Additional concerns have been raised regarding the removal of material from the Borough ROW as part of the on -going quarrying operation. This type of activity is also subject to two other separate provisions of the Kodiak Island Borough Code. Resource extraction activities conducted within the boundaries of the Kodiak Island Borough are subject to severance tax per Kodiak Island Borough Code Chapter 3.26 - Severance Tax (included with this correspondence as an enclosure). And, any construction work resulting in a "cut" or "fill" exceeding five (5) feet is subject to Kodiak Island Borough Code 15 — Buildings and Construction.
