Dear Mr. Spagnola:
This letter is to inform you of the results of staff
investigations to determine whether the building on the lot
referenced above is a nonconforming use (i.e., a four-plex in a
R2--Two-Family Residential Zoning District).
To be "grandfathered," a nonconforming structure must have
existed prior to June 5, 1980 and have ,generally been used
continuously since that date. The use must be documented.
In this case, city tax and utility records do not provide the
necessary documentation to support this nonconforming use since
previous owners have paid only for triplex use.
However, documentation has been supplied in the form of notarized
statements from individuals who rented units at this address
stretching back to 1978. These statements confirm the use of the
building as a four-plex.
As a result, it is satisfactorily established that the building
at 420 Carolyn Street, legally described as Lot 66, Block 8,
Erskine Addition Subdivision, has a valid claim to its
nonconforming use as a four-plex. You should be aware that this
determination may result in an assessment of back taxes and
utility charges by the City of Kodiak.
