VED ROAD s Rn. • Letter of Concern Priority Level High as Work is in Progress September 4, 2009 To: Bud Cassidy Cc: Kodiak Island Borough Assembly Director Kodiak Island Zoning Commission Kodiak Island Borough Zoning Kodiak City Council This letter is to voice our collective concern regarding the contradictory nature of current Kodiak Island Borough Zoning Code and how it may be interpreted by staff or prospective developers. As owners of lots in the Kodiak Business Park Subdivision with a shared vision, we feel it is imperative for the community and its citizen's long term prosperity that proper planning and regulation be administered by local mrmicipalities. We do not intend in this letter to offend any business or personal interests of other valued members of our close-knit community. •1n fact we applaud entrepreneurial efforts and infrastructure development in all industries. We also must protect our interests and the interests of various community groups in the responsible development of Near Island. Our immediate iate concern is of the interpretation of Chapter 17.90 13- Business District Zoning. Section 17.90.010 clearly states the specific intentions of the chapter are to "prohibit the use of business district lands for manufacturing and industrial purposes". Industry is defined in Section 17.25.100 as "means the manufacture, storage; extraction, fabrication, processing, reduction, destruction, conversion, or wholesaling of any aiticle, substance, or commodity, or any treatment which changes the form, character, or appearance of a resource material or previously manufactured item. [Ord. 81-40-0 §1, 1981. Formerly §17.06.335]." It bas come to our attention that the owner of Lots 4, 5 and 6 of Kodiak Business Park Subdivision, or some portions thereof, are currently being developed for industrial and/or manufacturing purposes. Further definition of manufacturing and industrial uses can be established through a comparison of Industrial versus Business District Zoning as permitted by Sections 17.105 and 17.90 respectively. SPecifically permitted uses 13, G, N, Q, R, S, U, BB, and FF as stated under the Industrial District (see attached). We also understand that a zoning compliance permit has not been issued. Therefore we would ask that zoning compliance permits for uses that do not fit the intent of Business District Zoning be denied.
