P1r. Busch moved to adopt KIB Resolution Z-4-77 regarding establiishment of
a moratorium on all rezoning and subdivision activity to the Borough Assembly:

Mr. Logan moved it is the intent of the P & Z Commission to address in the
Comprehensive Plan, the question of dormitory uses for seafood processing
facilities in the industrial zoning districts. Mr. Erwin seconded the motion.
Motion passed by unanimous roll call vote. !"
P1r. Busch made the motion to reject an application from Rolland Jones on
behalf of New England Fish Company for a special exception to construct a
dormitory in connection with a fish processing facility in an industrial
zoning district. P1r. Logan seconded the motion. Motion passed:by unanimous
roll call vote.
B. REPORTS
The Borough Manager stated that there will be a Joint Forum meeting on October
11, 1977. The Joint Forum consists of the P & Z Commission,`'O.ED.P., OCS,
Borough Assembly and City Council. Dr. Firth a Consultant for Woodward &
Clyde, will be present to present a draft of the Marine Facilities Study,
along with Mr. William Blair, the Project Consultant,from Kramer;; Chin, and
Mayo. Mr. Blair will present a progress status report on the Kodiak Regional
Comprehensive Development Plan. Mr. Milligan read into the record a letter
from the Port Lions City Council Chairman stating Port Lions acceptance of
the proposed plan to rezone the lands within the city and, also, thanking
the Borough Assembly, P & Z Commission and Borough Staff for'thei;r assist-
ance in preparing the Plan.
P & Z COMMISSION COMMENTS
Mr. Milligan stated that the Borough Assembly had taken actidn, in February, and
did budget and authorize for a full time Building Inspector.

density zoning in order for more people to have easy access to the
business district. Has a development plan for a fourplex, with
apartments to be built on top of the garages, on Mission Road.
Ochard Sims, Lots 11 6 12, Block 30, East Addition spoke in opposi-
oirriFrt-Fe—rezoning stating that he had not signed the petition to
rezone this area. Wishes the rezoning to remain the same as when he
purchased his property, lower density. Feels that the development
ane themselves are insufficient. All the homes involved with the
exception of Mr. Eggemeyer's are already built on variances because
ofland contour and road right-of-ways. Stated there is no considera-
tion for road right-of-way or utility easements on Mission Road and
feels that P 6 Z has ignored problems that must be faced in the future,
there would be 4 fourplexes in a row. Says there are not enough
square feet to accommodate all of the units that are planned. There
would.he parking problems. Mr. Sims submitted pictures of the area
asevidence. Mr. Jack was informed that some areas have bedrock on
the surface and other areas are swampy with bedrock mixed in.
Public hearing closed; meeting opened. Mr. Milligan stated there was
apublic hearing held by the P & Z but Mr. Sims lots were not included
nhe was not one of the petitioners. The commission initiated re-'
ming of Lots 11 & 12 as they felt it would be in the best interest
ofthe community as high density residential zoning. Lots 15, 16 &
17 were 'rezoned to high density at an earlier date. Mr. Milligan read
the code the regulations pertaining to R-2 and multi-family
dwellings stating that a four-plex requires 2,400 sq. ft. The

wae instances the preser:: homes are on the same lot as that of the

177-23-0. Seconded by Mr. Estes. Mr. Estes feels this might be an

Dr.Dmick stated that because an area is zoned R-3 does not mean

!laPrehensive plan calls for R-2 with only about four months before

(Huey DeVille).
WHEREAS, Alaska Statutes 29.33:.090 empowers the Borough
to enact a Zoning Ordinance and provide for its administration,
enforcement and amendments, and
WHEREAS, the Kodiak Island Borough has pursuant thereto
adopted Title 17, of its Code of Ordinances and Resolutions which
,provides for planning and zoning provisions and procedures, and,
WHEREAS, according.to the ComPrehehsive Planning and
'Zoning Map adopted by the Kodiak Island Borough, that Lot 16,
Block 19, Kodiak Townsite has been zoned R-21 and
WHEREAS, a petition has been received from Huey DeVille
requesting that same be rezoned from R72 to R-3 to allow for
future development, -
WHEREAS, the Petition was considered and approved by the
Planning and Zoning Commission on July 0, 1977, and said body has
recommended the reclassification of said property from R-2 to R-3.
NOW, THEREFORE, BE IT ORDAINE'by the Borough Assembly of

I would like to request to have lot 16 U.S. Survey 2537-7,B
on Hilcrest Avenue Rezoned from R-2 to R-3. My adjoining
lot 15-A is R-3 and does not have enough square feet for
R-3 so I need lot 16 Rezoned so as to have enough square
feet for a apartment. The two lots would then give me
8584 square feet.
