Dear Mr. and Mrs. Zimmer: It has recently come to my attention that you have converted the upper floors of two repair shops on your property at the above - mentioned location into apartments without having valid zoning compliance and building permits. According to our file, you originally obtained zoning compliance and building permits for two repair shops with apartments on the upper floors in early 1982. Kodiak Island Borough Assessing Department records show that you constructed the building shells soon afterward, but did not finish the interior, including the apartments, until late 1996 or early 1997. Since the original permits expired almost 14 years ago, you are required to obtain new zoning compliance and building pennits for the interior finish work, including the apartment conversion. According to Kodiak Island Borough Code section 17.01060, "Zoning compliance is required for site grading (excavation and fill), erection, construction, establishment, moving, alteration, enlargement, repair, or conversion of any building or structure in any district established in this title..." In addition, KIBC section 15.04.030A states that, "It shall be unlawful for any person, firm, association, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure regulated by this code, except as specified in subsection B of this section, or cause same to be done without first obtaining a separate permit for each building or structure from the building official." Therefore, failure to obtain the required zoning compliance and building permits within 30 days (by January 15, 1998) will require that your file be forwarded to the Borough Attorney for further enforcement action. If you disagree with the determination, or wish to propose some other remedy or compliance schedule, it is essential that you appeal this letter within ten (10) days. An appeal begins by filing with this office a written notice of appeal, specifically stating the reason for the appeal, and the relief sought. The fee to file an appeal is $150. At present, there are 9 existing structures on this lot ranging in use from commercial storage to residential. Two additional structures are under construction (see attached photograph). The use for these two buildings are for a commercial shop and commercial net repair and storage. The existing zoning ordinances do not address any criteria to limit the number of business ventures allowed on a single business zoned lot, nor does it address minimum lot sizes for lots in a business district. With this in mind, I can not legally refuse to issue zoning compliance permits for any building permit application which deals with commercial buildings and uses on business zoned lots. I strongly recommend that an ordinance regulating the size of business lots and number of structures allowed per lot be adopted as soon as possible, so that this situation does not continue to crop up and haunt us. Also for your information, the second structure in the photo- graph (in foreground) was constructed prior to the issuance of a building permit. Bryce Gordon has Indicated to me that a double permit fee will be levied as penalty for this action. This action by Bryce is allowed under the provisions of the 1979 Uniform Building Code.
