Seconded by Mr. Briggs. Motion FAILED by unanimous roll call vote. REASONS FOR DENIAL: Mr. Hill we do not need the same problems in this area as we have in other areas in the Borough. Would like to retain the safety of the area. Mr. Ramaglia voted NO because of the public testimony as most of the people to be involved would rather see 21/4. acre lots as the smallest. (Kay Marshall) !t ... Mrs. Crowe explained that this request is only for the R/V park. Not the mobile home park. Mrs. Crowe closed the regular meeting and opened the public hearing. Brent Mackie would like to see the development plan for this proposal. Mr. Hill showed Mr. Mackie the development plan. John Burt lives on Tract L. Opposed to the request for several reasons, sewer problems, more people and would like to see 40,000 square foot lots. Shelly Long Opposed to the request, sewer problems, too.many people, trash that will be left behind and an increase in vandalism. Mrs. Crowe don't you think that if we offer a place for these people to stay it will help to clean things up? Shelly Long it sounds logical, but I don't know if people would really follow the rules. I slao have a letter from Mr. and Mrs. Huges who are also against this request. Mike Rasmussen we need a place to put these people. Ken Sikora would like to have other public hearings on this. REOUEST Keith and Lea Bryan are requesting a variance from Section 17.18.040(C)- Rear Yards and Section 17.45.010(A) - Projections into Yards, to permit the construction of an un- enclosed deck which will leave an 11'8" rear yard. PROPERTY The property involved is located at 419 Erskine and is further known as Lot 4, Block 6, Erskine Subdivision. The lot has 5,929 square feet of are and is zoned R -2 Two Family Residential. DISCUSSION Section 17.18.040.(C) of Borough Code requires a twenty -five foot rear yard while Section 17.45.010(A) allows an un- enclosed porch or deck to encroach four (4) feet into the rear yard. The applicant wants to replace a porch and stairs which were destroyed by the elements with a 9'6" deck and stairs. The construction of the deck at this size will leave 11'8" for the rear yard. It should be noted that when the home was originally built a 22' rear yard resulted. A strict application of code would only allow the construction of a 1 foot deck in the back yard. Hence the need for the variance. RECOMMENDATION. Staff recommends approval of a variance to Section 17.18.040(C) of Borough Code to permit the construction of an un- enclosed deck and stairs on Lot 4, Block 6, Erskine Subdivision, which will leave an 11'8" rear yard, for the following reasons: KODIAK ISLAND BOROUGH Case 82 -056 Page 2 . 1' 1. There are exceptional conditions present because the second story rear door, cannot be used'without the granting of a variance for the construction of a deck; 2. The strict application of the zoning ordianaces will result in practical difficulties and unnecessary hardship by denying the use of the second story rear door; 3. Granting of the variance will not result in material damage or prejudice to other properties in the vicinity and the applicants health, safety and welfare will be improved; and 4. The applicant is not seeking relief from a condition he caused as the original deck and stair's were destroyed by the elements. 17.18.040(C) REAR YARD REQU1R6ENTS C. Rear Yard. There shall be a rear yard of not less than twenty- f-i-ve percent of the depth of the lot but such yard need not exceed twenty -five feet.
