(Tim and Pam Abena) 32 PUBLIC HEARING NOTICES WERE MAILED ON SEPTEMBER 3, 1982 REQUEST Tim and Pam Abena are requesting a front yard variance to permit the construction of an addition and artic entrance on an exist- ing single family home. LAND The land involved is located at 412 Erskine and is further described as Lot 15, Block 5, Erskine Subdivision. Lot 15 is triangular in shape and contains 4,979 square feet of area. The lot is zoned R -2 Two Family Residential and was created on February 17, 1950. CODE CONSIDERATIONS Section 17.66.090(B) of Borough Code states that all four of the following conditions must exist before a variance may be granted. 1. That there are exceptional physical circumstances or conditions applicable to the property or to its intended use or development, which do not apply generally to the other properties in the same land use distirct. 2. That the strict application of the zoning ordinances would result in practical difficulties or unnecessary hardship. 3. That the granting of the variance will not result in material damage or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety or welfare; and CASE 82 -091 Page 2 4. That the granting of the variance will not be contrary to the objectives of the comprehensive plan. The applicant's responses to the above conditions are shown on the copy of the variance request form enclosed. DISCUSSION Because of the presence of numerous irregularly shaped lots in the Erskine Subdivision there is a good record of past actions on variances. For example: 1. Lot 4, Block 6 (Bryan) - variance granted on June 16, 1982 to leave an 11'8" rear yard. 2. Lot 1, Block 6 (Billings) - variance granted on August 15, 1979 to leave a 10' front yard; and 3. Lot 15, Block 5 (Bentson) - variance granted on July 26, 1967 to leave a 15' yard on Erskine Avenue, a 5' rear yard, and a 10' side yard. Copies of the 1967 application for variances, submitted by Mr. Bentson, and the Planning Commission's decision on that case are enclosed for information. According to Mr. Abena's site plan the present home is setback 17.7 feet from the Erskine Avenue property line. There are an additional 8.5' from the property line to the street itself for an "effective" yard setback of 26.2 feet. The requested variance, if granted, would leave an "effective" yard of 19.5 feet. RECOMMENDATION Staff recommends approval of a variance to Section 17.18.04O(A) of Borough Code to .permit the construction of an..addition which will leave an eleven (11) foot yard from the Erskine Avenue property line of Lot 15, Block 5,. Erskine Subdivision, City of Kodiak, for the following reasons: 1. There are exceptional conditions applicable to the property which affect its development; 2. The strict application of the zoning ordinances would result in practical difficulties; 3. Granting of the variance will not result in material damage or prejudice to neighboring properties; 4. Granting of the variance will not be detrimental to ;: the public's health, safety or general welfare;, and 5. Granting the variance will not be contrary to the ob- jectives of the Comprehensive Plan. The existing structure extends approximately 8 to 10 feet further out toward Erskine Street than other structures on the same side of the street. Any ad- dition to the front would exagerate this alignment very conspicously. 2. If Erskine Street has a 50 foot right -of -way, in my opinion, any addition to the front would pose a problem on any future right -of -way improvements such as street paving and curb and gutters and /or sidewalks. 8. A general visual inspection indicated that the required 25 foot set -back is marginal. REQUEST FOR SETBACK VARIANCE ON LOT 15, BLOCK 5, ERSKINE SUBDIVISION, BY RICHARD BENTSON (CASE 1 -H) At theircmeetng held on July 28, 1967, the Kodiak Island Borough Planning & Zoning Commission voted'UnanimoiisIy to grant the subject request. Following are the reasons for granting the variance: (1) There are exceptional physical circumstances applicable to this lot which do not apply generally to the other properties in the area in.that it is a triangular lot, and following the normally required setbacks would permit construction of only an extremely small building. However, in comparing the total square footage of the lot, 4979,. with the other lots in the area, 5000, the lot is short only 21 square feet. If the lot were square, the side yard setbacks would be met by the proposed construction. (2) The strict application of the provisions of the Borough Code as far as setbacks are concerned would result in the practical difficulty mentioned in (1) above, since it would preclude building a livable house on the lot, for which purpose it was purchased. (3) The granting of the variance will not result in material damage or prejudice to other properties in the vicinity. Construction of a house on the lot will raise the value of the property. The value of the proposed house is comparable to existing homes in the area -- $40,000 to $45;000. The construction of the house with a 15 -foot instead of 25 -foot setback int'ront could possibly obstruct the view of one of the opponents to the granting of the variance, but the Commission did not feel this was sufficient cause for not granting the variance. (4) The granting of the variance will mot be detrimental to the public health, safety or welfare. The Commission felt that granting a variance in the setback requirement would riot have any bearing on making driving in the area more hazardous. They felt that if there is a problem in- the winter with cars slipping off the road, the City should erect a barrier to prevent this. (5) The granting of the variance will not be contrary to the objectives of the Comprehensive Plan, when it is adopted. Box 661 Kodiak, Alaska July 13, 1967 This letter is to request a variance or variances to the Kodiak Island Borough Code of Ordinances to allow the construction of a single unit dwelling as shown on the attached plot plan, with the offsets as shown on the plan and listed below: In support of this request, the applicants for the variances, Mr. and-Mrs. Richard A. Bentson, owners of the property involved, submit the following information. 1. The legal description of the _property involved is: Lot 15, Block 5, Erskine Subdivision, U.S. Survey 562, recorded on February 17, 1950 in Book R at Page 348. 2. Attached to this letter is a plot plan showing the location of the proposed building, and its elevation. d. It is the intent of the applicants to begin construction of this house within the next two months. A local contractor has been contacted regarding the construction of the building and the final building plans are in the process of being completed. A commercial bank has been contacted and the bank has indicated that financing Is available for the construction of the house. 4. The exceptional physical circumstances applicable to the property, which do not apply generally to the other properties in the same land use district are as follows: .A. Irregular Shape of Land — As shown on the plot plan, the land involved is a triangular shaped piece of property with the following dimensions: 127.94' x 77.84' x 149.95' B. Lot Area — The area of the property involved is 4,979 square feet. Under existing borough ordinances a house could not be constructed on this lot. 5. Strict application of the Kodiak Island - Borough Code of Ordinances would result in both practical difficulties and unnecessary.hardship on the applicants, in that construction of any type of residental structure would be•.preeluded-,under-a strict application'of.the ordinances.=.. The granting of the variance will not result in material damage or prejudice to other properties in the vicinity, or will not. be detrimental to the 'public health, safety or welfare because: A. The granting would not result in material damage or prejudice to contiguous properties: (1) The property is contiguous on one side to property owned by Alaska,Communications Service which has no roads, structures or other facilities which would be adversely affected by the proposed construction; (2) On the second side the property is contiguous to Erskine Avenue. The requested offsets are sufficient so the building will not affect the flow of vehicle traffic or in any way interfere with - the safety or use -of the street. Also, with the house situated as shown on the plot, there is adequate space available for off - street parking. (a) On the third side, the property is contiguous to the lot . owned by Mrs. Edith Wiley. Mrs. Wiley's house is located approximately twenty (20) feet from the property line (per Mrs. Wiley). This would leave approximately thirty (30) feet between the two houses. It is the backside of Mrs. Wiley's house (which contains the bedrooms) that would be approximately thirty (30) feet from the proposed structure. Construction would not adversely affect her enjoyment of her property. The granting would not result in material damage or prejudice to non - contiguous property in the vicinity: (1) Construction will have No affect on non - contiguous properties in the vicinity. Construction of the proposed structure will have no affect on the access'or enjoyment of any non - contiguous properties or result in any material damage to them. (2) Construction will actually enhance the value of properties in the general vicinity, in that the lot now is covered by brush and weeds.
