Please be advised that the Planning and Zoning Commission, at
its May 20, 1981, regular meeting approved a variance from
Section 17.57.020(B)(5) offstreet parking - number of spaces
required, of the'Kodiak Island- Borough Code for. lots 84, 89,
90, 91, 115 -118, block 9, Erskine Subdivision, requiring 52
instead of 62 parking spaces, subject to the following conditions;
1. Parking plans be reviewed and approved by the Planning
and Zoning Commission prior to any construction;
2. Grading, drainage and erosion control plans for the
property be reviewed and approved by the City Engineer prior
to. any construction;
3. The parking area be graded and paved in accordance with
approved plans prior to the, issuance of a building permit for the
proposed warehouse;
4. Excavation be accomplished to provide a total available
area for 52 offstreet parking spaces;
5. A retaining wall be constructed in all excavated areas

Discussion between the Commission members and Mr. Filmore on the area of the parking

Mr. Ball - would you go along with a time stipulation on the paving of the parking lot
and if the time stipulation was not met then the storage area would be closed?
Mr. Filmore - that is agreeable.
Mrs. Strickert - are we going to tie in a date for the paving of the parking lot?
Mrs. Crowe - yes, we could do that.
Mr. Ball would you be able to do all of the paving in a years time?
Mr. Filmore - we would be able to have all of the parking lot paved within one year
from June 1982.
Mrs. Crowe will there be a gravel surface on all of the parking lot on or about June 1.

Mr. Filmore - that is correct, and all of the junk cars and trailers will be removed
from the back parking area. -
Mrs. Crowe all of the stipulations that the Commission has stipulated should be met.
Mr. Ball do you understand the stipulations?
Mr. Filmore yes, parking area must all be paved by June of 1983.
Discussion between the Commission members and Mr. Filmore on all the stipulations set -
forth by the Commission.
Mr. Ball moved to grant City Market their building permit with the original -six (6)
conditions to be met by September 1982, except for parking. Under parking, pave the
front part of the parking lot, which will be designated by the Planner, and the rear
part of the parking lot will be graveled at the same time the front is graveled. The
front lot will be paved in June of 1982 and the rear parking lot will be paved by June
of 1983; parking spaces should also be delineated. If these conditions are not met by
September of 1982, excluding the parking, the warehouse will be closed. Also if the
parking is not completed by the later part of June 1983 the warehouse will be closed.

Bill Alwert owner of Buccaneer Enterprises, petitioner for the exception. Showed and
explained a site plan.

Mrs. Crowe at one time we discussed the possibility of putting apartments above the
storage building.
Mr. Alwert when we pour the cement slab we will install the plumbing connections for ar
apartment.
Mrs. Crowe one of the other concerns is putting a warehouse in a high density resident
ial area and that the appearance of the building would not be compatible to the
residences in the area.

RE: Appearance request by Mr. Lee Filmore for City
Market's site plan review.
REQUEST:
Mr. Lee Filmore, City Market Manager, requests an appearance
with the Planning and Zoning Commission to review the parking
and drainage plans required by the Commission at its May 20, 1981
regular meeting when a variance, with conditions, was approved
for City Market in order to expand the existing storage facility.
HISTORY:
At its regular meeting on May 20, 1981 the Planning and Zoning
Commission granted City Market a, variance, with conditions, to
the number of required off street parking spaces for construction
of planned warehouse space to begin.
The Commission granted a variance to allow City Market to
provide for 52 off street parking spaces with six (6)
conditions. These conditions are as follows:
1. Parking plans be reviewed and approved by the Planning
and Zoning Commission prior to any construction;
2. Grading, drainage, and erosion control plans for the
property be reviewed and approved by the City Engineer prior
to any construction;
3. The parking area be graded and paved in accordance with
approved plans prior to the issuance of a building permit
for the proposed warehouse;
4. Excavation be accomplished to provide a total available
area for 52 off street parking spaces;
5. A retaining wall be constructed in all excavated areas
to prevent erosion; and

Mr. Filmore is here tonight to present to the Commission plans
which will satisfy conditions 1 and 2.
The City of Kodiak Public Works Department has reviewed and
approved the grading, drainage and erosion control plan and
also the construction of a retaining wall between the City
Market property and Mr. Cathey's property.
RECOMMENDATION
Staff recommends that the plans be accepted by the Planning
and Zoning Commission as satisfying conditions 1 and 2 contained
in the May 20, 1981 motion passed for City Market's variance
request. (Z -81 -007)
For the Commission's information we mention the fact that
should the improvements not be constructed as approved or
not installed in a timely manner, the warehouse addition
could be closed or City Market taken to court for non-
compliance. You may want to consider a condition on the
site plan approval requiring construction within a specified
time.

is not accomplished at this time, the plans as outlined, will be
satisfactory upon completion. More favorable weather will be
necessary before further progress can be accomplished at this
stage of construction.

It has recently been brought to my attention that you are
presently constructing retaining walls in the parking lot
area of City Market.
The Planning and Zoning Commission on May 20, 1981 granted a
variance to the parking requirements for the expansion of
City Market to provide more warehouse space. This variance,
however, has six (6) stipulations attached. One ofthese
stipulations was that the Planning and Zoning Commission
review and approve a parking plan PRIOR to any construction.
Attached for your records is a copy of the variance with the
stipulations as granted by the Commission.
We require a formal parking plan be submitted to this department
for approval by the Planning and Zoning Commission before further
construction activities take place.

MINUTES - April 15, 1981. Mr. Ramaglia under the roll call my name is misspelled
and on page 2 during the conversation with Mr. Brighton, I asked in reference to
Afternoon Delight I asked generally how it compared with other restaurants in
town in a health and cleanliness stand point and he said that it was superior to
other restaurants. No other corrections so Mrs. Crowe stated that they stand
approved as read.

STAFF REPORT: Mr. Walton presented the staff report based on a memorandum prepared
by the Planning Department staff recommends denial of this variance staff also
provided six (6) conditions for the Commission to follow in granting this if they
see fit. Mr. Walton presented the ownership of the property.
Mr. Briggs the erosion on the hill, are we permitting sewer seepage? Is that the
sewer line?
Mr. Hodgins Yes it is.
Mr. Briggs is that for the property above?
Mr. Hodgins yes it is
Mr. Briggs what about the retaining wall?
Mr. Hodgins I do not know.
Mr. Walton we did receive a non objection letter from a Rosenberg, and the only
other comment received is in your staff report and that was a letter from Mr.
Morris Lee, the City Building Official. Would you like me to read it?
Mrs. Crowe not necessary.
Mr. Walton there is also a letter from Dr. Cathy.
Mrs. Crowe how many notices were sent out?
Mr. Walton the file says 50 notices were sent out, 2 objections received and then
1 non objection.
Mr. Ball under staff recommendations I might have been mixed up k3 the parking
area be graded and paved in accordance with approved plans prior to the issuance
of a building permit for the proposed warehouse and H6 is parking area development
standards of Section 17.57.040 be accomplished within six (6) months of the date
of issuance of the warehouse building permit do those two conflict?
Mr. Walton I do not believe so, but now that you mention it they might be because
the parking area development standards do contain the curb stops, lighting if you -
require it. I basically would like, if you decide to approve it, the applicant
to come in and have a plan approved by you and then to make sure that it is
accomplished.

Dr. Eufemio the only thing I want to say because this is the last time I will be
coming before this thing I feel that you should provide for progress. We are
asking for more warehouse space the reason is there is land there not being used.
No one parks in the back all we,want to do is to move further out. There is
plenty of parking and it is a shame not to use it.
Mrs. Crowe do you think that people are aware that there is available parking
back there?
Dr. Eufemio sure, it is not needed and has never been used. Right now there is
heavy equipment down there because we are doing the wall and this is not bothering
anybody because it is not needed. You are talking about paving, sure we want to
pave but it will be next year.we may be in a position to pave. What we want now ._
is a store house. We will also clean up the back. That is all we are asking for
we do not plan to add any commercial space, no extra people and nocextra businesses._
Mr. Briggs is it my understanding that you are in the process of putting in a
retaining wall?
Dr. Eufemio I do not know if we can put up a retaining wall, we plan to pave and
do excavation and put up a wall right now what we plan to do is to put up armor
rock along the back
Mrs. Crowe but at this time you'are not doing that are you? What wall were you
referring to when you said you were constructing a wall, 1 think is lir. Briggs
question?
Dr. Eufemio where there is sewer, we plan to pave the whole thing and to put up
a wall.
Mrs. Crowe you are putting up wall where the sewer is exposed?
Dr. Eufemio what we are asking for is not interferring at all with anything else
we aretalkingabout, cause all we want to do is get some storage space, it is not
going to take away any parking spaces.
Mr. Hill I would not mind you putting down in writting what you want along with
a time line on it, paving it, retaining wall and have you start conforming to a
.few of the items you were supposed to have conformed to in the past.
Dr. Eufemio we did not have to conform t� anything as far as I know there was no
agreement about anything until now. And for our own personal progress we do want
to pave the land but we do not have enough money but the way things are going by
next summer we may be in a position to pave then.
Mrs. Crowe were you able to hear the recommendations that if this variance is not
turned down.
Dr. Eufemio yes.
Mr. Hill would you like a copy'of them?
Dr. Eufemio I heard them and I do not think that I can
which these things are to be done. I would anticipate
summer. As far as everything else I do not know.
Mrs. Crowe there is a possiblity that a variance would
of the six items before the warehouse was constructed.

draw up and want us to do and it is unreasonable to single out City Market for us
to do it and no one else has to do it.
Mr. Hill how do you know no one else is required to pave?
Dr. Eufemio no body else is paved.
Mrs. CroweWaldo's is paved, Mark It foods has their parking marked and they do
not have an erosion problem so that they do not endanger anybody.
Dr. Eufemio there is no body endangered now.
Mrs. Crowe that is your.ppinion and if I lived on that bank I would be concerned.
Dr. Eufemio if you look at that picture three or four years ago there is no
change. There is grass growing there on the bank.

ways you can help us is to improve our business efficiency by letting us have a

different than any of the other grocery stores that are in town and are adhearing fit_

City Market until very recently it hasn't been very conducive to go back there and
park because the condition of the area back in there. It was not really a parking
lot.

Dr. Eufemio I do not know what it means.

Mr. Hill I feel that before we decide to grant a variance that we should set some
stipulations and conditions an there and if he wants to abide by them then it can
be granted and if not, then why even bring up the subject.
Mrs. Crowe suggestions are good, I would like to add the addition of outside
lighting be provided in the parking area and with the stipulation that these
improvements be done before the building permit is issued for the proposed ware-
house. This gives us a handle on the situation and insures that these improve-
ments are done before any additional building is done on this property. Either
that or just turn it down. I do not think it meets the requirements for a variance.-- .
Mr. Ball I would go along with the staff's recommendation and recommend what
improvements we want to see. I do not think lighting is necessary.

Mrs. Crowe well it is not any more than we are requiring for any other grocery
store and they have complied with it. We are giving them a variance to reduce
the amount of parking that is required for anyonerelse in town.
Mr. Ball moved to approve a variance from section 17.57.020(5) parking requirements
on lots 84, 89, 90, 91, 115 -118. block 9, Erskine Subdivision for City Market
to expand its warehouse and to allow for 52 parking spaces with the following
conditions: 1. Parking plans be'reviewed and approved by the Planning and
Zoning Commission prior to any construction, 2. grading, drainage, and erosion
control plans for the property be reviewed and approved by the City Engineer
prior to any construction, 3. the parking area be graded and paved in accordance
with approved plans prior to the issuance of a building permit for the proposed
warehouse, 4. excavation be accomplished to provide a total available area for
52 offstreet parking spaces, 5. a retaining wall be constructed in a I excavated
areas to prevent erosion, and 6. parking area development standards of section
17.57.040 be-accomplished within six 6) months of the date of issuance of the
warehouse buildin• •ermit. All six 6 conditions must be met before a buildin
permit is issued. Seconded by Mrs. Wa ser. Motion PASSED with a 5 -2 vote with
Mr. Ramaglia, and Mrs. Walser voting NO, and Mr. Ball, Mrs. Crowe, Mr: Briggs,
Mr. Hill and Mr. Gudenau voted YES.
Mrs. Crowe stated that a variance expires if conditions or construction does not
begin within six (6) months.
5. PUBLIC HEARING ON CASE Z -81 -008. A request for a variance from section 17.51.010
accessory buildings on lot 7, block 10, Aleutian Homes Subdivision to permit the
construction of an accessory building which willtencroach 5' into a required 25'

REQUEST
Dr. John Eufemio is requesting a variance from the offstreet
parking standards to permit the construction of a 20' x 140'
warehouse addition on the rear of the existing City Market
structure. The relief sought is from the specified number
of offstreet parking spaces presently required plus the spaces
which would be required because of the proposed construction.
PROPERTY
The property involved contains 42,962 square feet of area or 0.98
of an acre. Access is provided from Mill Bay Road. The existing
structure occupies 11,200 square feet-of the lot or 26 %.. The pro-
posed 20' x 140' warehouse addition (2,800 square feet) would
increase the total structure.size to 14,000 square feet or 33%
of the lot area. Contained within the building at the present
are 3 storage areas (meat 384 square feet, freezers 864 square
feet, and warehouse 1,960 square feet) and a 280 square foot
office. Retail floor space within the building consists of
6,350 square feet for City Market and 910 square feet plus
462 square feet for two other stores. The following chart
summarizes this information:

LAND USE
The Comprehensive Plan identifies this area as part of the central
business district. The land has been and is used for retail pur-
poses. The property is zoned B- business.
Land Uses in the immediate area are the Union 76 Service Station,
single family dwellings, a veterinary medicine professional office,
the City Police and Fire Departments and the library.
DISCUSSION
Section 17.57.020(B)(5) of the Kodiak Island Borough Code states
"Food Market, grocery store or shopping center: one parking space
for each 125 square feet of retail floor area." Using the retail
floor space figure previously mentioned, 7,722 square feet, divided
by 125, yeilds 62 required offstreet parking spaces. Sixty -two (62)
spaces require 21,700 square feet of area according to Title 17.
The following chart may help:

At first blush, these figures show 7,262 square feet of "excess
area" and it would appear that no variance is required. However,
the "leftover" area is unusable in its present unimproved con-
dition. Using an as built" survey, prepared by Roy Ecklund,
the unusable bank area on the property actually contains 9,300
square feet or 22% of the total lot. There is then a deficit of
2,038 square feet. Removing this amount from the area required
for parking yields 14,438 square feet or the amount of space
nedded for 42 vehicles. A variance decreasing required parking
from 62 to 42 spaces is needed. The offstreet parking regulations
also contain Parking area development standards and Parking plan
review requirements which will apply if the variance is approved.
FINDINGS
Variances must meet four conditions to be approved by the
Commission, as follows:
"1. That there are exceptional physical circumstances
or conditions applicable to the property br to its intended
use or development which do not apply generally to the other
properties in the same land use district."
Applicant's Statement: "More parking than is needed - this
represents wasted and unused space."

Staff Comment: The only physical condition on the property
which represents a possible hardship is the eroding bank area.
Additional usable area could be obtained by further excavation
and the construction of a retaining wall.
"2. That the strict application of the provisions of
this title would result in practical difficulties or unnecessary
hardship ".
Applicant's Statement: "Inefficient use of valuable space."
Staff Comment: The strict application of the zoning
ordinance does present a problem. That problem, insufficent .
parking area, could be resolved, by the applicant, through proper
site development.
"3. That the granting of the variance will not result in
material damage or prejudice to other properties in the vicinity
nor be detrimental to the public health, safety or welfare..."
Applicant's Statement:- "No other properties nearby except
Union 76." -
Staff Comment: Residential properties abut. City Market.
The lack-. of a retaining wall and subsequent erosion caused a
City sewer manhole to be exposed and presented rear yard problems
to adjacent homes. -
"4. That the granting of the variance will not be contrary
to the objectives of the Comprehensive Plan."
Applicant's statement: "We have more space than needed
for parking."
Staff Comment: The 1968 Plan suggests that this property
is a part of the central business district but contains no
objectives for commercial land uses. Therrequested variance is
not contrary to the plan.
Additionally, Alaska Statute, Section 29.33.110(C), states, "A
variance shall,not be granted because of special conditions caused
by actions of the person seeking relief or for reasons of pecuniary
hardship or inconvenience. A variance shall not be granted which
will permit a land use in a district in which that use is prohibited."
Staff Comment: The unusable portion of the Iot is a result
of conditions caused by the applicant. Financial hardship or in-
convenience may be claimed but such cannot be considered according
to the statute referenced above. The proposed land use is permitted
in a B- business district.
Staff finds that exceptional physical circumstances or conditions
do not exist, that the strict application of the zoning ordinances
does present a problem, that the granting of a variance will con-
tinue damage to adjacent properties and be detrimental to the public's
health, safety and welfare, and that the requested variance is not

contrary to the adopted Comprehensive Plan. Further, in accordance
with A.S. 29.33.110(C), staff finds that the applicant has caused
special conditions from which he seeks relief and financial hard-
ship or inconvenience may be involved.
RECOMMENDATION
Staff recommends denial of the request for a variance from the
requirements of Section 17.57.020(B)(5), Offstreet Parking -- Number
of Spaces Required , on lots 84, 89, 90, 91, 115 -118, block 9,
Erskine Subdivision,, based on staff findings for conditions 1 and
3 of Section 17.66.090(6), Kodiak Island Borough Code, and staff
findings for A.S. 29.33.110(C).
Should the Commission's finding on this case be more positive
than staff's, the following recommendation is provided for your
consideration:
Recommend approval of a variance from Section 17.57.020(B)(5),
on lot 84, 89, 90, 91, 115 -118, block 9, Erskine Subdivision
for 52 total parking spaces, subject to the followning con-
ditions:
1. Parking plans be reviewed and approved by the Planning
and Zoning Commission prior to any construction;
2. Grading, drainage and erosion control plans for the
property be reviewed and approved by the City Engineer prior
to any construction;
3. The parking area be graded and paved in accordance
with approved plans prior to the issuance of a building permit
for the proposed warehouse;
4. Excavation be accomplished !to provide a total available

5. A retaining wall be constructed in all excavated areas to
prevent erosion; and

Gentlemen:
The City of Kodiak Engineering Department would like for you..to carefully consider
the above request. It is our opinion that the parking requirements could not be
satisfied without considerable improvements to the existing property. The original
excavation, approximately six years ago, is causing extensive erosion and sloughing
problems to adjacent properties. This excavation was accomplished to provide ade-
quate parking for a building expansion program at that time, September 30, 1977.
On September 19, 1979 another building expansion permit was issued and the Planning
- and Zoning personnel were barely able to accomodate the required number of parking
spaces. With the present proposed building expansion, I rather doubt that this re-
quirement could be satisfied.
It is my understanding that the City Market property owner, at the time of the 1977
expansion project, promised to install retaining walls to protect the adjacent -pro-
perties from damage that might occur from the necessary excavation to provide the
required parking spaces at that time. To date, this has not been accomplished.
Due to the above factors, I feel that an indepth assessment of the.City.Market pro-
perty should be accomplished before any consideration for a variance is made. In
this assessment, a very firm consideration should be given to the adjacent property
owners and the City of Kodiak utilities that are endangered from previous City
Market expansion projects. -

The above request by Dr. John Eufemio has recently come to my attention,
and since my property is adjacent I feel that it is necessary to respond.
Five years ago Dr. Eufemio removed a massive amount of soil from the
above mentioned lots to create a parking lot for City Market. At that
time the city sewer system was not exposed, and Dr. Eufemio assured us
that a retaining wall would be built during the next construction season.
Last fall I asked my attorney, Dennis Nelson, to find out when the retain-
ing wall would be built and who would be doing the construction. In January
the City of Kodiak also asked for this information and requested to see
copies of the construction plans. To date no information has been received
from Dr. Eufemio.
I would like to request that any decision on a variance to the property
mentioned above be postponed until the City of Kodiak and I have the inform-
ation we requested. At present parking for City Market is poorly defined,,
and I feel more planning 1s needed before any variance is considered.
Enclosed with this letter is a photograph of the property problem as it
exists presently. The exposed sewer system services the Aleutian homes.

I would like to call again to your attention the key fact:
that we are obligated to make the most economical use of valuable
commercial space. At the present time 2/3 of the parking space
at City Market is never used even at its busiest times. In actual
fact, one proposed addition would only move the assigned parking
spaces further out into the center. There would not be only
actual decrease in the number of parking spaces and since the
additions would be used as a warehouse, there would not be any
new retail space. In other words, our proposed addition would
not alisiriate any already existing space.

Planning and Zoning has seen fit to retain their unreasonable restrictions
of one parking space per 125 sq. feet for supermarkets. We had been hoping that
this would be lifted but since it has not, we are now applying for an exception
to this ruling. We would like to expand City Market to include a warehouse and
storage area. We have attached plat which shows our proposed addition.`
We hope for quick and favorable action since we expect to build this spring.
I can only hope that each of you before -you decide, inspect City Market on its
busiest day (Saturday afternoon) and see how much space goes unused and wasted.
It is rediculous to allow valuable space to be wasted in this way. Also note
that our addition will dress up the back of City Market.

Thank you for your letter of November ,20th. At one space per

I firmly believe that present parking requirements for commercial
buildings are overly restrictive. Over six months ago, in connection with
City Market, I appeared before the P&Z Commission and so stated. At that
time I was promised that this would 15e discussed. To date nothing apparently
has been done. I still feel a change should be made. As an example I offer
City Market, a very busy place. While we have the maximum allowable places,
yet fully 2/3 of the parking is not used. In other words, you say we cannot
add on to our building because we are at the allowable limit for parking yet
only 1/3 of it is even used. We have been waiting over six months for an
answer.

RE: Z-79-053. A request for a variance on the parking requirements
of the Kodiak Island Borough Code of Ordinances on lots 84, 89,
90, 91, 115, 116, 117, and 118 block 9, Erskine Subdivision.
REQUEST:
This is a request for a variance from the off-street parking pro-

visions of section 17.57.010 B.7. of the Kodiak Island Borough Code of
Ordiances to permit construction of an addition to an existing business
building in a business zoning use district.
SITE:
The petitioned property is located within block 9 Erskine Subdivision.
The site is located on Mill Bay Road oonosite the Kodiak Police Station
and is locaqy referred to as the City Market property.
HISTORY:
In 1977, the owners obtained a building permit to enlarge the then
existing building, doubling the size of the building. In 1979, the sub-
sequently obtained a permit for a second addition to the building. The
applicant now wishes to add yet another addition to the building which
will result in a reduction in required parking area and result in a net
parking reduction of three (3) spaces below that required,for the existing
building and its latest proposed addition.
•The Kodiak Island Borough Building Official reports the 1977
approved construction plans along With the 1979 constructed addition
. indicated there are presently sixty-one (61) off-street parking spaces
available on the site, of those sixty-one (61) spaces provided the
building presently .requires fifty-eight (58) spaces • under the terms of
the Zoning Ordinance. Thus there presently exists a surplus of three .(3)
spaces.
• The proposed addition to the building will require 3.2 parking
spaces. However, the space required for the addition would reduce a-

4. That the granting of the variance will not be contrary to
the objectives of the Comprehensive Plan."
The following reflects the anolicants response to the application
requirements. The application shall contain a statement and adequate
evidence showing the following conditions, all four of which must exist
before a variance may be granted:
1. That there are exceptional physical circumstances or con-
ditions applicable to the property or to its intended use or
development which do not apply generally to the other properties
in the same land use district. These special conditions are
"More than adequate parking"
Staff finds the physical characteristics of this site are different
than other properties in this business district. The site has been excav-
ated out of the hillside. The site could be enlarged through further ex-
cavation either by complete removal of more of the hill along Mill Bay
Road or by terracing the property.
2. That the strict.application of the provisions of this title
would result in practical difficulties or unnecessary hard-
ship: "Unable to build flower shop."
The applicant has not shown how strict application of the zoning Ord-
inance would result in practical difficulty or unnecessary hardship. Staff
finds that there are additional •costs associated with hillside development,
at what point these costs constitute practical difficulties or unnecessary,
hardship we can not say. The applicant was aware of the costs of develop-
ment and he is the only one who can effectively develop a cost benefit
ratio.
3. That the granting of the variance will not result in material
• damage or prejudice to other properties in the vicinity nor!
be detrimental to the public health, safety or welfare in ,
that: "More than adequate parking exists."
Staff finds that other properties in the area are not generally impaCted
by activities on this site. We have found.at times it is difficult to park
'at City Market not because of a lack of developed parking but rather do to
the lack of organization within the lot and discourteous person parking in
such a way that much of the property is rendered inaccessable. It seems
everyone wants to park in front of the main entrance.
4. That the granting of the variance will not be contrary to
the objectives of the Comprehensive plan for the following
reasons: "MO harm done,"

to provide for the orderly and systematic development of the community,
This is done in part through adoption of a Zoning Ordinance which regulates
uses of land and establishes minimum standards for land development.
To what extent granting a variance from a minimum standard will effect
the community .as a community decision. Hopefully this can be answered
during thp public heOriDg.
STAFF SUMMARY:
Staff finds the applicant has not provided all of the information
required with the application. Nor has the applicant proven in the
application the existance of the four conditions. �
If this request were to be decided soley on the terms of the Ordinance
set forth in section 17'65,090 and the contents of the application. It
could not be granted as the applicant has failed to address the salient
points. However; we have attempted to evaluate the site and its develop- •
ment in terms of the Ordinance to determine whether or not we could find
facts supportive of the request.
RECOMMENDATION:
Staff recommends this request be approved subject to the following
conditions: .
1. The parking area be graded.
2. That the fifty-nine /59\ available parking spaces be delineated
with curb stops to insure that each is readily identifiable.
This should reduce the confusion during peak business hours and
reduce congestion in the parking area.
3. That concrete or asphaltic compound sidewalks be provided adjacent
to the building for customer convenience,
4. That outside lighting be provided to illuminated parking areas
during business hours.after dark.
5. That a revised site plan indicating the driveway Ope|ing inaccor-
dance with section I7.57.060 be submitted prior to construction,
6. .That plans as required under section 17`21,020 C. be submitted
to the Planning and Zoning Commission for approval prior to
construction.

Dear Dr. Eufemio:
The Planning & Zoning Commission at the second day of the Au-
gust 15, 1979 meeting classified your parking lot as a private park-
ing lot in order to expedite the processing of your building permit
application. Attached is the memorandum that was submitted to the
Planning & Zoning Commission as required by 17.57.020.
If part of your store could be considered a warehouse the size
of such warehouse may be large enough to reduce some of your parking
requirements. With the plans submitted I have no way of reducing
the area for retail sales purposes. A. detailed floor plan of your
building will be of valuable assistance in determining your actual
on site parking requirement.
On a project of this size you should have your designer lay out
a parking lot and submit it for approval. If you cannot come up
with the proper number of parking spaces you will have to apply for
a variance. This application must be in before August 21, 1979 to
get on the September agenda.
I have enclosed a copy of Chapter 17.57 of the Kodiak Island
Borough Code of Ordinances. This can be used as a guide in laying
out the parking as it has all of the requirements that are to be met.
I hope this information is of assistance to you. We look forward
to your continued cooperation and assistance in processing your build-
ing permit for the addition to City Market.

1. City Market Construction. On August 8, 1979, Mr. Morris Lee, Kodiak City
Building Official sent the attached letter to Dr. Eufemio advising him to
stop work on the addition until a building permit had been issued.
2. Fir'Terrace Apartments. The fencing for the Fir Terrace Apartments is being
cut at the Island Lake Sawmill. The contract for the landscaping has been
awarded and is expected to start the week August 13, 1979. The project is
expected to be completed September 15, 1979 with turn key and occupancy by
October 1, 1979. Gary Hovanec and'I inspected the property for drainage at
the rear and without the original topographic map it would be impossible to
tell what has taken place. It would be possible to drain the standing water
from the back line when the landscaping is being done. If there are any
questions Morris Lee will meet with the Commission and try to answer them.
3. DeVille property on Spruce Cape Road. Mr. DeVille is trying to sell his
property on Spruce Cape. August 9, 1979 I drove over after work and it
looks like he is cleaning up around there. There•is still some heavy
equipment sitting around.
4. Building Permits for Industrial Uses. Attached are the copies of builing
permits issued in the Industrial area back to 1975.
5. Brodey House on Benson Blvd. Mr. Brodey's house shown in the Kodiak Mirror
is 2 stories with a 7' attic. He had a variance for the project. Attached
is the Planning and Zoning Commission Resolution No. Z -79 -007 approving
the variance.

During our telephone conversation of August 2, 1979, you advised
me that your partner in Anchorage was bringing over a set of
plans for the latest addition to your City Market building, lo-
cated on Lots 84, 89 and 90, Block 9, of the Erskine, Subdivision.
To date I have not been presented with a set of plans for this
said addition.
I have researched our records and cannot find a building permit
or a set of plans for this building. The State Fire Marshal's
office in Anchorage has no record of a plan review for your struc-
ture. Consequently, I must presume that your building has been
constructed in violation of the Uniform Building Code, State, City
and Borough Codes, Laws and Ordinances.
This letter is written confirmation of our telephone conversation
of August 2, 1979. No further construction can be permitted on
the City Market addition. This letter is your official notice of
the verbal "stop work order" given to you on August 2, 1979.
strongly urge you to contact me as soon as possible to rectify
this violation„ The required process is as follows;
1. Obtain a building permit application from
the City of Kodiak, office of the Building
Inspector.
2. Obtain zoning information from the- Kodiak
Island Borough Planning and Zoning office.

Borough Code I find that 81 parking spaces should have been provided;.and only 67

This letter will confilw the recent visit to your establishment of
a member of this department for the purpose of conducting a Fire Life
Safety re—inspection. Several deficiencies noted during the first inspec-
tion (Januaiy 5, 1979) were reexamined. All of the deficiencies were
found to be corrected with the exception of the items listed below.
ITEM 2. Several ceiling tiles are missing in the shopping area of
your store. These tiles are an integral part of the one hour fire
resistancy requirement of your building and mist be replaced.
Uniform Building Code 1973 Section 4303 F.? 4305.
ITEM 6. The boiler room lacks a self closing one hour rated fire
assembly. Install this door to gain the required one hour separation of
this room from the rest of the occupancy.
Uniform Building Code 1973 Section 4306 Ce 1108.
ITEM 7. There are numerous openings in the walls and ceiling of the
boiler room which must be sealed in to provide the required one hour fire
separation.

These items have been granted (upon written request) a one week
extension period for compliance. A letter certifying the above items have
been corrected must be sent to this office no later than April 9, 1979.
These deficiencies are in direct violation of the codes cited with them
