It would then also allow these lots to again be placed on the tax roll. The plats were studied.; Mrs. Gellis moved for tentative approval of the plats, and approval of the procedure as outlined in the letter, seconded by Ur. Welch, and carried by unanimous roll call vote.
