LINDA FREED stated that Mr. Thompson is the owner of Lot 4A(2), which has an easement across it, and has submitted two public hearing notices stating opposition to the rock removal project. COMMISSIONER KNIGHT asked if the Commission's position -was to negotiate, or to accept or reject a request as submitted. He requested an end to the discussion concerning easements.. COMMISSIONER RENNELL stated that . some of the testimony sounded like "they were pointing the finger at us." He stated for the record that he also lives in Monashka Bay, that the Commission did not request the removal of any rock, and that the Commission did not initiate the proposal but rather is arbitrating it. He stated opposition to industrial use on residential property. COMMISSIONER ANDERSON stated that because the lot is so steep it would be impractical for building purposes; therefore, rock removal to a lesser degree would be the beet deal. COMMISSIONER HILL stated opposition to the project on the grounds that removal of 100,000 cubic yards of gravel is excessive and that three • years is too long for residents to endure. COMMISSIONER JAMES MOVED TO APPROVE A REQUEST FOR AN EXCEPTION from Section 17.17.020 (Permitted Uses) of Borough code to permit the 'removal of approximately 101,000 cubic yards of gravel on an RR1 -Rural Residential One lot. Lot 6, Block 4, Elderberry Heights 4th Addition, 1712 Lynden Way. (Michael Killen) Thirty-six (36) public hearing notices were mailed on December 4, 1984. 1. Applicant: Michael Killen, Box 2868, Kodiak, AK 99615. 2. Land Owner: Raymond Baglin, Box 2969, Kodiak, AK 99615. 3. Request: A variance from Section 17.34.030(B) (Lot Width) to permit the construction of a zero-lot-line structure on a lot that exceeds the three-to-one depth to width ratio. 4. Purpose: To build a zero-lot-line structure on an R2 lot that does not meet the three-to-one lot depth to width ratio. 5. Existing Zoning: The current zoning is R2-Two-family Residential. 6. Zoning History: The 1968 Comprehensive Plan designates this lot as "Residential Unclassified." On April 3, 1980, Ordinance 80-9-0 rezoned all "Unclassified" land to RR-Rural Residential. In 1981, Ordinance 81-26-0 rezoned this area from RR to R2-Two-family Residential. 7. Location: 1712 Lynden Way. Lot 6, Block 4, Elderberry Heights Subdivision 4th Addition. 8. Lot Size: 11,657 square feet. 9. Existing Land Use: Vacant. 10. Surrounding Land Use and Zoning: North: Tract I, Elderberry Heights Subdivision 3rd Addition. Zoning-R2, Use-R2. South: Lynden Way. Comprehensive Plan: The Comprehensive Plan designates this lot for "Public and Open Space." 12. Applicable Regulations: Chapter 17.34, zero-lot-line development. Section 17.34.030(B) (Lot Width) states: B. Lot Width. The minimum lot width is thirty feet per dwelling unit, with a depth to width ratio not to exceed three to one. COMMENTS: The applicant is proposing a zero-lot-line structure on a 11,057 square foot lot that fails to meet the required 3:1 lot depth to width ratio. The average ratio of the newly created lots would be 3.45:1 (average lot depth: 144.54 t average lot width: 41.86). The structure is proposed to be constructed in an R2 district that was subdivided prior to the enactment of the zero-lot-line section of the code. In order for the Commission to grant a variance, all of the following conditions must be satisfied: 1. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. The lot in question is large in size (11,657 square feet); much larger than the 8,000 square foot minimum lot area requirement for zero-lot-line development. Placement of a building on this lot will have more than ample room after satisfying the front, side, and rear setbacks. This is important because the site is densely forested and much of the timber could be retained. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. Strict application of the zoning ordinance would obviously prevent zero-lot-line development on this lot because it exceeds the lot depth to width ratio (3.45:1 vs. 3:1). Because this subdivision was finalized prior to the zero-lot-line regulations, the area of the lots is generally ample in size, but is just over the 3:1 lot depth to width ratio. The trade-off, then, appears to be this extra 3,600 square feet (11,600 vs. 8,000) for a lot that has a 3.45:1 depth to width ratio. 3. The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety, and welfare. A variance for a zero-lot-line structure would not impact neighboring residences any more than what a permitted use would impact here. In Case 84-131 -2- December 12, 1984 fact, the side yard setbacks are stricter for a zero-lot-line structure. Other regulations such as height requirements are generally similar. 4. The granting of the variance will not be contrary to the objectives of the Comprehensive Plan. Zero-lot-line construction is in keeping with the "medium density residential" objectives of the Comprehensive Plan. 5. That actions of the applicant did not cause special conditions or financial hardship from which relief is being sought by the variance. The applicant was not involved with the subdivision of this area. 6. That the granting of the variance will not permit a prohibited land use in the district involved. Residential use is permitted in this district. RECOMMENDATION: It is staff's opinion that the request meets all the conditions necessary for a variance to be granted per Section 17.66 (Variances). APPROPRIATE MOTION: Should the commission agree with staff's recommendation, an appropriate motion is specified below: "Move to approve a request for a variance from Section 17.34.030(B) (Lot Width) of Borough Code to permit the construction of a zero-lot-line structure on a lot that exceeds the three-to-one depth to width ratio.
