This is ny only problem with your rezoning attempt. Mr. Murray stated that a31 existing plans show a building height of 35 feet, or less. I we could use the contract zoning pro- vision Chapter 17.73, which addresses problems of this nature, you could proceed with rezoning with no objection from us. Your reluctance to agreeto contract zoning, which would restrict building height to 35 feet, would imply intent to build ober, 35 feet, which we would oppose. There are many rPasons for pro- tecting the established rights, including view, of property owners. We believe that allowing the zoning to change and provide for tall -buildings near the water at the expense of residents further away would not serve the public interest and would not be' a reasonable action for the borough assenbly to make. The argument of, "not giving any concessions until you have to" seams inappropriate for this situation. It assumes you haveithe rezoning assured. To agree to a stipulation that has no effect on your plans, past or present, is no concession at all. This contract rezoning would also give•the surrounding property owners a carndtment, that even if other zoning restrictions_ such as setbacks, parking, business activity, etc., are related, at -least the really important one of building height would be retained. How would you like to buy a piece of view property, pay the view property price, and expect a 35 foot height restriction, then have the Borough change the rules for one party that would affect the quality of life for all the residents uphill from the project. That is like a person at the start of a stream dumping his ' garbage into the stream. It is soon not his problem at all. It is, however, a real problem for his neighbors downstream.' We have tried in earnest to reach a solution that works for everyone. We hope you can join in this spirit. Amendments to the:zoning map (rezonings) may be approved subject to onejor!more contract limitations which restrict the use of land beyond that provided by a proposed zoning change. (Ord. 81-28-0 §1(part), 1981) . 17.73.020 Purpose. For the purpose of this section "contract zoning" means a rezoning to a less restricteduse and when the owner of the property involved agrees, either through a contract with the borough or a cenvenant in favor of same, and places restrictions dm the use of his land which go beyond the requirements contained injthe proposed .zoning district. (Ord. 81-28-0 §1(part), 1981). 17.73.025 Limitation. A rezoning using:the special provisions of this chapter must conform to the standards con- tained in Chapter 17.72:_.. -(Ord. 81-28-0 §1(part), 1981). 17.73.030` Scope. Limitations established by contract zoning may: A. Limit theause of property affected so that one or more of the uses which would otherwise be permitted in the district classification being adopted shall' not be permitted in this specific district as amended; B. Require compliance with such design standards re- lating to the construction, design and placement of buildings, landscaping, streets, roadways, pathways, drainage ways and ,other site design features as may be necessary to protect the community from the impact of future development. (Ord. 81-28-0 §1(part), 1981). 137 (Kodiak Island Borough 9/81) 17.73.050--17.73.090 17.73.050 Requests for limitations. A request for contract zoning shall specify those uses and structures to be allowed under the terms of the proposed limitations. The request shall -also specify any site design features which the party making the request wishes to be considered as limitations. The request shall include a binding committment on the part of the owner(s) to use the property only in accordance with the contract zoning limitations. (Ord. 81-29-0 §1(part), 1981). 17.73.060 "Planning commission review. The plannig com- mission shall review contract zoning proposals following the procedures specified in Chapter 17.72 for amendments and changes. The planning commission shall consider and make recommendations on all aspects of the proposed contract and may recommend additional or substitute limitations. (Ord. 81-28-0 §1(part), 1981). 17.73.070- Assembly action. The assembly shall act on Contract zoning proposals following the procedures specified in Chapter 17.72. When a zoning change has been initiated by the owner or owners of the subject parcel, the assembly shall not apply contract zoning limitations more restrictive than those applied for by the petitioner and/or approved by the planning and zoning commission unless the written agree- ment of the petitioner is obtained. (Ord. 81-28-0 §1(part), 1981) 17.73.086 Amendment of zoning map. The official zoning map shall be amended as necessary to reflect the existence of contract zoning. Areas affected by contract zoning shall be identified by the use of the suffix "CZ" and shall be clearly di-s€inguished from areas in like zoning districts which are not subject to contracts. The number of the ordinance creating a district subject to a contract shall be printed on the zoning map within the boundaries of the affected district. (Ord. 81-28-0 §1(part), 1981). 17.73.090 Contract zoning to control. Contract zoning provisions contained in an ordinance amending the official zoning map shall govern over any inconsistent regulations contained in the zoning regulations. A11 district and supplemental district regulations not specifically affected by a contract shall apply in the same manner as if they were not subject to contract limitations. The total height of the Senior Citizen Complex is computed from these plans to be 47 feet. I am forwarding to Mr. Shealy the:entire document, but have zeroxed the important pages for the mayor and each member of the assembly. This document completes almost two years of planning on the part of the Senior Citizens of Kodiak, Inc. Originally, the emphasis was on additional housing alternatives for seniors. However, the cdstlof operation of such facilities detered the board from further consideration. It was decided that a SeniorCenter could best serve the needs of the elderly popul.ationlat this time. I I have reviewed you CIP, and find that you have included a senior center in your FY 85 budget. The board and,I feel that with the work already accomplished Kodiak should move forward with this project. I am therefore requesting that the assembly consider a resolution in support of the project at your April 7 meeting. I have taken the liberty of drafting a resolution which you might use. Your support of our efforts would be greatly apprecilated. If you have any questions, do not hesitate to contact me. The property is presently zoned R-3. In order to maximize the usefulness of the property for our purposes the board wishes to have the property rezoned to Business. For your information the board would note that this rezoning is compatable with adjacent properties. The board does have some preliminary designs of the building and the site plan. The board is aware of the concern of the planning and ':zoning commission concerning occupancy and parking requirements. The board has inquired with your staff the current regulations. (A copy of that response is attached.) You will note that our preliminary site plan calls for 15 offtstreettparking spaces on our property. Further,t-the board notes that in Mr. Walton's letter he indicates that parking requirements ma3,be satisfied by use of adjacent properties for that purpose. The board has discussed this with Mt. Louis Tani of Sunset Development Corp,., the adjacent property owner. Mr. Iani has expressed a willingness to allow access to the undeveloped portion of his property. This would provide 20 additional spaces. (Please note this is the shaded area on our site plan.) Further, it is anticipated that the maximum usage would occur on:rare occasions', and,usually in the evening. There is parking in front of the Griffin Building which is within 600 feet of the proposed center. Given these considerations, the board feels that it has satisfiedzthe::requi'rements of 45 parking spaces.
