Box 1246 Kodiak, Aladca 99615 Dear Mr. Chairman: Equipment Rental With regarcUto the setback variance requested by Richard Hentson on Lot 15, Block 5, Erskine Subdivision, we wish to submit this letter as a. written • appeal to the Borough Planning & Zoning; Commission decision of July 26, 1967. Again, we strenuously object to this ten foot setback variance on the grounds that it will create a driveway parking problem with the existing, homes and in winter will create a more hazardous, road condition than what now exists. Presently, Erskine Subdivision is considered to be one of the finer residentual areas in Kodiak. In our opinion, the granting of a variance in this> neighbor- hood will only tend to lower the value of the adjacent property. All other property owners in this area have built homes on lots large enough to accomodate off street parking for their homes. We see no reason to grant this variance and thus crowd a home onto an inadequate lot and create a sub-standard precident in the area. In addition, we would be interested in the basis on which the Planning & Zoning Commission approved this variance. We trust that you will understand our position and objections to any variance which will lower our property value and create problems in the neighborhood. Sincerely ,yours, Harry and Lorraine Felton • DECISION RE: REQUEST FOR SETBACK VARIANCE ON LOT 15, BLOCK 5, ERSKINE SUBDIVISION, BY RICHARD BENTSON (CASE 1-H) At their meeting held on July 28, 1967, the Kodiak Island Borough Planning & Zoning Commission voted unanimously to grant the subject request. Following are the reasons for granting the variance: (1) There are exceptional physical circumstances applicable to this lot which do not apply generally to the other properties in the area in that it is a triangular lot, and following the normally required setbacks would permit construction of only an extremely small building. However, in comparing the total square footage of the lot, 4979, with the other lots in the area, 5000, the lot is short only 21 square feet. If the lot were square, the side yard setbacks would be met by the proposed construction. (2) The strict application of the provisions of the Borough Code as far as setbacks are concerned would result in the practical difficulty mentioned in (1) above, since it would preclude building a livable house on the lot, for which purpose it was purchased. (3) The granting of the variance will not result in material damage or prejudice to other properties in the vicinity. Construction of a house on the lot will raise the value of the property. The value of the proposed house is comparable to existing homes in the area - -S40,000 to S45,000. The construction of the house with a 15-foot instead of 25-foot setback irltront could possibly obstruct the view of one of the opponents to the granting of the variance, but the Commission did not feel this was sufficient cause for not granting the variance. (4) The granting of the variance will not be detrimental to the public health, safety or welfare. The Commission felt that granting a variance in the setback requirement would not have any bearing on making driving in the area more hazardous. .They felt that if there is a problem in the winter With cars slipping off the road, the City should erect a barrier to prevent this. (5) The granting of the variance will not be contrary to the objectives of the Comprehensive Plan, when it is adopted. Request for Setback Variance - Lot 15, Block 5, Erskine Subdivision - Richard Bentson (CAse 1 -H). The application letter was read and the plat studied. The letter had been approved as to form by Mr. Madsen. Mr. Williams made .a motion, seconded by Mr. Cross, that the variance be granted. The meeting was then recessed and the public hearing declared open. Mr. Bentson stated that he had nothing to add to his remarks at the time of the first submittal of the request other than be had purchased the property. Mrs. Felton objected-to the variance on behalf of herself and her husband. She stated that the granting of the variance would cause a parking and driving problem, since the street is very hazardous in the winter, and cars sometimes slide onto this lot. Also, they feel that granting this variance would lower the value of the adjoining property, since all the other homes in the area are on large enough lots, whereas this house will be crowded onto the lot. Mr. Lawhead objected since he felt the granting of the variance would set a precedent to grant others in the -area. He also objected because the house will obstruct his view and he feels a traffic problem will be created. .N. Bentson was called upon for a 'rebuttal statement. He did not feel that the construction of the house would have an effect on the safety of the street, even though the house would be only 15 feet off the street, instead of 25 feet. He also felt that construction of the -house would improve the neighborhood, rather than detract from it, since the lot is now vacant and - unkempt. If a variance is not granted to build on •1r this lot, it will just remain vacant. Also, the value of the house will be equivalent to those in the neighborhood -- $40,000 to $45,000. Mrs. Wiley questioned how far the roof overhang will be from her pooperty line, and was told 7 feet. There were no further comments and the hearing was closed and meeting reconvened. After some further discussion, the motion was carried by unanimous roll call vote. It was stated that if the opponents wished to appeal ' the decision, a written-appeal would have to be filed within 10 days. In rendering -the decision to grant the variance, the Commission gave the following reasons. Mr. Fields, Mr. Zentner and Mr. Herst, representing the ranchers, presented a map to show the present and proposed ranching areas on Kodiak. They are concerned because the State appears to be intending to make the Shearwater area into a refuge for moose, and the ranchers feel that this would be a good area for ranching, since it would be a good bear control area. The ranchers would like this request to be considered when the Comprehensive Plan is developed. Since most of the island is now under the Federal bear refuge, the ranchers feel that an additional area set aside as a refuge would be a serious setback to the ranching industry. The Commission agreed to do their best to see that there would be sufficient land available for ranching. B. Mr. Madsen re Pillar Creek Gravel Sale. Mr. Madsen was concerned about a gravel sale in this area ruining it as a recreation area. This area contains one of the most beautiful sand beaches that is accessible to the public. There is an ample gravel supply in Bells Flats, so that a gravel site at Pillar Creek is not a necessity. Furthermore, the State will be selling the gravel, and the Borough would not be receiving any benefits from the sale. The Commission went on record as objecting to this site for use as a gravel pit, and recommended that it be set aside for a recreation area instead. VII ZONING ITEMS - PRELIMINARY REVIEW A. Request for Setback Variance - East Addn Blk 37 Lot 16 - Church of God - Case 183 -A. The application letter was read and plat studied. The application had been approved by the attorney as to form. Mr. Williams moved, seconded by Mr. Welch, that a public hearing be held on this request at the next meeting. After some discussion, motion carried by unanimous voice vote. B. Request for Trailer Park Permit - Lot 2, Block 3, First Addition Kadiak Subdivision - Ernest Brothers. It was explained that this lot, now zoned R-3, would have to be rezoned to Unclassified in order for a trailer park to be located there. Mr. Brothers wished to know the Commission's feelings about his proposed court before he applied for a rezoning. The location on the map was studied. It was suggested that perhaps there are now enough trailer parks. Mr. Stansbury reported that spaces would soon be available in Hardings Court and in ACS. However, it was felt that it would be a good idea to have a new park in which everything would be completed and approved before any trailers are moved in. The Commission agreed to notify Mr. Brothers that the area must first be rezoned to Unclassified before an application Cor a court could be considered, and that the Commission will recommend, in connection with the court application, that no trailers will be placed in the area until the construction of all utilities and improvements has been completed and approved. The granting would not result in material damage or prejudice to contiguous properties: (1) The property is contiguous on one side to property owned by Alaska Communications Service which has no roads, structures or other facilities which would be adversely affected by the proposed construction; (2) On the second side the property is contiguous to Erskine Avenue. The requested offsets are sufficient so the building will not affect the flow of vehicle traffic or in any way interfere with the safety or use of the street. Assembly - 7/6/67. There were no comments. V CORRESPONDENCE - PEOPLE TO BE HEARD' A. Mr. Bentson re Variance on Lot 15, Blk 5, Erskine Subdivision (Case 1 -H). Mr. Bentson reviewed the case. He explained that both the original application and the appeal were not done in the proper form, according to the Borough Attorney, and therefore the decision rendered was void and the case would have to be re -done from the beginning. He had attempted to complete a new application letter which would be correct, but had not been able to complete it. He did not know what to state concerning the Comprehensive Plan, since he was not familiar with it. He asked if the Commission would set a public hearing on the case for the next meeting, subject to his submittal of the new, application letter on the following day, after he had it approved by Mr. Madsen. The Secretary explained that the Attorney had suggested that all application letters be approved by him before submission to the Commission. There was concern that this would cause everyone considerable delay. Also, it was felt that no state- ments could be made concerning the Comprehensive Plan, since the 1980 Plan had not been formally adopted by the Borough, and the new Plan has of course not been started yet. It was felt that no action could be taken on Mr. Bentson's request before submission of his application letter. He asked that they call for a public hearing subject to submittal of the letter and to the Attorney's approval. If the Attorney declares it incorrect procedure, he will present the letter to the next meeting. Mr. Cross made a motion that a public hearing be held on this case at the next meeting, subject to the submission of the new application letter and the approval of the Borough Attorney. Motion seconded by Mr. Williams and carried by unanimous voice vote. VI PUBLIC HEARINGS A. Request for Exception for Small Tool Rental and Second Floor Apartment Rental - Lot 4 Resubdivision of Lot 21, USS 3099 - Robert Brooks - Case 181 -A. It was explained that no opinion had yet been received from the Attorney on the legality of the aplication letter. Mr. Brooks requested that action be taken even if it has to be done over again. It was explained that in connection with exceptions and variances, it will be necessary for the Commission to send a representative to make sure that the proposed use will not be injurious to public health, safety or welfare or detrimental to other properties or uses in the vicinity. It was further explained that a decision must be written separate from the minutes which contains the findings of the Commission. Mr. Brooks' application was read. The Commission felt that it did state the facts required by the ordinance. under Section 3.A.7, that the use is desirable to the public convenience and is in harmony with the objectives of the ordinance. Mr. Waller moved, seconded by Mr. Williams, that the exception be granted. The meeting was recessed and the public hearing opened. Mr. Brooks stated that he was sure that none of his neighbors would object to his proposal. He feels that the building will improve the neighborhood, and will not in any way be injurious to it. There were no other continents and the hearing was closed and meeting reconvened. The motion was carried by unanimous roll call vote. In our opinion, the granting of a. variance in this neighborhood will only tend to lower the value of the adjacent property. He suggested that this proposal be considered, or negotiation take place with other firms, rather than waiting'for the grant from ASHA, slnce there is still no definite word from them. Mr. Barr felt that the Borough would get more for their money from this firm, and that they are a good firm. The Assembly concurred in asking a representative of the firm to'neet with them and discuss the proposal. B. Letter fraM Dick Sassara re Financial Consulting Services C. Letter from Tom Dowd of Foster & Marshall re Financial :Consulting Services The letter from Dick Sassara was read, and copies of the Dowd letter were distributed to the Assembly. These letters outlined a proposal for Foster & Marshall to handle the Borough bonding and long-range financial planning for capital improvements. Mr. Sassara has left the firm of Governmental Statistical Corp. and is now with Foster & Marshall. The Assembly concurred in asking Mr. Sassara to come to Kodiak and :discuss the proposal. Mr. Barr suggested that GSC also be contacted and asked to offer a proposal, if they are still represented in Alaska,-aIthoughit,was agreed that a Seattle firm would be more convenient to deal with than a New York firm. Al Dickow re Rezoning Request Mr. Dickow stated that he owns Part of Lot 6, and all of Lots 7 through 10 of Block 34, East Addition; and that he hopes to purchase Doug Preston's lots --Part of Lot 4, Lot 5, 'and part of Lot 6 in the same block. He wished to enter a formal request that these lots be included in the rezoning to business. Mr. Dickow was advised to submit a written request and application fee for this-rezoning. It was also suggested that if possible he obtain similar requests from'the owners of the lots which are between the presently proposed rezoning and his own lots, so that there would not be a break in between the areas. VI PUBLIC HEARINGS A. Requett for Exception to Build Utility Building - Aleutian Homes Inc. Subdivision, Block 12, Lots 50 -53 - DHUD - Case 176 -A. The meeting was recessed and the public hearing opened. Mrs. Lynch objected to the construction of the building next to her lot since it would block her view and would make her property less desirable. There were no other comments and the hearing was closed. Mr. Richmond questioned how high the building would be. It was determined that it would be of less height than a dwelling would be. Mr. Richmond moved, seconded by Mr. Williams, that a recommendation be made to the Borough Assembly that the exception be granted. Motion carried by voice vote as follows: Mr. Wailer - Yes; Mr. Welch - Yes; Mr. Williams - Yes; Mr. Richmond - Yes; Mr. Cross - Abstained. Request for Setback Variance - Erskine Subdivision, Block 5, Lot 15 - Richard Bentson - Case 1 -H. The application letter was reviewed, and the meeting recessed and public hearing opened. A written objection which had been received from the Feltons was noted. Mrs. Wiley stated that since the house would be built only 10 feet from her property, and the roof would have a 6 foot overhang, there would only be a four foot distance from her property, which she felt might be too close. She also questioned the A -frame style of the house. Mr. Bentson stated that this design was chosen because it would fit the lot best. He did not feel that the house would detract from the neighborhood. Mr. Stansbury stated that he had only heard objections to the shape of the roof, and felt that the decision on the variance should rather be based on whether it would cause any hardship on the neighbors. Mrs. Wiley asked whether variance would be granted on all lots in the City which are too small to meet the presen setback requirements. There were no further comments, and the public hearing was closed. The Commission took up Mrs. Wiley's question of whether variances would be granted on all similar lots, and Mr. Richmond stated that he felt each case should be judged on its own merits. After further discussion and study of the proposed plans, Mr. Williams moved, seconded by Mr. Welch, that the variance be granted as shown on the plans submitted. Mr. Deveau stated that there had been some difficulty with the wording on the petition, but that the majority of the property owners concerned had agreed to sign it. Be requested approval for advertising subject to submission of the petition. He explained that the property owners desired the use of the area now designated as the alley; that they did not wish the trees on the property cut down since it would create a wind tunnel; and that they all had off-street parking on their on property. An objection had been received from Mr. Johnson of KEA which had subsequently been withdrawn since an agreement had been reached on a utility easement. Mr. Cross, seconded by Mr. Richmond, moved that advertising for a public hearing on the vacation be approved, subject to submission of the petition. Motion carried by unanimous voice vote. This proposed rezoning would extend the present Business zoning in Block 1 of Airpark Subdivision for 2.38 acres toward the City. Mr. Williams moved, seconded by Mr. Welch, that a public hearing be held on this rezoning at the next meeting, June 28. Motion carried by unanimous voice vote. E. Request for Rezoning Lower Tagura Road ARea to Business - T. T. Fuller - East Addition Block 33 Lots 4 -8; Townsite Block 1, Lots 1 -6 and 11. Mr. Fuller presented a petition signed by the owners of this property. They feel that Industrial zoning in this area is too limited, and that there would be more opportunity for use of their property as Business. After further discussion, Mr. Richmond made a motion, seconded by Mr. Cross, that a public hearing be held on this rezoning at the next meeting on June 28. After further discussion, motion carried by unanimous voice vote. It was then pointed out that this request could be combined smith the intent of the Commission and the Assembly to rezone this area to Business. After some discussion, Mr. Richmond moved that the Commission, on its own initiative, add to this rezoning the remaining area on the upper side of Tagura Road which is now zoned Industrial. Motion seconded by Mr. Cross and carried by unanimous voice vote. F. Exception to Build Hospital in Unclassified Zone - Portion of USS 1822 and Lot 1, USS 3511 - Borough Initiative. It was explained that this exception amounted to a technicality only, since the Ordinance Committee has recommended that hospitals be allowed in Unclassified zones in the revised ordinance, but if construction takes place before the revision, the Commission should go on record as granting an exception so that no conflict will exist with the present ordinance. Mr. Williams moved, seconded by Mr. Welch, that the exception be granted. Motion carried by unanimous voice vote.
