The Commission tabled your request to permit a flower shop addition as they would like to meet with you on December 5, 1979, at 7:30 p.m. in the Borough Assembly Chambers during a work session to discuss this matter with you. We wish to inform you that'this decision of the Commission may be appealed to the Borough Board of Adjustment within ten (10) days of the Commission's action. Mr. Pugh questioned Mr. Milligan on the parking area Mr. Busch closed the regular meeting and opened the public hearing. Dr. Eufemio states that he has adaquate parking even at the busiest Mr. Busch closed, the public hearing and reopened the:regular meeting. Mr. Perez moved to table this request for further information and also to look at the finer details with Dr. Eufemio at a work session. Seconded by Mr. Baker. An amendment to the Kodiak Island Borough Zoning Ordinance establishing additional height limitations within the airport annroach and side-slope safety zones. REQUEST:' This is a request for a variance from the off - street parking pro-, visions-of section 17.57.010 B.7. of the Kddiak Island Borough Code of Ordiances to permit construction of an addition to an existing business' building in a .business zoning use district.. - SITE: The petitioned property is located within block 9 Erskine Subdivision. The site is located on Mill Bay Road opposite the Kodiak Police Station and is locally referred to as the City Market property. HISTORY:,. In 1977, the owners obtained a building permit to enlarge the.then, existing building; doubling the size of the building, In_1979, the sub- sequently- obtained a permit for a second addition ' ition to the building. The applicant now wishes to add yet another addition to the building which will result in a reduction in required parking area and result in.a net parking reducti "on_of three (3) spaces below that required for the existing building and its latest proposed addition. The Kodiak. Island Borpug}i Building Official reports the 1977 approved construction plans along with the 1979 constructed addition indicated there are presently sixty -one (61) off - street narking spaces available on the site, of those sixty -one (61) spaces provided the building presently.:requires fifty -eight (58).,spaces.under the terms of: the Zoning'Ordinance. Thus there presently exists a surplus of three '(3) spaces. The following reflect our review of that application, the Kodiak Island Borough .Code of Ordinances in section 17,66,090 sets forth the requirements' an applicant. must meet i n 'requesting a -vari ance . Section 17.66.090 A states "The'appkicati_on shall contain the following data with respect to the' property ;and -the, appl,i cant . " - "1.. A legal discription of the property involved. " "2. Plot plans showing the location of all existing and proposed . buildings or al terations, elevations of such buildings or,alter- ations, and such other -data as may be required. Staff finds the application.does include a legal discription of the... property involved. The plot plans can-be translated to show the existing building and the proposed addition. Building plans for the addition and elevations have not been provided. The,applicant has indicated construction can be started. within six months.. The code further require :, "B. The application shall._ contain a.statement, and adequate evidence showing the following conditions, all four of which must exist . before a variance -•may be granted: 1.- That there are exceptional..physi.cal circumstances . or con- ditions applicable. to the property . or to its intended use or . development which' do not apply generally to the other proper- ties in`.the. same land use district; .;Memorandum, - November 20, 2. That the strict application of the provisions of this title would result in practical difficulties or unnecessary hard-, ship; 3. That the granting of the variance will not be contrary to the objectives of the Comprehensive Plan." The following reflects the applicants response to the application requirements. The application shall contain.a statement and adequate evidence showing the following conditions, all four of which must exist _before a variance may be granted: 1. That there are exceptional- physical circumstances or con - ditions applicable to the property or to its intended use or development which do not apply generally to the, other properties . in the_same land use district. These special conditions are: "More than adequate parking" Staff finds the physical- characteristics of this site are different than other properties in this business district.. The site has been excav- ated out of the hillside. The site could be enlarged 'through further ex- cavation either by complete removal of more of the hill along Mill Bay. Road or by terracing the property. 2. That the strict application of.the provisions of-this title would result in practical difficulties or unnecessary hard- ship: "Unable to build flower shop." The applicant has not shown how strict application :of the zoning Ord- inance would result in practica:l..difficulty.or unnecessary hardship. Staff ' finds that there 'are' addi ti onal costs associated with hillside development, . at what point these costs constitute practical difficulties or unnecessary - hardship we can not-say.. The applicantwas aware of the costs of develop- ment and he is the only, one who can effectively develop a cost benefit-- ratio. 3. That the.granting,of the variance will not result in material damage or prejudice to. other properties in, the vicinity not be detrimental to the public health, safety or welfare in that: "More than adequate parking- exists. " - • - Staff-finds that other properties. in the area are.not generally ,impacted . by activities on this site.. We have found at times. it is. difficult to park at City Market,not because of a lack of developed.parking but rather do to the lack of organizatiom wi-thinthe lot and discourteous person parking such-a way that much of the property-is rendered inaccessable. It seems= everyone wants to park in front of the main entrance. ' • 4. That the granting of the variance will not.be contrary to- : the objectives.of the Comprehensive -plan for the following reasons.: "No harm'done: Memorandum, November 20, 9 9- Staff finds-onebf the major'objectives of any Comprehensive Plan is to provide for the orderly and systematic development of the community, This is done in part through adoption of a Zoning Ordinance which regulates uses of land and establishes minimum standards for'land development. To what extent granting a variance from a minimum standard will effect the community as a community decision. Hopefully this can be answered during-the public hearing. STAFF-SUMMAO: Staff" finds the applicant_has not provided all of the information" required with the 'application. Nor has:the.applicaht proven inthe application the existence of the four conditions. If this request were to be decided soley on the terms. of the Ordinance set forth in section 17.66.090 and the contents of the application. It could not be granted as the applicant has failed to address the salient points. However; We have attempted to evaluate the site and, its develop- ment in terms. of the Ordinance to determine whether or not-we could find facts supportive of the request, RECOMMENDATION: StaffrecOmmends"this request be approved subject to the following conditions: 1.
