Please be advised that the Planning Commission held a lengthy public hearing at its September 21, 1983 meeting and unanimously recommended approval of the attached ordinance rezoning the "Island Lake Area" from RR1 to R1 or R2. The public hearing mentioned was preceded by numerous work sessions and an inform- ational public hearing. Attached for the Assembly's information and consideration is a proposed ordinance and materials discussed by the Planning Commission. The minutes were approved with one correction to Item #12 Committee Reports. Mr. Hill made the recommendation that the Commissioners have staff reports and related material at least one week prior to a regular meeting. MRS. CROWE MOVED TO APPROVE the minutes of August 17, 1983 with the correction. Mr. Rennell seconded the motion and the motion PASSED with a unanimous voice vote. 2. APPEARANCE REQUESTS WITH PRIOR NOTICE AND AUDIENCE COMMENTS. MR. WALTON introduced two letters submitted by residents adjacent to Rasmus Anderson's property who were in complaint of a building permit. Mr. Anderson was not present. It was decided to hear the complaint under Item #17, Additional Audience Comments. 3. OLD BUSINESS. (A) Accessory Building Ordinance. MRS. CROWE MOVED TO PASS ON TO THE ASSEMBLY for their approval Ordinance No. 83- 60 -0(A) to read as follows: Section 1. That Section 17.51.050 of Borough Code is amended to read as follows: 17.51.050 Area. The area occupied by accessory buildings shall not exceed 10 percent of the area of a lot or mobile home space. Accessory buildings shall not be closer than 5 feet to any side or rear lot line, or be located within 25 feet of any public right -of -way other than an alley. Mr. James seconded the motion and the question was called. The motion PASSED by unanimous voice vote. 1 4. PUBLIC HEARING ON CASE 83 -108. Island Lake Area Rezdning. Several letters were received from the public as testimony and accepted as part of the record. Mr. Walton explained the maps on the wall for the public's information and the meeting was opened to public hearing. The Commission was met with opposition from several residents of the Island Lake Area, specifically Lots 1 and 2, U.S.5 3464; Lots 5 and 6, Block 10, Miller Point Alaska First Addition; Lots 1 through 7, U.S. 3466. Objections ranged from inadequate road system to handle an increase in traffic to future police /fire protection, vegetation and erosion, and no compelling need to rezone. There were a few residents from Shafka Acres and Island Lake Sub- division in favor of rezoning their property to R2. Mr. Hill closed the Public Hearing and opened the Regular Meeting. The Commissioners discussed at length the alternatives open to them., MRS. STRICKERT MOVED TO APPROVE CASE 83 -108, Island Lake Area Rezoning, with an amendment to the proposed ordinance. Item #1, Lots 1 and 2, U.S. Survey 3464; Item #2, Lots 5 and 6, Block 10, Miller Point Alaska First; and Item #16, Lots 1 through 7, U.S. Survey 3466 be left as they are at RR1 zoning. Mr. Gregg seconded the motion and the question was called. A roll call vote was taken and the motion CARRIED by unanimous roll call vote. 5. PUBLIC HEARING ON CASE 83 -110. A request, for a Conditional Use Permit in an RR1 district and a request for a variance from Borough Code 17.17.050, Rear Yards, on Lot 3, Block 3, Island Lake Subdivision, U.S. Survey 3219, submitted by C.K. Lamont. MR. WALTON gave an additional staff report advising of one letter in opposition to the request. Mr. Hill closed the Regular Meeting and opened the Public Hearing. MR. LAMONT spoke before the commission stating that he wanted to move a building back 10' from where he is building a small propeller repair shpp. His proposed use of the building was storing welding gear and doing outboard motor repair inside the building. The question was raised con- cerning the general welfare of children in the area due to the bottled gas and equipment needed in this type of home occupation, but Mr. Lamont remarked that he used extreme care and caution in his occupation. Four local residents spoke before the Commission in opposition to this request. Their objections were small children living next door, increased traffic problems, not wanting a business in a residential area, and the increase in scrap material being stored on the property. MR. HILL closed the Public Hearing and opened the Regular Meeting. The Borough Code on home occupations was read for the record: "A home occupation means an accessory use of a service character customarily conducted within a dwelling by the residents thereof, which is clearly secondary to the use of the dwelling for living purposes. It does not change the character thereof and does not involve more than one paid assistant." MRS. STRICKERT MOVED TO APPROVE CASE 83 -110, a request for a Conditional Use Permit in an RR1 district and a request for a variance from Borough Code 17.17.050, Rear Yards, on Lot 3, Block 3, Island Lake Subdivision, U.S. Survey 3219, submitted by L.K. Lamont. Mr. Rennell seconded the motion and the question was called. The motion FAILED the roll call vote unanimously. Mr. Lamont was advised of his right- to appeal in writing to the Borough Assembly within 10 days, and that both requests were denied. The reasons for voting no were stated by the Commissioners as follows: On the issue of the Conditional Use Permit: a. This request did not classify as a home occupation; b. That the conditional use would not preserve the value, spirit, character and integrity of the surrounding area; c. That granting the conditional use permit would be harmful to the public health, safety, convenience and comfort; d. That sufficient setbacks, lot area, buffers or other safeguards were not being provided to meet the conditions listed in Subsections (A) through (C) of Section 17.67.050. I object to the rezoning to R1 of Lots 1 and 2, USS.3464, and Lots 5 and 6, Block 10, First Addition, -Miller Point Subdivision. Although rezoning to. R1 of the lots south of Island Lake Creek would be an appropriate recognition of existing land use, rezoning the area north of Island Lake Creek to a higher density classification would mean changing the character of the 'existing land use and would result in changing the. region. The only consideration in proposing the change appears to be provision of sewer and 'water to these four lots. The present zoning code description and definitions of RR1 (Rural Residential 1) are compatible with the existence of sewer and water. The difference between R1 and RR1 is that RR1 is defined as a district for "large lot, low .density residential purposes" while R1 is for "small lot single-family residential dwellings." In making such a major change to the character of land use in the area; a .number of other equally important conditions need to be considered: Roads. Even with the future addition of Lilly Drive, roads in the area. barely handle existing traffic and could not handle the traffic volume that, could be created by subdivision. For the area immediately surrounding the lake, there is no legal access except the lake itself and a few privately negotiated easements. 2. Fire and Police Protection. Subdivision would mean an increased demand for fire and police protection. The present fire service district is a volunteer department with limited equipment. Improvements in these services would need to be considered in a plan to increase the density of the area; a schedule for providing them and funding them should be included in the Capital Improvements Program; Other considerations exist: 3.. There is a need to protect sensitive vegetation in a vul- nerable area. Spruce trees presently .protect steep slopes in the \J Planning and Zoning Commission -2- September 21, 1983 area. Trees have already been cut from the Lilly Way right -of- way and from'several. lots. Winds have subsequently toppled many of the newly exposed trees on adjoining lots: This process continued could lead to serious, erosion and runoff problems, not to mention destruction of a presently beautiful area. 4. The capacity of the lots in question to sustain higher density development needs to be considered. The vast majority of the lots in the area north of Island Lake Creek are too steeply sloped to sustain higher density development. Occasional lots are less steeply sloped and could sustain.some subdivision; however, with isolated pockets of small, subdivided lots surrounded by larger lots, the region would reflect makeshift development instead of rational, planned development. 5. A need for higher density zoning in the area has not been demonstrated. Since many of the lots in the area are not developed at all, rezoning for subdivision appears inappropriate. Additionally, many other areas in the Borough are opening up. for private.ownership and residential development. 6. The wishes of the land owners in the area should be considered. The comprehensive plan is now almost 20 years old. Conditions have changed since the time that it called for medium- density__ zoning in the area. At this point the wishes of the residents would appear more relevant to proper use of the land than a plan that was considered in need of revision in 1978. The general feeling of the residents in the area is, as expressed in. Mr. Zahn's letter, that we bought property in the area because.of its character and its character is a direct result of its low density development. The inclusion of the four lots in question with the lots south of Island Lake Creek would be arbitrary and inappropriate. Island Lake -Creek provides a natural boundary between two areas distinctly different in topography and land use. Haerer, Jr. Assessor/Chief Appraiserk) SUBJECT: Assessment Rates / R-1 vs R-2 In response to your memo dated September 8, 1983, request- ing an answer to the Planning and Zoning Commissions' question regarding assessment ratio differences between R-1 and R-2 zoned property, I submit to you the following: 1. Typically market trends depict a value difference when legal utility of property may become income producing such as R-2 (two family and or limited office). 2. The value determination for property assess- ment purposes as would be not unlike that for fee simple, would be derived from the market place. If market values depict a difference, the assessment should and would do the same. 3. Historically, these value differences are usually not great enough to show up in the assessment of property for ad valorem tax purposes. In summary, one can say that there may be an assessment difference but if there is, it most likely would not be very significant. I hope this alleviates any concerns in your decision making process. PLANNING AND ZONING COMMISSION Work Session - August 31, 1983 VERBATIM PUBLIC OPINION AND TESTIMONY - Regular Meeting, August 17, 1983 ISLAND LAKE AREA REZONING MRS. LORNA ARNDT: (It was established for Mrs. Arndt that the rezoning of Island Lake would be from RR-Rural Residential to either R1-Single Family Residential or R2-Two Family Residential.) I would like to see it left so that people can build duplexes out there. Property is not cheap and sewer and water is not cheap. We pay higher water than what they do in the city. Right now, we are allowed only one family per lot, and 1 don't care what size it is, we are paying the same price as people in the city living 25 people in a house. They are paying less for water per month. I think we should just leave it and not change it. Leave it so that they can put duplexes in, if their lot is 7,200 square feet or more. They are not going to change the lot size. Most of the lots are smaller, probably 7,200 square feet. I think it should be left the way it is now so that they could put a duplex on instead of trying to knock 'em down to a single family. We've always been--we used to be RU-Rural Unclassified) and then they changed us to RR-Rural Residential. Now, we are going on the third trial change. Hill: So, you would suggest that you would like some areas as being R2 and other areas to be R1? Or, the whole thing R2? Arndt: Well, instead of changing us, they could build duplexes or build single family homes in the 7,200 square foot agreement. Walton: No, that's a mistake. It is one. That is the comprehensive plan. It says that the area is planned for medium density. What we are going to be doing is changing it from RR to either R1 or R2. Arndt: Well, I think I would rather see it changed to R2. Hill: All of it, some of it..? Arndt: All of it that you are talking about in question. That takes in everything in the yellow, is that correct? (Arndt was answered "yes." Hill: Are you concerned about the roads at all? That was one thing we talked about. The present roads might not be able to stand up to twice as much traffic. Arndt: Those roads are good. We put them in ourselves, and they have held out good. PUBLIC OPINION TESTIMONY Page 2 Hill: Are they wide enough? Arndt: Yes, they are. They are 40' wide. Except this one right up here (pointing to map). We couldn't afford to put that big of a road in. What we did was install a road on our lot because that's a big drop-off. Hill: If you change it to a higher density, then roads must be maintained for that density. Arndt: That is why we should be R2, because we have good roads. We put them in ourselves. The Borough didn't put them in. We put them in. END OF MRS. ARNDT PUBLIC TESTIMONY MRS. SZABO: I speak for the people who are up there on that little bitty road. I wish you would handle the area as discrete units, or at least as different units. I wish you would not consider the entire area to be eventually serviced by the sewer district as the same because it is topographically different. It is different in how it is developed to date. I agree with Mrs. Arndt that the area she is referring to, where the roads are somewhat better than they are once you go into the woods, is an area that would be properly zoned for greater density. It is already developed more densely than the rest of the lake. It is a flat area. It is sensible to have smaller lots. We are not quite touching what you are discussing here. We are Lot 4; you end at Lot 2 on Survey 3464. Once you are back right about in here (pointing to map) you are on a ridge and a hill. It is really not sensible to have a very small lot there because it is just not topographically suited to it. I would hope that you would still keep the Ri for those areas past the flat part that is heavily developed for Rl. END OF MRS. SZABO PUBLIC TESTIMONY MS. NILA TRESTON: I am speaking from Shahafka Acres, and I would like to see us zoned R2. Hill: Are you speaking for yourself, or for the whole community, the whole Shahafka Acres? Treston: For myself. And, I am in agreement with Ms. Szabo that if the whole area, you know, that it might be best to divvy it up as to what people feel best for their specific area as to R1 or R2. I would like to see where 1 live, Shahafka Acres, zoned R2. PUBLIC OPINION TESTIMONY Page 3 Hill: Question. When you go into Shahafka Acres to the left where the residential lots, the larger lots, there is a trailer or mobile home on the right. We had discussed maybe that area over there being maybe R2 and maybe the other area of Shahafka Acres being Rl. Does anyone have any recall about that? It is something we had considered before. Crowe: On the right hand side as you are going down? Hill: When you go to the very end and it "T"s off, you make a right. Their mobile home is right on the right and there is a couple more in there. It is something we had kicked around as being R2. Your little area on the right, we had considered about it as a potential R2. And the area on the left, Ian Fulp's/Gallanger's, that whole left at one side RI, and the other side, the smaller area would be R2. Treston: In our case, we were thinking of building a house on our other half. We have a half acre on the other half to help pay for expenses. We'd like to put a small studio apartment in there. That would need to be zoned to R2 in order for us to do that. So, personally speaking.... Hill: Have you talked to any of your neighbors? Treston: I did, yes, to a couple of them. They didn't understand the notice that was sent out. I didn't either, and I called the Borough and got a better explanation. I know that there is no one else here from Shahafka Acres. Hill: On your part, or the other part down there? Treston: The whole area. END MS. NILA TRESTON PUBLIC TESTIMONY MR. SCOTT ARNDT: Basically, I will kind of repeat what I mentioned in the work session last week. In my opinion, I am speaking as a resident and also a land owner on a Parcel P in Lot 1, which is proposed as R2. That is what I would like to have it zoned, R2. To me, the RI is obsolete. You have RI property that is zoned throughout the city limits, yet within it sporadically, and under so-called "Grandfather Clause", we have R2 and R3 uses. I have also seen within the R2 areas (most recently within the last five to six years) residences constructed where someone has gone back in and created a small efficiency apartment. The house is sold and the new owners decide they would like that additional room and chose not to rent it out. They open it back up to the main living area. Then, I have seen where it is sold and once again the new buyer, in their optimum use of that piece of property, found it best lent itself to R2. PUBLIC OPINION TESTIMONY Page 4 Arndt: Housing and land is very expensive. In order to make it available to the majority of the people, many of them need the option of the second income to help make that payment. In my opinion, the R2 leaves that option. It doesn't say they are all going to be duplexes. But, it allows the property owner that option at a future date. In my opinion, the entire Shahafka Acres lends itself to that. You are saying "part of it as you go in there". In my opinion, the entire Shahafka Acres lends itself to it, as does part of the Holland Acres Subdivision (part of it is owned by the Kodiak Bible Chapel). You have some lots on the upper end here (pointing at map) that will be served by the sewer and water and will also in the future be served by Lilly Drive Road that is being constructed now. It should be in within the next year. Those areas, once again, lend themselves to the R2. We think along the lines of 7,200 square feet. 7,200 square feet is a minimum requirement; it is not a maximum. You find when people take into consideration the terrain in that area, many of these lots are going to end up being 10,000 square feet. Some will be larger. So, when we look at things, we look at the minimum. You are using 7,200 square feet divided into useable square footage and that isn't going to happen. Dan brought up the point on the lots along Dark Lake. He felt it best that that remain either R1 or something else along that range because of the access problems. That was a very good point. I tend to agree with that. You are going to eventually see sewer and water along Lilly Drive Baleka, Neva, and Molnitsa. That is going to open up that area. I am also looking at that area, and I tend to feel R2 is along the lines that it best lends itself to. We are going to have, hopefully, Eider Street constructed as part of the Lilly Way first phase. And, at some future date, Baleka will be continued through. Right now, it is just as a trail or a driveway, you might call it. But, speaking specifically to the areas that are up for subdivision, I would like to see the Shahafka Acres and the surrounding area as R2. Possibly you may be looking at the Island Lake Subdivision as R1, but once again, I feel R2 lends itself there, also. Briggs: What is the difference in tax assessments on R1 and R2? Arndt: There is no difference. Hill: When you say that you would like to see all of Shahafka Acres, or I should say any R2 where people are already living in single family dwellings and they would like to continue having an area of single family dwellings. Arndt: They have that option, Tim. PUBLIC OPINION TESTIMONY Page 5 Hill: They have an option, but what if this person would like to live in a single family dwelling area without living in an area where there are duplexes involved? In options, say, your next door neighbor can have.... let's turn it all into R2 and let your next door neighbor have potential R2. And this lady down here can have Ri. Maybe they want to live in an R1 area and not have the R2 overlay. If a person sells a house and another buys it, that person can say "Hey, let's throw an efficiency in here." Arndt: That is a possibility, Tim. But, I haven't heard of anything to that effect. Hill: Neither have I, but just you know. Where I want to live, I want to live in an R1 area and not have duplexes around me. Arndt: There are two sides to every story, Tim. If you can afford that, great. More power to you. But, for the majority, it is very difficult. That's where I am coming from. Any other questions? (None). END MR. Hill: Does the Commission deem it necessary to take a vote on it, or have one more work session on it? Crowe: I would like to have one more work session on it, and if we can, place it on our September agenda so we can take action at that time with an additional public hearing so that people have the opportunity to see what, if any, changes we have made and then have the option of commenting on the issue. Mrs. Crowe moved to table consideration of the Comprehensive Plan Change and rezoning of Island Lake Area and place it on the agenda for September with an additional public hearing with the intent of taking action at that time. Consideration of a comprehensive plan change and rezoning of the Island Lake Area. Fifty -three (53) Public Hearing Notices Mailed on August 9, 1983. HISTORY This item was initiated by the Planning Commission at a July 1983 work session. The Commission's intention was "to plan ahead" in view of the new public water and sewer facilities presently being installed. AREA The only lots being considered for rezoning at this time are those directly adjacent to the new water and sewer lines. The area involved generally runs from the front side of Dark Lake to the front side of Island Lake, and in- cludes portions of United States Surveys 3463, 3466, 3465, 3219 (Island Lake Subdivision), 3464, 3218, Miller Point Alaska First Addition, Shahafka Acres Subdivision, and Holland Acres Subdivision. Eighty -eight lots are involved, which ranged in size from 1,800 square feet to more than 16 acres. Page 2 Several pieces of the proposed rezoning "pie" can be immediately discarded as inappropriate. Those pieces are the PL zoned portion of U.S.S. 3465, which is owned by the Borough, and the Business zoned parcels. The Business zoned parcels are deemed inappropriate for a zoning change because apartments are a permitted use in that land use district. With those deletions, 67 lots remain containing 36.4 acres. COMPREHENSIVE PLAN The 1968 Comprehensive Plan suggests "medium density residential" as the preferred land use for the area under consideration. Medium density residential is described as "Single Family Residential and Duplexes on Lots over 7,200 square feet in area." DISCUSSION With new public utilities installed, the "Island Lake Area" can handle a higher density of population than that which is present. Generally, all of the RR1 zoned properties are suitable for rezoning to R1-Single Family Residential. Three exceptions to the generality stated are: Lot 1, Block 2, Miller Point (1.04 acres); Parcel P, U.S.S. 3218 (2.05 acres); and a two acre portion of unsubdivided U.S.S. 3218. The total area involved with these properties is 5.1 acres. If rezoned. to R2, approximately 30 duplexes (60 dwelling units) could result. If rezoned to R3, approximately 180 apartment units could be constructed. If rezoned to R1, approximately 30 single family homes are possible. RECOMMENDATION Staff recommends rezoning of the RR1 lots in the "Island Lake Area" to R1-Single Family Residential. Consideration of the following parcels for R2 zoning is requested: 1. Lot 1, Block 2, Miller Point, AK, First Addition; 2. Parcel P, U.S.S. 3218; and 3. An unsubdivided two-acre portion of U.S.S. 3218 bounded on two sides by Cove Road and Island Lake Road.
