Dear Mr. Billings,
The Planning and Zoning Commission considered your request for a variance
on the above referenced property during their regular meeting held on August 15,
1979.
The Commission approved your request to permit development of a single-family
dwelling on Lot 1, which will project not more than 15 feet into the required
front yard.
We wish to inform you that this decision of the Commission may be appealed
to the Borough Board of Adjustment within 10 days of the Commission's action.
The Borough Code of Ordinances states in Section 17.66.170 that any variance
is good for six months unless construction has been started.

A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING COM-
MISSION GRANTING VARIANCES FROM THE REQUIREMENTS OF SECTIONS 17.42.010, 17.18.
030, AND 17.18.040 OF THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES TO PERMIT
THE CONSTRUCTION OF A DETACHED DWELLING STRUCTURE ON A NONCONFORMING LOT OF
RECORD. (Gary Billings).
WHEREAS, a petition was received from Mr. Gary Billings to permit
the separate development of a dwelling structure on an abutting lot containing
5,617 square feet into a required 25 foot front yard. And;
WHEREAS, notice was published, notices were mailed and a public hear
ing was held. And;
WHEREAS, the Commission found the lot has an extremely irregular
shape consisting of five sides. And;
WHEREAS, the lot configuration presents extreme difficulty in build-
ing within the required set back areas. And;
WHEREAS, do to the development on adjoining lots the property can
not be replatted. And;
WHEREAS, the proposed structure will only occupy 25% of the lot.
And;
WHEREAS, granting this variance will not increase the density allowe
in the neighborhood and it will not conflict with the objectives of the Comp-
rehensive Plan.
NOW THEREFORE BE IT RESOLVED by the Kodiak Island Borough Planning
and Zoning Commission that this request for a variance is approved.

STAFF REPORT: Mr. Milligan presented a staff report based on a memorandum
prepared by the planning department.
Mr. Busch closed the regular meeting and opened the public hearing.
Mr. Billings spoke on his reason for needing the variance.
Mrs. Crowe asked if the way the house is sitting on the plans is that the
way it will actually be sitting on the lot?
Mr' Billing/ yes, that is the way it is going to be sitting on the lot.
Mr. Busch closed the public hearing and reopened the regular meeting.
Mr. Pugh moved to grant the variance from the requirements of Section
. 17.42.010, 17.I8'030, and 17.18,040 of the Kodiak Island Borough Code of
Ordinances to permit the construction of a new dwelling structure on the
joining lot containing approximately 5,617 square feet as apposed to the
' required minimum of 7,200 square feet and which if granted will project
approximately 15 feet into a required 25 foot front yard. Seconded by Mr.
Ball. Motion PASSED by unanimous roll call vote.

4. Z-79-040. An amendment to the Kodiak Island Borough Code of Ordinances,
Section 17,42,010. (Non-conforming lots). (P & Z Commission)
STAFF REPORT: Mr. Milligan presented the staff report based on a memorandum
prepared by the planning department. And an Ordinance prepared by the
Borough Attorney's office.
Mr. Busch closed the regular meeting and opened the public hearing.
Mr. Art Bors spoke in favor of the 5,000 square foot lot size.
Mrs. Bishop in favor of the 5,000 square foot lot size. She also stated
that this would make it easier for those people with non-conforming lots to
sell them or to build on them.
Mr. Busch closed the public hearing and reopened the regular meeting.
Mr. Milligan asked Mr. Gordon about the 5,000 square foot lot size. Mr.
Gordon thought it was a good size to stick to.
During a discussion by the Commission, the 5,000 square foot lot size was
agreed upon.
Mr. Pugh moved to adopt an Ordinance repealing and reenacting the Kodiak
Island Borough Code I7.42.010, non-conforming lots recommend passage to the
Borough Assembly and that under Section B, of the proposed Ordinance that
the figure 4,000 square feet be changed to 5,000 square feet. Seconded
by Mr. Ball. Motion PASSED by unanimous roll call vote.
5. Z-79-042. An amendment to the Comprehensive Land Use Plan reclassifying
lots 16A, 158, and 16C, USS 3098, from medium density residential to
Business. (Burke and Kealey)

SITE:.
The petitioned properties are triangularly shaped lots located at the inter-
section of upper Mi11Bay Road and Erskine-Avenue. Lot.2 which front on upper
MiliBay is developed with a single- family dwelling. It has-a lot area of.approxi-
.mately 6,496 square feet'. The adjoining lot 1 faces onto•Erskine,Avenue, it is
• presently undeveloped and has a lot area of approximately 5;617 square feet.
• HISTORY:.
The Erskine•Subdivision was platted and recorded on Februray-7, 1950. The
lots under consideration. were :purchased,by Mr. & Mrs. Billings from a Mrs. ,Ramona
Henderson in 1978 •
ANALYSIS:
In reviewing all variance applications the Commission is required to find
fact supporting thefour conditions set forth in Section 17.66.090 B of the
Kodiak Island Borough'Code of Ordinances which states: -
17.66.090 Variance—Application:. Section "B ", `.The application shall
. contain a statement and adequate evidence showing the following conditions,
all four of which must exist before a variance may be granted:
1. That there -are exceptional'physical circumstances or conditions
applicable to the property or to its intended use or development which do

2. That the strict application ofthe provisions of this title would
result in practical difficulties or unnecessary hardshop;

4. That the-granting of the-varinaCe'Will. not be contrary to the
' objectives of.the Comprehensive'Plan.
