Crowe, P.E., Borough Engineer tke'd SUBJECT: Case No. S-88-036, Subdivision of Lot 1B, HOLLAND ACRES SUBDIVISION, FIRST ADDITION; to Lots 1B-1 and 1B-2 (William Berkenbile) The applicant desires to subdivide a 20,108-square-foot lot, zoned B-Business, to create two lots of 9,764 and 10,342 square feet. A duplex residence exists on proposed Lot 1B-1, and a business is located on proposed Lot 1B-2. Since an existing water service serves both the business and the duplex, the applicant will have to install a new water service to serve the duplex. No sewer service exists for the business, but the applicant has indicated that he is in the process of having the business structure connected to the public sewer. Staff recommends that you grant preliminary approval of this subdivision, subject to the following conditions: 1. The applicant must terminate the existing water service between the business and the duplex, and install a new water service for Lot 1B-1 (duplex) before submission of the final plat. 2. Departmental records indicate that the dwelling on proposed Lot 1B-1 is "grandfathered" under the existing Borough Code. The subdivision of Lot 1B will not increase the nonconformity of the existing structure. It appears that the duplex is currently accessed from both Mill Bay Road and Island Lake Road. The developed parking accessed from Island Lake road is sufficient for a duplex since the existing parking behind the dwelling will become part of the adjacent lot if this action is approved. The shed along the rear lot line of proposed Lot 18-2 would encroach the five (5) foot setback required for accessory buildings. RECOMMENDATION: The Community Development Department recommends approval of this subdivision subject to the following conditions of approval: CONDITIONS OF APPROVAL 1. The shed located along the rear lot line must be relocated to conform with the five (5) foot rear and side yard setback requirements for accessory buildings. 2.
