Two Separate Dwellings as Duplex
Dear Mr. LeDoux:
September 22, 1989
This letter is your notification that an administrative determination has been made by the
Community Development Department that the Kodiak Island Borough will not seek
removal of, or pursue enforcement action against, the separate apartment used as a
second dwelling unit on the R2--Two-Family Residential property referenced above.
The following findings of fact have been adopted to support this determination:
FINDINGS OF FACT
1. The property owner obtained zoning compliance and building permits, and
worked actively on the rezoning of this area from RR to R2, with the
understanding that two separate units constituted a duplex.
2. A certificate of occupancy was issued with the understanding that the two units
met all code requirements for the R2 zoning district.
Notarized affidavits have been provided by two individuals associated with the
construction of these two units in 1980-81 attesting to the fact that it was mutually
understood by the property owner and building official that all code requirements
pertaining to the R2 zoning district were met.
4. There is adequate parking onsite for the two units.
The property owner has been assessed and paid utility charges on a duplex
since 1982.

6. There is no increase in the density intended for the R2 zoning district.
7. No substantial public purpose would be served in enforcement action against this
property.

Dear Linda;
This letter is to declare what I know about the constructiOnof
516 Mozart.
I gave Mr. Ledoux advise on what was necessary and how to construct a
grambrel roof on the garage apartment and how to build the stairs so
that they would pass the building code. The reason Mr. Ledoux was
consulting me was that I had previously been the building and zoning
official.
When the project was completed my son and daughter-in-law moved into
the apartment.. I don't know whether they moved in before or after the
C.O. was obtained; but I do know that an attempt was being made to
comply with the existing building code. I believe they moved into the
apartment in July of 1981. As far as I know it has been occupied as
an apartment continuously since that time.
