1. RIGHTS GRANTED. This homestead entry permit entitles the permit holder to
enter upon the homestead described above and occupy, survey, and improve it, in accordance
with the conditions of this permit, in order to qualify for patent under AS 38.09.
2. ASSIGNMENT OR OTHER TRANSFER. This homestead entry permit may not be
assigned, conveyed, or in any other manner transferred except upon approval of the
Department of Natural Resources under the circumstances set forth in AS 38.09.030(c) and 11
MC 67.153. A request to transfer this homestead entry permit must be made in writing to the
regional office noted in section 20 of the permit and must be accompanied by appropriate
documentation that the statutory conditions for transfer have been met. An assignment,
conveyance, or other transfer of this homestead entry permit (except as allowed above) is
automatically void and constitutes a substantial breach of the conditions of this permit.
3. LAWFUL USE OF HOMESTEAD. The permit holder shall use and occupy the
homestead in compliance with all applicable laws, regulations, ordinances, and orders,
including those of a building or zoning authority and those relating to pollution and sanitation
control. The permit holder may not permit any unlawful occupation, business, or trade to be
conducted on the homestead.
4. PROPER LOCATION. The permit holder is responsible for proper location of the
homestead and all homestead improvements. If any part of the homestead (whether improved
or unimproved) is on land that was not open to homestead entry at the time of staking, the
permit holder is not authorized to use or to be granted the part improperly entered or
improved.
5. MAINTENANCE. The permit holder shall maintain the homestead in a reasonably
neat and clean condition and shall take all prudent precautions to: (1) prevent or suppress
pollution of the land, ground or surface water, or air; (2) prevent or suppress grass, brush, or
forest fires; and (3) prevent erosion or destruction of the land. The permit holder may not
manage, use, or permit the use of the homestead in any manner that results in destruction or
deterioration of the homestead or adjacent property, including by neglect, abuse, destructive,
use, or mismanagement.
6. AUTHORIZED USES OF HOMESTEAD. (a) This permit authorizes the permit
holder and members of the permit holder's household to utilize the homestead for residential
and agricultural purposes and for incidental home business uses that employ only members
of the permit holder's household (such as child care, home crafts, or sale of items produced
on the homestead); to build a permanent single - family dwelling and incidental improvements
such as roads, fences, garage, barn, woodshed, and other outbuildings; and to install and use
temporary quarters during construction of the permanent dwelling. The permit holder may also
use gravel on the homestead as needed for building homestead improvements and may clear
and use timber on the homestead as needed for residential or agricultural uses.
(b) Any other use of the homestead requires the written authorization of the Department
of Natural Resources.

7. ENTRY ON ADJACENT LAND. The permit holder may not enter upon adjacent
state land for the purposes of obtaining material including, but not limited to, timber, coal,
gravel, or peat, nor may the permit holder use adjacent state land for the disposal of solid or
liquid waste or for the construction of any improvements, roads, driveways, or landing strips,
without the written authorization of the Department of Natural Resources.
8. BRUSHING BOUNDARIES; AFFIDAVIT. (a) This section does not apply if the
homestead is described by aliquot parts or as a lot of record.
(b) If the homestead is described in this permit by metes and bounds, no later than
90 days after issuance of the permit, the permit holder shall brush the homestead's boundaries
(or otherwise mark its boundaries, if allowed by the Division of Land and Water Management)
as required by 11 MC 67.145. Within 105 days after issuance of the permit, the permit holder
shall submit to the division a signed and notarized affidavit stating that the permit holder has
complied with the brushing requirement.
9. HABITABLE DWELLING. Within three years after issuance of the homestead entry
permit, the permit holder shall submit proof of completion of a habitable, permanent dwelling
on the homestead as required by 11 MC 67.148. However, under the circumstances set out
in AS 38.09.040(a)(3), the permit holder may file a request within the three -year period for an
extension of time within which to complete the dwelling. If the permit holder fails to comply
with this section within the time required or within an extension of time granted by the
commissioner, the homestead entry permit automatically expires.
10. SURVEY. (a) This section does not apply if the permit holder paid a survey
deposit to the Department of Natural Resources before the homestead entry permit was issued.
(b) Within five years after issuance of the homestead entry permit, the permit holder
shall submit a plat of survey meeting the requirements of 11 MC 67.146. If the permit holder
fails to comply with this requirement, the homestead entry permit automatically expires.
11. ELIGIBILITY FOR PURCHASE OR PATENT. (a) Within two years after issuance
of the homestead entry permit, the permit holder may apply to purchase the homestead under
AS 38.09.090(a) if he or she has fulfilled all requirements of the permit (specifically including
early compliance with section 10) except for section 9.
(b) Within five years after issuance of the homestead entry permit, the permit holder
may apply to purchase the homestead under AS 38.09.090(b) if he or she has fulfilled all
requirements of the permit.
(c) Within five years after issuance of the homestead entry permit, the permit holder
may request patent to the homestead under AS 38.09.050 if he or she has fulfilled all
requirements of the permit and in addition has resided and lived on the homestead for at least
25 months. The request for patent must be accompanied by the information required by 11
MC 67.149.

(d) If the permit holder fails to complete the requirements to purchase the homestead
under AS 38.09.090 or to obtain patent under AS 38.09.050 within five years after issuance of.
the homestead entry permit, the permit automatically expires.
12. - REVOCATION FOR BREACH. This homestead entry permit may be revoked by
the commissioner of the Department of Natural Resources if the commissioner determines that
the permit holder has substantially breached a condition of this permit or a requirement of AS
38.09 or 11 AAC 67.138 - -11 MC 67.155. Such reasons for revocation include, but are not
limited to, falsification of information on or in support of the homestead entry permit application
or of any information filed under the homestead entry permit.
13. PROCEDURES UPON REVOCATION OR EXPIRATION. If the homestead entry
permit is revoked for breach or automatically expires, a written notice will be sent to the permit
holder. The permit holder may appeal within 30 days in writing to: the Director, Division of
Land and Water Management, P.O. Box 107005, Anchorage, Alaska 99510 -7005. If no appeal
is filed within 30 days, the decision is final. The permit holder has 60 days after the date the
decision is final to remove his or her improvements from the homestead in compliance with AS
38.05.090. Improvements and personal property remaining on the homestead after that time
will be managed under AS 38.05.090.
14. TAXES AND ASSESSMENTS. The permit holder shall pay all taxes and
assessments accruing against the homestead subsequent to the issuance of the homestead
entry permit.
15. GENERAL RESERVATIONS. (a) This homestead entry permit is issued subject
to all valid existing rights, including easements, rights -of -way, reservations, or other interests
in land, in existence on the date the permit was issued.
(b) If the homestead borders or includes one or more section lines, the commissioner
hereby expressly reserves an easement 100 feet wide and centered on the section line or lines.
(c) The commissioner also reserves a public access easement extending 50 feet upland
from the mean high tide line of coastal waters and 50 feet upland from the ordinary high water
mark of all streams, lakes, and other navigable and public waters adjacent to or within the
homestead.
(d) The state reserves, for itself or to grant to third parties, all minerals that may be in
or on the homestead, and the right to enter onto and use the homestead in any way
reasonably necessary or convenient to explore for, develop, and remove those minerals, as set
out in AS 38.05.125; however, the reserved mineral rights may not be exercised until provision
is made under AS 38.05.130 to pay for all damages that the homestead entry permit holder
may sustain due to the exercise of those rights.
(e) If the homestead is within a municipality, in addition to state requirements it is
subject to applicable municipal platting requirements, including easements and other
dedications.

16. ADDITIONAL RESERVATIONS BEFORE PLAT OF SURVEY APPROVED. Before
the plat of survey is approved, and after consultation with the permit holder, the commissioner
may reserve for the use of the State of Alaska, and grant to third parties, easements or rights -
of -way of unlimited size across the homestead if it is determined to be in the best interests of
the state to do so.
17. SPECIFIC RESERVATIONS. The commissioner reserves the following specific
interests that are in addition to and do not diminish any general reservation to the state that
may be stated elsewhere in this permit: Subject to:

18. SURVEY DEPOSIT. (a) This section does not apply if the permit holder is
required to submit a plat of survey.
(b) Upon completion of the requirements for purchase or patent of the homestead, the
permit holder must remit the balance due of the total survey costs, as determined by the
commissioner. The total survey costs for this homestead are $ N/A
