Staff has developed the following findings of fact for the Commission's
consideration in support of their August 21, 1985 decision granting the above
cited variance.

The Kodiak Island Borough Planning and Zoning Commission at their meeting on
August 21, 1985, granted your request for the variances cited above and
adopted the following findings of fact in support of .their decision to grant
the variance to expand the cubical content of a nonconforming structure:
1. The unique condition applicable to this lot is the existing noncon-
forming accessory structure. Any addition to this structure will
expand its cubical content.
2. The strict application of the nonconforming section to the ordinance
would not allow any additions to the existing structure, even if in
full compliance with all other code requirements. This is a
practical difficulty and unnecessary hardship.
3. Granting of the variance for expansion of the cubical content of the
nonconforming accessory structure will not damage or be prejudicial
to other properties in the area. The public health, safety, and
general welfare will not be compromised.
4. Granting of the variance will not be contrary to the objectives of
the comprehensive plan which identifies this area as Central
Business District.
5. Action of the applicant did not cause the special condition from
which relief is being sought by a variance. The existing structure
was built in 1957, prior to adoption of a zoning ordinance in the
Kodiak Island Borough.

The Commission will adopt findings of fact for the second variance at their
regular September meeting.
An appeal of this decision may be initiated by any person or party aggrieved
by filing a written notice of appeal with the City Clerk within ten days of
the date of the Commission's decision. The notice of appeal must state the
specific grounds for the appeal. Therefore, the Commission's decision will
not be final and effective until ten days following the decision.
Failure to utilize these variances within 12 months after its effective date
shall cause its cancellation. Please bring this letter with you if you need
to come into our office to obtain zoning compliance for any construction on
your lot.

SUBDIVISION of Lot 9, Block 1, Southeast Addition No. 1, USS
2910AB to Lots 9A and 98 with the conditions stated in Mr.
Crowe's memo of August 12,1985, and also the front property line
for the purpose of computing in the required front yard setback
on Lot 9B shall be the property line in common with Lot 9A which
shows a bearing of N79°57'57"E as shown on the preliminary plat
dated July 18, 1985. The motion was seconded and CARRIED by
unanimous roll call vote.
The conditions stated in Mr. Crowe's memo of August 12, 1985:
1. Revise the title block to indicate Southeast Addition No. 1.
2. Applicant to install water and sewer services to both lots.
3. Provide a five-foot-wide electrical easement along Father
Herman Street.

L) CASE 5-85-045. Preliminary subdivision of Lot 8C, Block 1,

the property owner, The Kodiak Island Improvement Corporation,
stating that the Commission feels it is inappropriate for them to
lease that area because it does meet their parking requirements.
COMMISSIONER GREGG inquired of staff if the attorney's opinion
had been solicited. A discussion ensued amongst the
Commissioners and staff. COMMISSIONER GREGG directed staff to
write the letter in any case.

12. Applicable Regulations: The following sections of Title 17 (Zoning) of
the Borough Code are applicable to this request:
17.36.070 General provisions. C. Repairs and Maintenance. On any
nonconforming structure or on any building devoted in whole or in part to
any nonconforming use, work may be done in any period of twelve consecu-
tive months on ordinary repairs, or on repair or replacement of nonbear-
ing walls, fixtures, wiring or plumbing, provided that the cubical
content of the building as it existed at the time of passage or amendment
of the ordinance codified herein shall not be increased.
17.51.050 Area. Accessory buildings in rear yards shall not be closer
than five feet to any side or rear lot line.
COMMENTS:
The purpose of these requests is to allow the applicant to construct a 24-foot
by 28-foot addition onto an existing nonconforming accessory structure on the
lot. The existing accessory building is nonconforming because it does not
comply to the required 5-foot minimum setback for accessory structures located
in the rear yard. The structure is 3 feet from the side property line common
to Lot 25, Block 2, Erskine Subdivision.
As the existing structure is nonconforming, any expansion of the cubical
content requires a variance. Additionally, the location of the proposed
addition does not meet the required 5-foot side yard setback, hence the second
variance request.
In order for the Commission to grant the variance requests, all of the follow-
ing conditions must be satisfied for each variance. The staff analysis of
each condition will be separately addressed for each variance--A for the
request for the expansion of the cubical content of the accessory building,
and B for the request for the two-foot encroachment into the required side
yard setback for the addition, as follows:

1. Exceptional physical circumstances or conditions applicable to the
property or intended use of development, which generally do not apply to
other properties in the same land use district.
A. The unique condition applicable to this lot is the existing noncon-
forming accessory structure. Any addition to this structure will
expand its cubical content.
B. Lots 23 and 24, Block 2, Erskine Subdivision, contain 8,652 square
feet, which is above the 7,200-square-foot minimum lot size for
single-family residences in the R3 district. There do not appear to
be any unique physical circumstances (e.g., slope or substandard lot
size) or conditions which apply to this lot that do not generally
apply to other properties in the same R3 District. There is more
than adequate room on the property to construct a detached accessory
building or an addition to the existing structure and still comply
with all setback requirements.
2. Strict application of the zoning ordinances would result in practical
difficulties or unnecessary hardships.
A. The strict application of the nonconforming section to the ordinance
would not allow any additions to the existing structure, even if in
full compliance with all other code requirements. This is a
practical difficulty and unnecessary hardship.
B. The strict application of the 5-foot side yard setback would mean
that the proposed addition would have to be moved 2 feet. This
would be no more than a minor inconvenience to the applicant. There
is sufficient space on the lot to adjust the location of the
addition in compliance with all currently required setbacks. Also,
the proposed addition could be constructed as a detached accessory
building and comply with all code requirements. Based on this
flexibility in location and the lack of unique physical circum-
stances on the lot, no hardship is created.
3. The granting of the variance will not result in material damages or
prejudice to other properties in the vicinity nor be detrimental to the
public's health, safety, and welfare.
A. Granting of the variance for expansion of the cubical content of the
nonconforming accessory structure will not damage or be prejudicial
to other properties in the area. The public health, safety, and
general welfare will not be •compromised.
B. Granting of the variance to allow encroachment into the setback, in
Absence of any unique physical circumstances, will set a precedent
that will be prejudicial to other properties in the area and will be
detrimental to the public's general welfare.

4. The granting of the variance will not be contrary to the objectives of
the Comprehensive Plan.

Business District.

5. That actions of the applicant did not cause special conditions or
financial hardship from which relief is being sought by the variance.
A. Action of the applicant did not cause the special condition from
which relief is being sought by a variance. The existing structure
was built in 1957, prior to adoption of a zoning ordinance in the
Kodiak Island Borough.
B. In this case, Actions of the applicant will cause the conditions
from which relief is being sought by a variance. Several alterna-
tive locations for an addition or detached accessory building are
available to the applicant. In light of these options, not allowing
the addition to encroach upon the setbacks is merely an incon-
venience and/or financial hardship. Title 29, Alaska Statutes,
specifies that inconvenience and pecuniary hardship are not valid
justifications for granting a variance.
6. That the granting of the variance will not permit a prohibited land use
in the district involved.
A. Residential accessory buildings are permitted in this district.
B. Residential accessory buildings are permitted in this district.
RECOMMENDATION:
A. Staff finds that the request to expand the cubical content of a noncon-
forming structure does meet all the conditions necessary for a variance
to be granted under Section 17.66 (Variance) of the Borough Code.
B. Staff finds that the request to locate an addition to an accessory
structure that encroaches 2 feet into the required 5-foot side yard
setback of the R3--Multifamily Residential District, does not meet all
the conditions necessary for a variance to be granted under Section 17.66
(Variance) of the Borough Code.

APPROPRIATE MOTION:
Should the Commission agree with the staff recommendations, the appropriate
