Non -permitted Use
Dear Mr. Joseph:
A complaint has been received by the Community Development Department that
dogs are being boarded on your property referenced above as an extension of
the business conducted there.
As you are aware, the business use of your R-3 property store is
nonconforming use allowed as a "grandfather" right under Sections117.36.050
and 17.36.060 of the Kodiak Island Borough Code. These same Codesections
specifically prohibit the enlargement or extension of any nonconforming
business use. (Attached)
You may also be aware that a request for a variance from relevant'sections of
the Code by the previous property owner to do exactly what is in question
here --that is, to permit the existing nonconforming use (pet shop and feed
store) to be expanded to include the boarding of animals (a kennel) --was
denied by the Planning and Zoning Commission at their April 15, 1987 meeting.
This letter is intended to make clear that any change in the business use of
this property requires the review and consent of the Kodiak Island Borough
Planning and Zoning Commission. Therefore, any boarding of animals on the
property, or any other change in the business from the use that has been
"grandfathered," must be discontinued until such time as it is approved by
the Commission.
