Dear Mr. Chatfield: This letter responds to a complaint filed with Community Development Department alleging a zoning violation on the property you own referenced above consisting of outdoor storage of tires and vehicles for resale purposes. I made a visit to the property on the afternoon of April 16, 1993 in an attempt to notify you in person. I encountered no one on the site, nor was there any response to the door bell. However, I did observe during this site inspection that there are more than one hundred tires stockpiled at the rear of your property, as well as fourteen _ vehicles, many with "For Sale" signs in the windows. Most of these vehicles J had no registration, outdated registration or were registered in various other names. These vehicles were packed so tightly onto the property that there \,`y was virtually no room available to support parking associated with the boarding -house use of the property. The purpose of this letter is to advise you that both outdoor storage and the operation of a used car sales lot are uses in violation of Kodiak Island Borough Code Sections 17.20.010 and 17.20.020 addressing the description and intent of and permitted uses in the R3- Multi - family residential zoning district. By way of explanation, land uses in any zoning district are listed as either permitted outright or peliilitted by obtaining a conditional use permit from the Planning and Zoning Commission. Other uses are not permitted. M_ c Kodiak Island Borough David Chatfield April 22, 1993 Page Two I am enclosing a copy of Chapter 17.20 of the Kodiak Island Borough Code pertaining to the R3- Multi- family residential district. In the R3 zoning district, there are fourteen (14) permitted uses as listed in Code section 17.20.020. There are no conditional uses permitted in this zoning district. Outdoor storage, which is explicitly permitted in both the B- Business and (- Industrial zoning districts, is not listed as a permitted use in the R3 district. The stockpiling of vehicles and tires for resale reasonably qualifies as outdoor storage associated with commercial activity. This is contrary to the description and intent of the R3 zoning district addressed in Code section 17.20.010 which specifically prohibits commercial and industrial land uses. As regards the sale of used vehicles, you may, in order to avoid violating that code also, wish to advise yourself of Alaska State Statute Sections 08.66.010, 060, and 090 (copy enclosed) addressing motor vehicle dealers and requiring them to register with the Department of Public Safety and post bond. A thirty (30) day deadline is established by administrative decision to bring your property into compliance with the Borough zoning ordinance. This is done in the interest of following standard procedure, and to give you the opportunity to appeal the determination and/or the deadline should you wish. Therefore, failure to remove the tires and other non - permitted outdoor storage, as well as vehicles not operational and not currently registered, by May 22, 1993, will require that the file be forwarded to the Borough Attorney for further enforcement action. This decision is final unless appealed to the Planning and Zoning Commission within ten (10) days of receipt of this letter. If you disagree with the determination, or wish to propose some other remedy or compliance schedule, it is essential that you appeal this decision within ten days. An appeal is commenced by filing with this office a written notice of appeal, specifically stating the reasons for the appeal and the relief sought. An appeal under Section 17.68,020.B of the Borough Code may be brought by any person affected by the issuance of an order or administrative decision issued under Section 17.75.O10.A of the Borough Code. Kodiak Island Borough David Chatfield April 22, 1993 Page Three Failure to comply with the terms of this decision or to appeal the decision subjects you to the penalties of Section 17.75.030 of the Borough Code, which states in part: "A person who violates any provision of this title, or order issued under 17.75.010.A...is guilty of a misdemeanor and upon conviction is punishable by a fine of not more that three hundred dollars ($300). Each act or condition violating this title, (or) order issued under 17.75.010.A.. and each day during which the act or condition exists...shall be a separate and distinct violation."
