Seconded by Mr. Ball, Chairman Busch suggested that the Commission consider zoning this area Business, and then some discussion followed between the Commissioner'sconcerning this suggestion. Mr. Anderson withdrew his motion. Mr. Ball withdrew his second. Mr. Ball moved that we postpone any further action on this item until November 29. Second- ed by Mr. Perez. Motion passed unanimously by roll call vote. (Jack Mann) REQUEST. Petitioners are requesting a variance to permit the existing dwelling structure to be raised approximatley 8' and to allow construction of a new lower floor. They also wish to construct an open deck across the front of the building which will project into the required front yard. The existing structuare presently projects approximatley 4 + feet into the required rear yard. SITE. The property is located on the south side of Upper Mill Bay Road between Rezanof and Erskine Avenue. :The site is basically level due to retaining walls and developed with a nonconforming (rear yard encroachment approximately 4') single family residence. The property is zoned R -2. ANALYSIS. Staff in reviewing all variance applications must determine whether or not the prerequisite conditions in Section 17.66.090 . have been met. A. Staff in reviewing the building permit application finds there is no front yard encroachment based on present construction. B. Staff agrees with petitioners comment.; C. Staff finds -based on statements of the applicant that cohstruction can proceed within the-time-limit established by the ordinance. .1. Staff finds that the 75% front yard rule may apply in this instance. The lots, particularly this one are small and the building does, encroach into . the rear yard. All properties within this block wishing to remodel may have similar problems. 2.
