This ordinance is not of general application and shall not be codified. Section 2. Section 3. Lots 1A and 3A, Estelle Subdivision are hereby rezoned from R -1 -- Single Family Residential j4 R- 2 - -Two Family Residential. The official zoning map shall be updated to reflect this rezoning. Mr. Stephen was unclear as to what effect the new administration would have. He added that the cost of implementation was underestimated. Assemblymember Gould asked Mr. Stephen for his recommendation on how to proceed. Mr. Stephen recommended keeping options open because there were additional steps to be taken. Jim Fisk telephoned opposing the hospital budget and Contract No. 92 -10. He offered a summary of feelings and thoughts regarding failures of government and involvement of the general public. He was of the opinion that personal involvement worked and that the right of public input must be guaranteed. B. Items Other Than Those Appearing on the Agenda None. (1214 Mission Road) Presented for consideration was Ordinance No. 92 -26 which, if adopted, rezoned a portion of Estelle Subdivision consistent with development trends in the area. Presiding Officer McFarland declared a conflict of interest because he applied for the rezone as the property owner. He passed the gavel to Deputy Presiding Officer Gould. Deputy Presiding Officer Gould ruled a conflict of interest. AUSTERMAN, moved to adopt seconded by FITZJEARL Ordinance No. 92 -26.. Mayor Selby reported that the rezone was recommended by the Planning and Zoning Commission. Student of the Month Mayor Jerome Selby presented the Student of the Month Award to LaFawn Gates, a sophomore at Kodiak High School. CITIZEN COMMENTS A. Agenda Items Not Scheduled For Public Hearing Jeff Stephen gave a synopsis of the sablefish and halibut IFQ proposal. He said the NMFS, NOAA, and Department of Commerce published a proposed regulation in the Federal Register implementing the proposed IFQ plan, and the public comment period closed January 11, 1993. He gave a chronology of events leading to the compilation of options for the conservation management plan. He reported meeting with Governor Hickel on the IFQ issue. He submitted the environmental impact statement draft and discussion on the IFQ issue. T nv Drabek suggested that until a master plan of the community of Kodiak was created, there should be no rezones. Deputy Presiding Officer Gould closed the public hearing and reconvened the regular meeting. Assemblymember Austerman favored the rezone because of the development of other properties in the area. B. Ordinance No. 92 -27 Rezoning Lot 2A -1A -1 Block 5 ORDINANCE Miller Point Alaska Subdivision From R -2- -Two NO. 92 -27 Family Residential le PL-- Public Use Lands. (4050 Parkside Drive) Presented for public hearing was Ordinance No. 92 -27 which, if adopted, rezoned lots consistent with development on the adjoining lot. GOULD, moved to adopt seconded by AUSTERMAN Ordinance No. 92 -27. It was noted that 32 public hearing notices were mailed. There were ten responses - -nine supporting, one opposing. Mayor Selby reported that the Planning and Zoning Commission recommended the rezone. He informed the Regular Assembly Meeting December 17, 1992 Volume %VI Page 21 Assembly that Duane Dvorak, Associate Planner, was available to answer questions. Presiding Officer McFarland opened the public hearing. Mark Maidic considered the rezone good development for the neighborhood. His property bordered the property to be rezoned, and he thought that the proposed fire training burn center would be built with safety in mind. He added there would always be checks and balances. He reported that the Fire Protection Area No. 1 Board provided information to residents in the area. Scott Arndt, Fire Protection Area No. 1 Board chairman, made the site plan available. Assemblymember Fitzjearl discussed with Mr. Arndt the $300,000 from the fund balance that was obtained as pass - through monies from the state to Fire Protection Area No. 1, not the entire Borough. Mr. Arndt added that the volunteer firefighter association committed $125,000 and that estimated completion costs were $500,000. He felt that purchasing the property and constructing the building was the first phase and would be accomplished with $425,000. The second phase would be to pave the complex. Presiding Officer McFarland reminded all that discussion was on the rezone. Mike Rasmussen telephoned and voiced non - objection to the rezone and fire training center because it was good for the community and the property was the logical location. Leroy Cossette, owner of property behind the present fire station, voiced no objection to the rezone. He felt the fire station was a good neighbor. Cathy Cordry telephoned and voiced objection to the rezone in that it was unnecessary that the Borough purchase property and build the facility at this time as other training centers were available in the state. Ernie Mills, former City of Kodiak Councilmember, telephoned. He suggested conditional permitting so that use of the property could not be changed. Presiding Officer McFarland closed the public hearing and reconvened the regular meeting. Ordinance No. ITEM TITLE: An Ordinance rezoning Lots 1A and 3A, Estelle Subdivision from R1-- Single Family Residential, to R2 - -Two Family Residential. SUMMARY STATEMENT: The purpose of this Ordinance is to rezone Lots 1A and 3A, Estelle Subdivision from R1-- Single Family Residential, to R2 - -Two Family Residential. The Planning & Zoning Commission held a public hearing on this request at their November 18, 1992 regular meeting. At that meeting the Commission recommended that the request be forwarded to the Borough Assembly with a recommendation of approval. The following findings were adopted in support of the recommendation: 1. Findings as to the Need and Justification for a chance or Amendment. The rezone of Lots lA and 3A, Estelle Subdivision from R1-- Single - family Residential to R2 -- Two - family Residential is necessary and justified because the R2 -- Two - family Residential zoning district permits development that: A. is consistent with development trends in this area; B. is suitable for the property as a whole, given the physical characteristics and location of the tract; C. will create no nonconforming land uses on the lots identified for rezone; D. is consistent with the existing and anticipated future development of this area. 2. Findings as to the Effect a Change or Amendment would have on the objectives of the Comprehensive Plan. The 1968 Kodiak Island Borough Comprehensive Plan indicates this area for Medium Density Residential. The proposed R2 -- Two - family Residential zoning district is specifically included' in the definition of Medium Density Residential contained in the plan. This zone permits the types and kinds of uses envisioned in the plan for this area. This zoning change is specifically consistent with the objectives of the comprehensive plan. The information considered by the Planning and Zoning Commission related to this rezone request is attached. The minutes of the Planning and Zoning Commission meeting at which this request was reviewed, will be available for second reading. COMMISSIONER HEINRICHS expressed a possible conflict of interest, as he is a volunteer fireman at Bayside Fire Department. The chairperson determined that no conflict existed. Regular Session Closed. Public Hearing Opened: 13111 Murdock appeared before the Commission and stated that he agreed with the need for a fire training facility, and was not opposed to the rezone. but expressed a desire to obtain more information on the possible environmental impact this type of facility would have (I.e. smoke, noise, etc) on the neighborhood. Mary LaFerrier appeared before the Commission and stated that she agreed with Mr. Murdock's environmental concerns, and expressed her concern for the safety of children and local residents, especially on the bike path in the vicinity of the proposed facility. Shirley Berns appeared before the Commission and stated that she felt the Borough was paying too much money to obtain this lot. Comprehensive Plan: The 1968 Comprehensive Plan depicts this area as Medium Density Residential. 6. Applicable Regulations: The following sections of Title 17 (Zoning) of the Borough Code and the Kodiak Island Borough Coastal Management Program are applicable to this request: 17.72.030 Manner of initiation. Changes in this title may be initiated in the following manner: A. The borough assembly upon its own motion; B. The planning commission upon its own motion; C. By petition of one or more owners of property within an area proposed to be rezoned. A petition shall be in the form of an application for a change in the boundary of a district, shall be filed in the community development office, be accompanied by the required fee and such data and information as may be necessary to assure the fullest practicable presentation of facts and shall set forth reasons and justification for proposing such change. 17.72.055 Submission to assembly. A. Within thirty days after the planning commission has acted favorably upon a proposed zoning change in accordance with the above provisions, a report with recommendations shall be submitted to the assembly together with the proposed ordinance. Such recommendations of the planning commission shall be advisory only and shall not be binding upon the assembly. When an ordinance has been forwarded to the borough assembly, the assembly shall act in accordance with this chapter and notice shall be issued as provided in Section 17.72.070, by the borough clerk. If the planning commission recommends denial of any proposed amendment, its action shall be final unless the initiating party, within ten days, files a written statement with the clerk requesting that the commission's action be taken up by the borough assembly. COASTAL MANAGEMENT APPLICABLE POLICIES Residential Development 1. Location In areas with poorly draining soils, development where feasible shall be connected to a sewer line. Where this is not feasible, onsite facilities shall be designed so as not to cause conditions that will pollute rivers, lakes, and other water bodies, including the ground water supply. Consistent: Yes. The lots are served by public sewer. 2. Open Space Green areas and open space shall be retained to the maximum extent feasible and prudent when land is subdivided. Consistent: Not applicable. This action does not involve land subdivision. 3. Access New subdivisions or other residential developments on the shoreline shall provide usable public access to and along the shoreline, extending the length of the development, to the extent feasible and prudent. Consistent: Not applicable. This lot is not located along the shoreline. 4. Hazardous Lands Case 92-035 Development shall not occur in hazardous areas such as avalanche runout zones, active floodplains, and high water Page 3 of 7 P & Z: November 13. 1992 Public Hearing Item VI -C channels to the extent feasible and prudent. Siting, design, and construction measures to minimize exposure to coastal erosion, mass wasting and historic tsunami run -up shall be required to the extent feasible and prudent. Consistent: • Not applicable. This lot is not located in a known hazardous area. 5. Wetlands Filling and drainage of water bodies, floodways, backshores, and natural wetlands shall be consistent with ACMP Standards 6 AAC 80.070 (Energy Facilities) and 6 AAC 80.130 (Habitats). Consistent: Not applicable. This action does not involve filling or draining of water bodies, floodways, backshores or natural wetlands. COMMENTS The purpose of this request is to investigate the possible rezone of Lots lA and 3A, Estelle Subdivision from R1-- Single - family Residential to R2 - -Two- family Residential. These two (2) lots were recently consolidated from five (5) pre - existing lots (Case S92 -012) in order to create conforming lots regarding lot size and lot width. Staff noted during the case that the two (2) small lots along the back lot line of the three larger lots were in the R2-- Two - family Residential zoning district. The three (3) larger lots were located in the R1 -- Single- family Residential zoning district. The consolidation created a split lot zoning situation which requires a rezone request to consolidate the zoning even though the lots have already been consolidated. Issues to be considered in evaluating this rezone request include conformance with the comprehensive plan, land suitability, recent development trends in the area, and traffic impacts including adequate access and offstreet parking. CONFORMANCE WITH THE COMPREHENSIVE PLAN: The 1968 Kodiak Island Borough Comprehensive Plan indicates this area for Medium Density Residential Development. Medium Density Residential Development is defined as single - family and two - family dwelling units. This request is therefore consistent the goals and objectives of the comprehensive plan. Case 92.095 Page 4 et P & Z: November 18, 1992 Public Hearing Item VI -C ZONING /USE: Lot lA is currently developed with a single- family dwelling. Lot 3A is vacant. Both lots are consistent with the present R1-- Single - family Residential zoning district. No nonconforming uses will be created by the change of zoning from R1 -- Single - family Residential to R2-- Two - family Residential. LAND SUITABILITY: The lots have sufficient lot area and width to be conforming under both R1 -- Single- family Residential and R2-- Two - family Residential zoning. Both lots have topographical considerations which might make development of duplex dwellings more of a challenge. This is primarily due to the need to provide for at least three (3) off -street parking spaces per dwelling unit. The lots slope away from Mission road towards the rear lot lines. RECENT DEVELOPMENT TRENDS IN THE AREA: The Lots adjacent to Lot lA and behind both Lots lA and 3A are located in the R2-- Two - family Residential zoning district. This R2-- Two - family Residential zoning district forms a contiguous area roughly bounded by Father Herman Street to the rear, Pearson Cove, Near Mission and Tagura intersection the areas served by Stellar Ave, and Portions of East Addition across from the Jr. High and High School. TRAFFIC IMPACTS: The present RI—Single-family Residential zoning allows for a single - family dwelling on each lot. A rezone to R2-- Two - family Residential would allow for one additional dwelling unit on each lot or for professional office development (provided that all other applicable regulations are met). Traffic impacts from the additional development potential allowed by R2 -- Two - family Residential zoning would be marginal. Mission Road is designated an urban collector. While the ingress and egress of traffic would marginally affect the traffic flow, it would not -be significant given the ingress and egress to other lots along the Mission Road condor. Also, any present limitations of the Mission Road corridor have more to do with the need for road improvements to serve the existing traffic flow than the effects of this minor rezone request. Case 92.095 Page 5 of 7 P & Z: November 18. 1992 Public Hearing Item VI -C SUMMARY These lots are now suitable for rezone to R2-- Two - family Residential since the lots have been consolidated into conforming lots. The proposed R2 - -Two- family Residential zoning district permits single - family and two - family dwelling and professional offices. This is consistent the Medium Density Residential Development designation as contained in the 1968 Kodiak Island Borough Comprehensive Plan. The proposed R2-- Two - family Residential zoning district will not significantly increase traffic levels in the area. The new zone will encourage new development. The new zone is consistent with the adjoining R2-- Two - family Residential zoning district. A rezone to R2 -- Two- family Residential will create no nonconforming uses and is consistent with the development trends in the area. FINDINGS OF FACT 1. Findings as to the Need and Justification for a change or Amendment. The rezone of Lots IA and 3A, Estelle Subdivision from R1-- Single- family Residential to R2-- Two - family Residential is necessary and justified because the R2-- Two - family Residential zoning district permits development that: A. is consistent with development trends in this area; B. is suitable for the property as a whole, given the physical characteristics and location of the tract; will create no nonconforming land uses on the lots identified for rezone; D. is consistent with the existing and anticipated future development of this area. 2. Findings as to the Effect a Change or Amendment would have on the Objectives of the Comprehensive Plan. The 1968 Kodiak Island Borough Comprehensive Plan indicates this area for Medium, Density Residential. The proposed R2-- Two - family Residential zoning district is specifically included in the definition of Medium Density Residential contained in the plan. This zoning change is specifically consistent with the objectives of the comprehensive plan. RECOMMENDATION Staff finds that this rezone request meets all the required findings and therefore recommends that the Commission forward the rezoning to the Borough Assembly recommending approval.
