To determine parking requirements, the Homeless Shelter is classified by staff as a use similar to a "hotel" since it meets that definitiion (KIBC 17.06.330). The parking requirement for a hotel is one (1) parking space for every three (3) guest rooms. By definition, a guest room is 100 square feet, or fraction thereof, of floor area used for sleeping purposes (17.06,310). Based on the total square footage of ME. designated and potential dorm space (2976 square feet), the shelter consists of thirty (30) guest rooms and therefore is required to provide ten (10) parking spaces in addition to one (1) Type "B" loading berth. The parking spaces and the loading berth are illustrated on the attached site plan of the shelter footprint on Lot 2, Block 15, Kodiak Townsite. Section 17.66.080 of the Kodiak Island Borough Code specifies that failure to utilize an approved variance within twelve (12) months after its effective date shall cause its cancellation. Prior to issuing zoning compliance, the overall parking plan for this facility and adjoining City of Kodiak facilities (jail, fire station, police station, library, and teen center) shall be revised to show at least one hundred twenty-eight (128) off-street parking spaces to serve a zoning code requirement of one hundred forty-five (145) spaces as permitted by Case 88-047. 2. All required off-street parking shall be provided prior to issuance of a certificate of occupancy for the shelter as outlined under Condition of Approval number four (4) in Case 88-047. 3. The applicant shall provide drawings of final floor plans for the shelter so that staff may check the consistency of the parking plan requirements. 4. The applicant will be required to obtain approval by the Planning and Zoning Commission regarding the provision and maintenance of appropriate screening. An appeal of this decision may be initiated by any person or party aggrieved by filing a written notice of appeal with the City Clerk within ten days of the date of the Commission's decision. The notice of appeal must state the specific grounds for the appeal. Therefore, the Commission's decision will not be final and effective until ten days following the decision. Failure to utilize thls approval within twenty-four (24) months after its effective date shall cause its cancellation. That the use as proposed in the application, or under appropriate conditions or restrictions, will not (A) endanger the public's health, safety or general welfare, (B) be inconsistent with the general purposes and intent of this title and (C) adversely impact other properties or uses in the neighborhood. A. It appears that the proposed use will enhance rather than endanger the public's health, safety, or general welfare. A shelter for the homeless will provide a direct benefit to the health, safety, and welfare of street people and provide indirect benefits to the community at large by providing a single safe and clean environment for shelter. B. The proposed use will be consistent with the general purposes and intent of Title 17 and with the specific description and intent of Chapter 17.21, the B--Business Zoning District. First of all, the use characteristics of the proposed shelter are similar to a hotel and/or motel, which are permitted business uses. Therefore, the proposed use may be permitted as a similar use pursuant to Section 17.03.090 because, as described in (A) above, the use should not be detrimental to the welfare of the community. Additionally, a number of permitted uses in the B--Business Zoning District are much more intensive activities than the shelter as measured in terms of traffic generation, noise, parking, hours of operation, etc. C. The proposed use should not adversely impact other properties or uses In the neighborhood. A number of public facilities are located nearby and the shelter should have minimal impacts in comparison. Locating the shelter at this location provides the additional benefit of proximity to the police station. The proposed location will consolidate rather than disperse public facilities throughout the community and is within walking distance of downtown. (City of Kodiak) Dear Gordon: The Kodiak Island Borough Planning and Zoning Commission at their meeting on August 17, 1988, granted the request for the variance cited above, subject to the following conditions: 1. The specific location of the homeless shelter will be established through the zoning compliance process. 2. The applicant shall provide drawings of final floor plans for both the jail addition and the homeless shelter so that staff may check the consistency of the parking plan requirements. 3. The applicant shall submit a revised parking plan, prior to the issuance of zoning compliance, showing the placement of 1 the required number of off-street parking places as : 1 I specified by variance. 4. The homeless shelter and the jail addition may each be developed independently, however, in order for the homeless shelter to receive its Certificate of Occupancy it must have developed and available the minimum number of required off-street parking spaces for that facility. The applicant will be required to obtain approval by the Planning and Zoning Commission regarding the provision and maintenance of appropriate screening. The Commission also adopted the following findings of fact in support of their decision: 1. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. There are several exceptional Conditions that apply to this site such as the irregular size and shape of the lots, the location and placement of down guys from utility poles and the existence of a 45 foot utility easement across one side of Lot 2, Block 15. Current borough policy does not encourage construction above or below 6 utility easement. There are not many properties in the Public Lands or Business Zoning Districts with these kinds of constraints. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. Strict application of the Zoning Ordinance would require the provision of 145 off-street parking spaces. This is a practical difficulty due to the shape of the areas available for parking and also due to the placement of utility pole down-guys. In addition, it would be an unnecessary hardship because both the inmates of the jail addition and the residents of the homeless shelter are not likely to require parking. The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety and welfare. 1 Granting of the variance should not result in material damage or prejudice to other properties in the vicinity as long as parking lot development standards are strictly adhered to. The variance, if granted, would be a promotion of the public's health, safety and welfare by increasing the police department's. capability for holding individuals suspected of crimes. These ideals would also be promoted by allowing a shelter for the homeless, which could provide a clean and safe place to sleep and eat for those withcut proper shelter. The proposed activity would also provide a viable alternative to street living for displaced workers with families. 4. The granting of the variance will not be contrary'to the oblectives of the Comprehensive Plan. This area, partially identified for Medium Density Residential Development by the comprehensive plan, has been dedicated to off-street parking in support of the institutional land uses located on the rest of the site by previous land use decisions. The area on which the present jail, police station, fire station and library are placed is designated for Public Use. The granting of the variance will be not be contrary to the objectives of the Comprehensive Plan because the larger area of the site is designated for public use and the comprehensive plan is used as a general guide and does not have to be interpreted specifically. 5. That actions of the applicant did not cause special conditions or financial hardship from which relief is being sought by the variance. In this case, the actions of the applicant have not caused the conditions from which relief is being sought by variance. The existing developments on the site were evaluated differently that the current proposal. Based on a reinterpretaticn of the current Borough Code, the applicant Kodiak Island Borough Gordon Gould, Manager City of Kodiak August 18, 1988 Page Four is trying to maximize a window of opportunity that was created through the reevaluation process. Further, the variance will be decided prior to construction of the proposed facilities. 6. That the granting of the variance will not permit a prohibited land use in the district involved. The placement of a homeless shelter in a B--Business , Zoning District has already received conceptual approval through an exception granted by the Commission per Case 88-020. The placement of a jail addition in the PL--Public Use Lands Zoning District is a permitted conditional use which was approved by the Commission per Case 87-024. THIS APPROVAL DOES NOT ALLOW ANY CONSTRUCTION TO BEGIN. Zoning compliance and/or a building permit must first be obtained. Please contact this office for further details. CONDITIONS OF APPROVAL 1. The specific location of the homeless shelter will be established through the zoning compliance process. 2. The applicant shall provide drawings of final floor plans for both the jail addition and the homeless shelter so that staff may check the consistency of the parking plan requirements. 3. The applicant shall submit a revised parking plan, prior to the issuance of zoning compliance, showing the placement of the required number of off - street parking places as specified by variance. 4. The homeless shelter and the jail addition may each be developed independently, however, in order for the homeless shelter. to receive its Certificate of Occupancy it must have developed and available the minimum number of required off - street parking spaces for that facility. In order for the jail addition to receive its Certificate of Occupancy, the applicant shall have developed the required number of off - street parking spaces for the overall site, as specified by variance. 5. The applicant shall be required to submit a grading and drainage plan for the site, plus an annual maintenance schedule for those areas which will not be developed in accordance with Section 17.57.040 (C) (Parking Area Development Standards) and Section 17.21.050 (C) (Performance Standards) of the Borough Code. 6. The applicant will be required to obtain approval by the Planning and Zoning Commission regarding the provision and maintenance of appropriate screening. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. A. There are several exceptional conditions that apply to this site such as the irregular size and shape of the lots, the location and placement of down guys from utility poles and the existence of a 45 foot utility easement across one side of Lot 2, Block 15. Current borough policy does not encourage construction above or below a utility easement. There are not many properties in the Public Lands or Business Zoning Districts with these kinds of constraints. B. Same as A, above. 2. Strict application of the zoning ordinances would result in Practical difficulties or unnecessary hardships. A. Strict application of the Zoning Ordinance would require the provision of 145 off-street parking spaces. This is a practical difficulty due to the shape of the areas available for parking and also due to the placement of utility pole down-guys. In addition, it would be an unnecessary hardship because both the inmates of the jail addition and the residents of the homeless shelter are not likely to require parking. The parking that is provided will probably only be used by operational personnel, occasional visitors and perhaps for deliveries. B. Strict application of the Zoning Ordinance would require the provision of 139 off-street parking spaces. As there is a maximum potential of 136 spaces available, this would be an unnecessary hardship because it is unlikely that the inmates of the jail addition would need the required 16 spaces for visitations at any one time. Operational staff will most likely continue to use the parking already established for the police station. 3. The granting of the variance will not result in material damages or pre1udice to other properties in the vicinity nor be detrimental to the public's health, safety and welfare. A. Granting of the variance should not result in material damage or prejudice to other properties in the vicinity as long as parking lot development standards are strictly adhered to. The variance, if granted, would be a promotion of the public's health, safety and welfare by increasing the police department's capability for holding individuals suspected of crimes. The new jail will be constructed as an addition onto the rear of the existing city jail/police department/fire station building currently located on Block 10A Erskine Subdivision. The homeless shelter is to be constructed on Lot 2, Block 15, Kodiak Townsite. Both lots were recently replatted as a result of Case S-84-019 which was responsible for the vacation and replat of the Cedar Street right-of-way. This replat was a originally a condition of Case 84-005 which was a variance and exception case to enable the Case 88-047 5 of 11 P&Z: August 17, 1988 :ITEM VI-E construction of the Teen Center. The U.S. Postal Office adjoins this "complex" of municipal facilities. A Conditional Use Permit was recently approved for the jail addition in Case 87-024. Conceptual approval was granted for an exception to allow the construction of a homeless shelter by Case 88-020, which also contained conditions concerning the replat of the Cedar Street right-of-way in conjunction with the establishment of an suitable parking plan by the applicant. A parking variance is required because, after reviewing a combination of tentative site plans and making on site investigations, it has been revealed that the applicant would be unable to provide the necessary off-street parking that is required by Borough Code for such development. A review of the existing parking plan for the overall uses on this site showed that although the required number of spaces cannot be provided by either development alternative proposed, a reevaluation of the code requirements indicates that the parking requirements for the overall site are not as great as previous case files have shown. In the case regarding the Teen Center, it was originally determined that there was a requirement of 180 off-street parking spaces to serve the facility based on the total proposed floor area of the structure. Upon review of the constructed facility, it appears that the parking requirement of a community building should be based on the maximum occupancy of the main assembly area as determined by the Building Official under Title 15 of the Borough Code. The Building Official has since certified that the maximum occupancy of the main assembly area is 429 persons. The Code specification for a community building is one space for each four occupants of the main assembly area. This results in a revised requirement for only 107 spaces as opposed to the original estimate of 180. This recalculation does not directly affect the current proposal as the Teen Center was granted a variance to provide a reduced requirement of only 100 off-street parking spaces, thirty of which were to be provided by sharing with the U.S. Post Office. However, it does indicate a significant (40%) decrease from the original estimated requirement for this facility, and consequently a proportional decrease in the parking needs of the overall uses of this site. In the case of the city library, calculations also included floor area in excess of the main assembly area. After reevaluation, the required number of parking spaces for the library was reduced from 49 to 25 off-street parking spaces. In reviewing the off-street parking requirement for the subject case, staff has utilized discretion in the calculation of required off-street parking by adopting criteria similar to the standards established for hotel uses. Because both jails and shelter facilities for the homeless are not defined in the Code the criteria relating to hotel uses were adapted for use in this report. The analogy of a hotel use to be considered in calculating parking Case 88-047 6 of 11 P&Z: August 17, 1988 ITEM VI -E requirements is consistent with the "Findings of Fact" in Case 88 -020 which recently granted conceptual approval for a homeless shelter on the site indicated in this staff report. The criteria for this proposal was developed from the following Code Sections: Kodiak Island Borough Code Sections 17.06.310 definition of "guest room "; 17.06.330 definition of "hotel "; 17.57.020(2)(i) Off- Street Parking -- Number of Spaces Required; 17.57.060(B) (2) Off - Street Loading; and 17.57.060(C) (2) Off- Street Loading. The application of these code sections has indicated an off - street parking requirement of one parking space for every 300 square feet of sleeping area in the proposed facilities and one space for each dwelling unit. In addition, each individual project has been calculated with the appropriate type "B" off - street loading berth. A breakdown of the off - street parking requirements as recalculated by staff is shown below for each of the alternatives now being proposed. The results indicate the total potential off-street parking available based on a minimum standard of 350 square feet per parking space as stated in the Kodiak Island Borough Code Section 17.57.040(F). Due to the topography and other constraints on the site it is possible that the maximum potential cannot be reached. Therefore, it will be the requirement of the applicant to work out the actual placement of the homeless shelter and the minimum necessary off-street parking facilities as a part of the zoning compliance process. Bids were received from Brechan Enterprises in the amount of $39,775 and from Felton Construction in the amount of $66,100. The Engineer's estimate was $41,930. The City Manager recommended awarding the contract to Brechan Enterprises as the lowest responsible bidder. Councilmember Iani declared a conflict of interest due to his financial interest in Brechan Enterprises. Contribution Request RE: Cooperative Promotion The Kodiak Chamber of Commerce had requested the City join . in a cooperative promotion sponsored by the State of Alaska City Council Meeting 9 July 28, 1988 VI. Department of Commerce and Economic Development. The promo- tion was in the form of a special advertising section in the September /October issue of Plants, Sites and Parks magazine. Thie issue would be sent to over 32,000 top site selectors across the United States and around the world, including a targeted audience in Japan. In addition, several thousand copies would be distributed at various seasonal trade shows. The cost of a one -third page advertisement was $1,598. The Chamber and the Kodiak Island Borough were participating end the Chamber asked the City to share the costs. CITY MANAGER'S REPORT City Manager Gould said the.Planning and - toning Commission's review of the parking variance for the•inew jail facility and the homeless shelter would be on its August 17 agenda. The issue would be studied under two configurations: the 17 parking spaces variance necessary for the proposed jail facility and the homeless shelter on the Cedar Street site; and the jail alone which would be a variance of three park- ing spaces. Neither were significant when considered in the total of 128 parking spaces. Another item on the Commis- sion's August 17 agenda was the conditional use permit needed if the homeless shelter was constructed on the City Council Meeting 10 July 28, 1988 (upper) Mill Bay Road site. There was adequate parking on that site. Mr. Gould announced the Library Story Hour program on Friday, July 29, was on gardening. VII. MAYOR'S COMMENTS Mayor Brodie said the 198th U.S. Coast Guard birthday would be celebrated August 4 and he urged the community to participate in the festivities. The Crimestoppers picnic was scheduled for August 6. He congratulated the Clerk on her Employment Agreement renewal. VIII. COUNCIL COMMENTS Councilmember Cratty cited a July 28 letter to the editor complaining about the enforcement of the animal control laws. He asked the laws be enforced. Councilmember Perrozzi asked that a letter of appreciation be sent for the new overlay on Mill Bay Road. The job had been done by the local DOT crew. Mayor Brodie said the production of "Cry of the Wild Ram" was an important August event and asked the City Manager and the Public Works crew do a quick cleanup before the tourists arrived. Councilmember Perrozzi asked that Rezanof Drive West near the Westmark Hotel be given its annual hosing. The area was full of winter debris and the materials spread during ice and snow. IX.
