above. Photographic documentation and field. olservat�on,has confirmed that a considerable
amount o rock has been removed from the site°/ The Community unity Development Department has
no record of anyvpermitted "on -site develop ent plan Which would accountfffor this quantity of
material. A. quarry for the purpose-Of-resource extractionsis =not a permitted. o°r'a onditional use
in the Retail Business Zoning District. Additional concerns have been raised regarding the
removal of material from the Borough ROW as part of the on -going quarrying operation.
This type of activity is also subject to two other separate provisions of the Kodiak Island
Borough Code. Resource extraction activities conducted within the boundaries of the Kodiak
Island Borough are subject to severance tax per Kodiak Island Borough Code Chapter 3.26 -
Severance Tax (included with this correspondence as an enclosure). And, any construction work
resulting in a "cut" or "fill" exceeding five (5) feet is subject to Kodiak Island Borough Code 15
— Buildings and Construction.
