Dear Leonard:
As a result of the meeting today attended by you and Bill Jones of the City of Kodiak,
and Barry Still, Wayne Kozak, and me from Brechan Enterprises, Inc., I believe we have
come to the following agreement regarding the above referenced grading plan.
Brechan Enterprises will close the fill, cut a bench at about the same elevation as the
existing berm, and seed the slope. There will be no asphalt, concrete, or culvert visible
before we seed. The toe of the slope will remain basically where it is now, and no further
engineering will be required. This work will be accomplished as other projects permit,
but will be completed within the next twelve months.
As you and I discussed by phone after the meeting, this agreement does not prohibit us
from applying for a permit in the future. At some point, we may want to level and or
pave the existing shop yard, and such an application would stand on its own merits.
We appreciate your cooperation in bringing this matter to a close, and look forward to
working with you in the future.

Dear Mr. Jones,
As KANA's new building project manager I had several discussions with the City
of Kodiak's building inspector (Leonard, I believe) regarding the status and
future of the expanding landfill at the edge of Brechan's property that borders
KANA's property on Woodland Drive and Rezano£
In one of our early discussions in May, 1995, I was told that this particular
situation was an ongoing situation between Brechan's and the City and that by :..
December "when things had quieted down" for Brechan that the situation would
be addressed.
In May, 1996, one year after the initial discussion and nearly six month since
"things had quieted down" there was no discernible changes in the status of the
landfill In fact it appeared that additional fill had been deposited over the edge
of the hill. I contacted the City again and was told that the plan was for
Brechan to reduce/maintain the slope at 45 degrees, create a terrace halfway
down the slope to mitigate any run-off or excessive slipping/sliding and that the
progress was being made.
It is now 18 months since we first discussed our concerns at KANA and since we
were told that the situation was being dealt with. In a phone conversation with
Mr. Bill Oliver at Brechans on October 9, 1996, I learned that there are "no
plans" to do anything with the landfill/slope. .
It has also been brought to my attention that Brechans and the City of Kodiak
are apparently at odds over a "change of rules", according to Mr. Oliver
regarding the understanding between the two about the landfill situation
KANA has anopportunity to clear and stabilize our. section of the site where we
lost/removed the spruce trees that were on the lot at the time we began
construction. It would be prudent to have the adjacent slope on Brechan's
property stabilized prior to any efforts on our part to groom, re -plant or
otherwise landscape if there are several concerns regarding excessive run-off,

additional deposits and any other factors that might cause the steep slopes to
become unstable or erode excessively.
There is also an element of visual degradation caused by the unsightly dumping
of debris (large chucks of concrete, asphalt and rusted metal over the side of the
hill.
At this point in time, what is the status of the Brechan landfill/slope from the
City of Kodiak's perspective? We are willing to work together with the City and
Brechan's to resolve this so we have an appealing and functional landscape, a
stable embankment and a solution that includes whatever considerations
necessary to satisfy both parties, the concerned residents adjacent to this site
and the City of Kodiak.

Dear Mr. Brechan,
On July 17, 1993 I received the revised grading plan for your fill project.
While this plan was much improved to the original, it still does not meet the
requirements of the 1991 edition of the Uniform Building Code, Chapter 70,
Excavation and Grading, as adopted by the City of Kodiak. (see attached)
Over the years I have received numerous questions about this fill from concerned
property owners adjacent to this tract along Woody Way Loop. I have also
discussed this project frequently with your management. Now, before you actually
construct this slope, I must bring the problems with the plans to your attention.
It appears that because of the height of the fill, the fill slope needs to be
benched or terraced. Please reference Drainage and Terracing, Section 7012. Your
current plans do not show this.
Your plans show a 15 setback from the property line. It appears that the setback
must be increased to ,20' at the higher portion of the fill, towards Rezanof. See
Setbacks, Section 7011.(c)
I have been asked about the stability of the fill, drainage, and erosion control.
These are questions that an engineer should answer. See Grading Permit
Requirements Section 7006(c), Grading Design. Grading in excess of 5,000 cubic
yards shall be performed in accordance with the approved grading plan prepared
by a civil engineer.
For the reasons stated above, you are hereby ordered to submit an engineered
grading plan for this lot before continuing with the filling of this property.
