USS 2843/MISSION - ExceptionKodiak islandBorough Ms. Jeannie Volker, Executive Director Baptist Mission 1944 Rezanof Drive East Kodiak, Alaska 99615 710 MILL BAY ROAD KODIAK, ALASKA 996156340 PHONE (907) 486 -5736 August 12, 1988 RE: Baptist Mission Fire Hydrant Requirements Dear Jeannie, On Tuesday, August 9, 1988 you mentioned to the Kodiak island Borough Construction Inspector, Dan Millard, lhat you had no official document from the Borough explaining the requirements and location of fire hydrant installations as required by Fire District No. 1 Fire. Chief Earl Smith. I hope this will explain the Fire Chief's directive.. In_.1984 the Borough adopted the Uniform Fire Code, 1982-Edition. The Code, gives the Fire Chief the authority to require on site fire suppression and alarm systems where .needed. A copy of the specific. section is attached. The Mission currently has only two buildings that have been constructed 'since the adoption of the'Fire Code which are, therefore, subject to the code requirements as determined by the Fire Chief. When the Thrift Shop burned, the Mission asked for an exception to the Borough Code to allow for the r'econstr'uction'of the Thrift Shop and to bring an existing nonconforming land use into conformance with the Borough Code which would allow for the Mission's .expansion. The Planning and Zoning Commission granted your request on May 20; 1987. 0ne of the stipulations of granting this request'was: - "...all future construction will be required to comply with applicable Zoning, Building and Fire - Codes." CNotification letter dated May 21', 1987 from Robert H. Pederson, Associate Planner, Community Development.) At. the time the Thrift Shop building permit was issued, the Fire Chief was not included in the Borough's permit review process. Since .that - time, the Fire Chief has. been included in the review. process. The Fire .Chief's concerns were not included in the building permit issued for your new Storage and Maintenance Shop. However, the Fire Code does' allow the Fire Chief to identity deficiencies at any time for Page 2 Baptist Mission Fire Hydrant Requirements August 12, 1988 qualifying structures and not just during the permit review period. It may be noted that the Building Inspector's Office reviews the building plans for Fire Code requirements but does not review the outside fire suppression support system requirements. Based on the remoteness of the Mission from a dependable water source for fire suppression and the Fire Department's experience in extinguishing the Thrift Shop fire, there is a very real concern for the . safety of the staff and young people at the Mission. Because of this concern, Chief Smith has required the installation of a water system to provide fire protection for the Thrift Shop and Maintenance Shop specifically, but, obviously the entire Mission complex will then have adequate fire fighting capability. The following alternatives will satisfy Chief Smith's requirements. Alternative I: Install one fire hydrant within 150 feet of the new shop building and one within 150 feet of the new Thrift Shop. - Alternative 11: Install a fire hydrant halfway between the Thrift Shop and Maintenance Shop. Alternative I would provide the best coverage and meets the Code's 150 feet protection radius requirement for the two new buildings. This is also the most expensive alternative since the water main would have to be extended all the way to the Thrift Shop site. Alternative 11 would be less expensive but functional. This would locate the fire hydrant in one of the two islands located'in front of the Mission's Administration Office. This does not meet the Code's 150 feet protection radius of the fire hydrant but, due to its strategic location and accessibility, Chief Smith would waive this requirement. Both 'alternatives would provide protection for all the existing buildings except the two single - family residences on the East side of the Mission grounds. Another alternative has been suggested by Paul Krauser of the Baptist ' Mission. This is to install the fire hydrant only on the new Maintenance Shop building side of McWhinnie Cottage. Even though this, would be the least expensive option, it would provide only marginal protection for the West half of the Mission complex and you would not be able to obtain permits for renovation of existing buildings or new buildings on that half of your complex. Should McWhinnie Cottage be fully involved in fire, the fire truck probably could not get to the fire hydrant. If the Thrift Shop were involved, valuable time would be lost in going to this hydrant and back to the shop with'the truck. Page 3 Baptist Mission Fire Hydranf Requirements August 12, 19138 gu , | hope this information clarifies the concerns about the fire hydrant. 1 think.ynu can appreciate the fact that the main concern is for the safety of the staff and young people at the Mission. As it stands at this time, | think all of you are at considerable risk if you havp a fire. On alternative \, if funding is a problem; you could put in the one hydrant by the new shop now and wait until next year to put in the second one if that helps` | would request that the details of the fire hydrant locations be worked out with Construction Inspector Dan Mi(\ard.mnd Assistant Fire Chief Andy Nault while-Chief Smith is out of town. Please give me a call if you have any questions. 3incoro|y. KODIAK ISLAND BOROUGH Jer o M. Request for an exception from Section 17.17.020 (Permitted Uses) of the Borough Code to bring an existing nonconforming land use (commonly known as the Kodiak Baptist Mission) into conformance with the Borough Code and to allow for its future expansion. The existing use is a residential child care facility and ancillary uses consist of a thrift store, offices, staff housing, recreation areas and agricultural activities. The exception will allow the future expansion of these facilities and activities in general and the reconstruction of the thrift store specifically. Lot 4, Block 1, Hospital Subdivision and Portions of U.S. Surveys 1822, 2843 and 3066AB; 1944 Rezanof Drive East. (Womens American Baptist Mission) Dear Ms. Volker: The Kodiak Island Borough Planning and Zoning Commission at their meeting on May 20, 1987, granted your request for the exception cited above and adopted the following findings of fact in support of their decision: 1. That the use as proposed in the application, or under appropriate conditions or restrictions, will not (A) endanger the public's health, safety or general welfare, (B) be inconsistent with the general purposes and intent of this title and (C) adversely impact other properties or uses in the neighborhood. A. It appears that the proposed use will not endanger the public's health, safety or general welfare. The Mission facilities are a long established land use at this location and departmental files contain no indication that the facility has been detrimental to the public's health, safety or welfare. In fact, the Mission can be considered to enhance the overall public health and welfare by providing an alternative housing and educational program for young people in the community. Lastly, all future construction will be required to comply with applicable zoning, building and fire codes. B. The proposed use will be consistent with the general purposes and intent of Title 17 and with the specific description and intent of Chapter 17.17, the Rural Residential Zoning District. "The rural residential district is established as a land use district for large lot, low ,density, residential and general agricultural purposes." The use of a Kodiak Island Borough Jeannie Volker, Executive Director Womens American Baptist Mission May 21, 1987 Page Two 25 acre site for a residential child care facility that includes agricultural activities is generally consistent with this description and intent. C. The proposed use (existing and considering future expansion) does not appear to adversely impact other properties or uses in the area. The use is located on a large parcel (more than 25 acres) that is bounded on two sides by two of the busier arterial roads in Kodiak (Rezanof and Mission) and most of the structures are centrally grouped. All structures appear to meet setback requirements and a good deal of the site, is undeveloped. Lastly, the existing facilities have not generated any complaints from the surrounding neighborhood of which staff is aware. THIS APPROVAL DOES NOT ALLOW ANY CONSTRUCTION TO BEGIN. You must first obtain zoning compliance and /or a building permit. Please contact this office for further details. An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of appeal with the Borough Clerk within ten days of the date of the Commission's decision. The notice of appeal must state the specific grounds for the appeal. Therefore, the Commission's decision will not be final and effective until ten days following the decision. Failure to utilize this exception within 12 months after its effective date shall cause its cancellation. Please bring this letter with you when you come to our office to obtain zoning compliance for any construction on your lot. If you have any questions about the action of the Commission, please contact me. The use of a 25 acre site for a residential child care facility that includes agricultural activities is generally consistent with this description and intent. All structures appear to meet setback requirements and a good deal of the site is undeveloped. Lastly, the existing facilities have not generated any complaints from the surrounding neighborhood of which staff is aware. COMMISSIONER HEINRICHS returned to the Planning and Zoning Commission. CASE 87 -030 MAY 20, 1987 P&Z ITEM VI -L COMMENTS: Approval of this exception request will bring the existing "Mission" complex into conformance with the Borough Zoning Ordinance and also allow for its future expansion. The Mission is currently a nonconforming land use in the RR1- -Rural Residential One Zoning District because institutional uses such as a residential child care facility are not listed as a permitted or conditionally permitted land use. The overall complex includes four residential cottages, a lodge, one duplex, one mobile home, a barn, a multi - purpose building, accessory buildings, and a thrift store that was recently destroyed by fire. A site plan of the property is attached. If approved as written, the exception will allow the future expansion of the Mission facilities and structures in general and the reconstruction of the thrift store specifically. Additional future activities contemplated at this time include an alternative school, recreation facilities, and additional office and maintenance facilities. Future structures will have to comply with the provisions of all other sections of the applicable zoning district (e.g., setbacks) regulations. In order to grant an exception, the Commission must find that the use proposed in the application meets all of the following: 1. That the use as proposed in the application, or under appropriate conditions or restrictions, will not (A) endanger the public's health, safety or general welfare, (3) be inconsistent with the general purposes and intent of this title and (C) adversely impact other properties or uses in the neighborhood. "The rural residential district is established as a land use district for large lot, low density, residential and general agricultural purposes." The use of a 25 acre site for a residential child care facility that includes agricultural activities is generally consistent with this description and intent. All structures appear to meet setback requirements and a good deal of the CASE 87 -030 4 MAY 20, 1987 PSI ITEM VI —L site is undeveloped. Lastly, the existing facilities have not generated any complaints from the surrounding neighborhood of which staff is aware. RECOMMENDATION: Staff finds that this request does meet the standards for an exception and recommends that the Commission grant this request. APPROPRIATE MOTION: Should the Commission agree with the staff recommendation, the appropriate motion is: Move to grant a request for an exception from Section 17.17.020 of the Borough Code to bring an existing nonconforming land use (the Kodiak Baptist Mission) into conformance with the Borough Code and to allow for its future expansion on Lot 4, Block 1, Hospital Subdivision; Block 3, U.S. Survey 3066AB; and Portions of U.S. Surveys 1822 and 2843; and to adopt the findings contained in the staff report dated May 7, 1987 as "Findings of Fact" for this case. The exception will allow the future expansion of the residential child care facility and ancillary activities and structures in general and reconstruction of the thrift store specifically.
