AN ORDINANCE AMENDING TITLE 17 OF THE KODIAK CIT.Z"CODE.- NI PROVIDING TIME
LIMITS FOR THE APPEAL PROCESS azY.rY
BE IT ORDAINED by the Council of the City of Kodiak, Alaska, as follows:
Section 1. Subsections 17.10.020(a) and (b) arc hereby amended to read as
follows:
"(a) An interested person may initiate an appeal to the board of adiustment
by filing a notice of appeal with the city clerk within ten days after the action
or decision appealed from and paying a filing fee of 550:00.
(b) The city clerk shall transmit a copy of each notice of appeal received
to the borough clerk and the planning department or other administrative officer
of the borough involved in the action appealed within five working days of the
receipt of the appeal. At the time of transmitting such notice[s], the city
clerk shall request the borough to prepare the record on appeal which shall be
prepared within forty -five days of the date of the notice."
Section 2. Subsection 17.10.030(a)(1) is hereby amended to read as follows:
"(1) A verbatim transcript of the proceedings before the administrative
body from which an appeal has been taken, if those proceedings were taped or
otherwise recorded in their entirety. If they were not recorded, copies of any
approved minutes, summaries, or other records of the proceedings; ".
Section 3. Subsection 17.10.030(b) is hereby amended to read as follows:
. "(b) When the record has been completed, it shall be transmitted from the
borough to the city clerk. Upon receipt of the record, the city clerk shall,
within five working days, send a copy of the notice of appeal, by regular mail,
to all persons appearing as witnesses in the hearing of the administrative action
being appealed, and advise them that the record has been prepared. The city
clerk shall, within five working days, also notify appellant of receipt of the
record and make the record available to the appellant and any other interested
persons for review. A copy of the record shall be provided to any person on
request upon payment of reproduction costs."
Section 4. Section 17.10.040 is hereby amended to read as follows:
"17.10.040 Written statement. The appellant may file a written statement
summarizing the facts and setting forth pertinent points and authorities in
support of the allegations contained in the notice of appeal not [less] more
than fifteen days after the clerk has given notice of completion of the rec-
ord. The borough staff and any interested party wishing to file a written
statement in opposition to the appeal may do so within fifteen days after
expiration of the time for the filing of appellant's statement. Statements
filed by any person shall be available for inspection in the city clerk's
office."
Section 5. Section 17.10.050 is hereby amended to read as follows:
"17.10.050 Notice of hearing. The clerk shall set a date for the hearing of
the appeal at a regular or special meeting of the council, or at a meeting of
the council sitting as a board of adjustment, to be held not less than ten
nor more than twenty -one days after expiration of the time for filing of briefs.
Notice of the hearing shall he published in a newspaper of general circulation,
and shall be mailed by regular mail to the appellant and all other persons

filing statements or appearing at thc hearing of the administrative action
being appealed, not loss than five days before the hearing date."

wherein the notice of appeal Was filed with the city clerk after July 1, 1983;
provided however, that in no event shall the time period for accomplishing any
such action begin to run until written notification of the enactment of this
ordinance is given to thc appellant and all other person who filed statements
or appeared at the hearing of the administrative action being appealed.

The Planning and Zoning Commission at their regular April 18, 1984 meeting
denied the request to illuminate your business sign located on the above prop-
erty. The reasons for denial include the following:
1. Business signs are not appropriate use in a residential neighborhood; and
2. Adverse public testimony received at the hearing and as written comments.
Appeal of the Commission's finding may be made to the Kodiak City Council by
specifying in writing your objections. This material must be submitted to the
City Clerk no later than ten (10) days from the date of the Commission's
action.

Lot 6A, Block 54, East Addition Subdivision with the following
condition:
1. the carport be erected in such-a manner that it would not
prevent a fire vehicle from breaking through to reach the other
side of the building, if necessary.
The motion was seconded and the Chairman called for a roll call
vote. The motion CARRIED unanimously by roll call vote.

MS. FREED reported receiving more public hearing notices in
opposition to the request. As there was no further discussion,.
the Chairman closed the Regular Meeting and opened the Public
Hearing.
GAIL PHILLIPS and KNOX CHRISTIE spoke in favor of the Commission
granting the request because they felt the sign to be discrete.
HARRY BRIGHTON, EDITH WILEY, AND NANCY FROST (residents in the
area) were present and voiced objection to granting the request.
ACTING CHAIRMAN RENNELL closed the Public Hearing and reconvened
the,Regular Meeting.
COMMISSIONER PATTERSON MOVED IN CASE 84-023 TO GRANT A REQUEST

Drive. The motion was seconded. The Chairman called for a
roll call vote. The motion FAILED by unanimous roll call vote.
ACTING CHAIRMAN RENNELL informed the applicant of the right to
appeal to the City Council within 10 days.
FINDINGS OF FACT AND REASONS FOR DENIAL:
1. that there was no compelling reason to have an illuminated
sign in a residential area;
2. that there was too much public opposition to the request;
3. that the business will have no harmful effects from not having
the sign illuminated;- and
4. that an illuminated sign is not appropriate for a professional
office building in a residential area.
E) CASE 84-024. Request for a variance from Section 17.19.040 (Yards)
to allow the construction of an attached garage into the required
front yard setback on Lot 1, Block 7, Aleutian Homes Subdivision;
416 Thorsheim Street (Donald Keegan).
There was no additional staff report and no discussion. The Chairman
closed the Regular Meeting and opened the Public Hearing. As there
were no audience comments, the Chairman closed the Public Hearing
and reconvened the Regular Meeting.

I am not sure I can make your meeting due to a Chemical People meeting
on the same night. I have talked with Bud Cassidy and Tim Hill and
registerd fay objection to this variance. I want to strongly object
because this is one of Kodiak's oldent and, I feel, nicest neighbor-
hoods. We have lived in our home for 10 years, made extensive alter-
ations, made plans to raise our children in a neighborhood environment,
and plan on remaining here for many years to come. We bought and
improved the property with the understanding that it was and would
remain a family neighborhood. I would hate to see it degenerate into
commercial property.
We did not object to the building in which the Travel Center is located
because it was to be a clinic and that seems compatible with a neighbor-
hood like ours. But we are certainly not pleased to see this attractive
building become a rental property where anything goes. If you can
allow a travel agency to locate there, what's to keep it from becoming
the offices of a cannery, a fast food restaurant, or a liquor store?
Surely the Borough has ordinances to protect what few family neighbor-
hoods Kodiak has from such creeping commercialism.
I feel that if the owners are allowd to continue renting to businesses
of this kind it will soom be a detraction to our neighborhood. I
object to your approving this variance becaue such action would be a
degradation of our neighborhood. I also object on a purely aesthetic
level. What business do you have putting up lighted signs in a
family neighborhood? Further, I am concerned about what this might
do to our property values. I would not'want to live in a commercial
neighborhood and I would expect that should you allow this proposal
to take place we would experience some difficulty should we want
to resell our property to families looking for a family type neighbor-
hood.
To summarize, I not only object to the lighted sign but I would
also like to object to the type of business being carried on in this
building. Do the owners have the right, in a neighborhood environment
such as ours, to rent to this type of commerical enterprise'? I
surely have no. objection to the Travel Center being in Kodiak,
just as I have no objection to liquor stores or cannery offices, but
I don't want to live next door to one.

The congregation of the Community Baptist Church owners of the property
at 317 Upper Mill Bay Road (Erskine Sub-division Block 7, lot_55)
strongly urge that the city zoning ordinance pertaining to residential
property be upheld.
The variance applied for by Travel Center Inc., under case number
84-023 should not be allowed.
Too often exceptions have been made to zoning in Kodiak. If we ever
`want to become an attractive city we must follow our planning and
zoning regulations.
None of us want an illuminated sign opposite our front yard.

RE: CASE 84-023. Request for a variance from Section 17.60.030 (Resi-
dential District) to permit an illuminated sign in a Two-Family
Residential District.
Fifty (50) public hearing notices were mailed on March 29, 1984.
1. Applicant: Travel Center, Inc., 4500 W. 50th, Anchorage, AK 99502.
2. Land Owner: Knox & Lorena Christie, P.O. Box 801, Kodiak, AK 99615.
3. Request: Request for a variance from Section 17.60.030 (Residential
District) to permit an illuminated sign in a Two-Family Residential
District.
4. Purpose: The purpose of this request is to permit an illuminated sign
in a Two-Family Residential District.
5. Existing Zoning: Two-Family Residential District (R2).
6. Zoning History: The 1968 Comprehensive Plan designates this location
as Two-Family Residential District (R2). Departmental files show no
additional activity on this lot.
7. Location: Lot 19B, Block 5, Erskine Subdivision (411 Rezanof Drive).
8. Lot Size: 14,767 square feet.
9. Existing Land Use: Residential/Professional Offices.
10. Surrounding Land Use and Zoning:
North: Lot 18, Block 5, Erskine Subdivision is zoned R2 and has an
R1 use;
South: Rezanof Drive;
East: Lot 6, U.S. Survey 25388 is zoned PL and has a Business use
(Alascom);
West: Erskine Avenue.
11. Comprehensive Plan: The 1968 Comprehensive Plan designates this lot
as medium-density residential.
12. Applicable Regulations: Section 17.60.030H (Residential District)
states: "No illuminated or flashing signs are permitted in any
residential district."
COMMENTS:
Travel Center's proposal is to illuminate the sign that is presently
on the downtown side of Dr. Christie's residence/clinic on Rezanof Dr.
It is a standard Travel Center sign found at most of their travel
agencies.
A building permit was issued to hang the sign, but it was understood
it could not be lit until a variance was granted.
RECOMMENDATION:
Staff recommends approval of this request due to the mix of professional
office/residential use of the area and distance from the nearest
residence.
The sign is unobtrusive and no brighter than a street light. It is
a fair distance from the nearest residence and should pose no detrimental
affects.

2. CASE 84-020. Request to purchase 15 acres of presently leased Borough real
property in accordance with Chapter 18'30 (Sale of Borough Land).
This property is a portion of ADL 44355, Monashka Bay Drive

CASE 84-021. Request for a variance from Section 17.18.050 (Yards) and
Section 17'40'010 (Projections into Required Yards) to allow
construction of additions onto the front and side of the existing
structure on Lot 6A, Block 54, East Addition. This property is
