RON KUCHICK: Owner in Killarney Hills. In favor of industrial to
' residential, but against the R-3. Doesn't want to live in a minia-
ture Los Angeles here in Kodiak.
Hearing no one in opposition of this request, Chairman Busch closed
the public hearing and reopended the regular meeting.
Anderson moved that the Commission rezone Lots A,B,C,D,E,F & G,
of Kadiak Alaska Subdivision from Industrial to R-2. Seconded by
Mr. Ball, Chairman Busch suggested that the Commission consider
zoning this area Business, and then some discussion followed between
the Commissioner'sconcerning this suggestion. Mr. Anderson withdrew
his motion. Mr. Ball withdrew his second. Mr. Ball moved that we
postpone any further action on this item until November 29. Second-
ed by Mr. Perez. Motion passed unanimously by roll call vote.
Mr. Ball moved that the Commission instruct the planning department
to take the necessary steps to advertise Tracts A,B,C,D,E,F & G in
regard to rezoning them to business (can't decipher), and have that
advertised, and have it back for us on our November 29th meeting.
Seconded by Mr. Anderson. Motion passed by unanimous roll call vote.

STAFF REPORT: Presented by Mr. Milligan based on a memorandum from
the planning department. Meets all lot area requirements. Discus-
sion followed between Mr. Milligan and the Commissioner's, and Bryce
Gordon.
Chairman Busch closed the regular meeting and opened the public hear-
ing. Hearing no response either for or against the request, Chairman
Busch closed the public hearing and reopened the regular meeting.
Mr.-Anderson,moved:that-the-Cotmission-grant Jack Mann the:variance
to raise his house. Seconded by Mr. Perez. Motion passed by un-
animous roll call vote. (Staff indicated that there were 5 returned
comments; two with no objections, and the rest'Unclaimed.)

which projects 16' into a required rear yard and to permit construction -
of a new deck which will project approximately 6' into the required
front yard on Lot 7 B, Block 6, Erskine Subdivision, in an R -2 zoning

REQUEST.
Petitioners are requesting a variance to permit the existing dwelling structure to
be raised approximatley 8' and to allow construction of a new lower floor. They
also wish to construct an open deck across the front of the building which will
project into the required front yard. The existing structuare presently projects
approximatley 4 + feet into the required rear yard.
SITE.
The property is located on the south side of Upper Mill Bay Road between Rezanof
and Erskine Avenue. :The site is basically level due to retaining walls and
developed with a nonconforming (rear yard encroachment approximately 4') single
family residence. The property is zoned R -2.
ANALYSIS.
Staff in reviewing all variance applications must determine whether or not the
prerequisite conditions in Section 17.66.090 . have been met.
A. Staff in reviewing the building permit application finds there is no
front yard encroachment based on present construction.
B. Staff agrees with petitioners comment.;
C. Staff finds -based on statements of the applicant that cohstruction can
proceed within the-time-limit established by the ordinance.
.1. Staff finds that the 75% front yard rule may apply in this instance. The
lots, particularly this one are small and the building does, encroach into
. the rear yard. All properties within this block wishing to remodel may
have similar problems.
2. Staff finds to raise all but the rear 4 plus feet of the building would
cause a physical and financially unnecessary hardship.

3. Staff agrees we find there will be no prejudice to other properties and
the planned improvements may enhance the values of other, properties as
well and the subject property.
