Subdivision, Third Addition and the home thereon.
Please be advised that the front yard setback should have
been 25 feet. Apparently, during construction of your new
home, that setback line became sheiled and the home was
building 22.3 feet from the front property line on one
corner and 25.0 feet on the other. You are not
responsible for this minor discrepancy and we have no
intention of asking you to correct it.

To this date I still have not received my full Security Deposit Refund. I moved out of the
apartment on February 4, 1999. Due to the amount of time that has elapsed since my move out
date, I have notified the Alaska Real Estate Commission of this issue in hopes that they can

Dear Linda,
Lam having a very difficult time trying to get a security deposit refund back from a previous __
landlord and you were the first person I thought of who could possibly help me or at least point
me in the right direction!
As you know, I left Kodiak in November 1998 due to marital issues. I'm happy to say that my
husband and I did work things out and he is now here in Reno with me.
When my husband moved out, he:
1) Gave a 30 day notice
2) Completely cleaned the apartment (did not shampoo carpets)
3) Gave an address and phone number to the lady who does the check -out inspections
He moved out February 5, 1999 and until this date he has NOT received a full refund of his
security deposit. He mailed a letter (copy enclosed) certified on March 11, 1999, we have not
heard from the landlord nor have we received the green copy back in the mail. Please review all
correspondence included with this letter. For additional documentation I have also included a
copy of our phone bill which backs up his many attempts to get his security deposit back.
Linda, I hope you can help us somehow. We are starting again new in Reno and these funds that
arebeing_withheld from us are very much. needed! Not to mention DESERVED! Please, please
call or write to me as soon as you possibly can!

Dear Mr. and Mrs. Knight,
I received your letter dated February 25, 1999. Per my request you had included a detailed
accounting for all deductions from my security deposit of $400. I'll make this letter as short and
to the point as possible. I completely disagree with all of the deductions. I will address each
issue in order of your letter.
1) The lease clearly states that rent is from the 5th of the month to the 5th. Therefore the
deduction of $74.16 for pro -rated rent is unacceptable to me. If you had informed me, at the time
I gave you my 30 day notice, that the lease was incorrect, I would've moved out on the 31st of
January.
2) Carpets cleaned and shampooed for $75. In your letter you stated that the apartment was
rented the very next day to a new tenant, therefore I do not feel it is fair to charge me for a
service that was not rendered.
3) General cleaning, items removed for $ 100. Knowing that I was leaving town that night and
that the check -out inspection could not be completed before I left, I was very adamant about
cleaning the apartment in it's entirety. I did the following:
BATHROOM: Scrubbed shower, tub and toilet. Cleaned fixtures, sink and mirror,
scrubbed and mopped floor.
LIVINGROOM: Dusted all wood, vacuumed carpet, wiped down toyo stove, sweep and
mop entry.
DINING AREA: Sweep and mop floor.
KITCHEN: Dismantle and clean stove, cleaned cupboards, scrubbed and deodorized
refrigerator and freezer, sweep and mop floor; scrub sink and fixtures.
BEDROOM: Vacuum carpets, wipe down wood doors.
ITEMS LEFT: Per a phone call with Marlin before I moved out he informed me that it
was ok to leave the dresser. Cans of assorted paints /stains were left under the sink. Those items
were in the apartment before I moved in I left them as I assumed they were kept for upkeep, etc.
I also left cleaning supplies tucked away neatly in a bucket under the sink, a mop and broom, a
clean table cloth for table. (Actual table not in good condition, thought leaving cloth would be
appreciated.)
4) The lease clearly states that it can be terminated at any time by either party. Please refer to
item 12. Therefore, I cannot be held responsible for the amount of $115.88 which includes
advertising costs, electrical service transfer and management costs. I'd like to add that I did not
have the electricity disconnected until the evening of the 5th which, if signed over to the new
tenant properly, would eliminate any charges to you as the landlord.
I feel that you have handled this in an unfair, unprofessional manner. I left Jennifer Smith a
contact number to reach me if necessary. I never received any phone calls. I called a week after
I left Kodiak to check on my security deposit refund. At that time I was told that you had not
heard from Jennifer regarding the condition of the property upon check -out. I called again every
week, leaving numerous messages and talking to you a few times. In all the time that passed you
did not indicate any problems until last week when I requested that you send me something in
writing. The lease states that I am to be refunded my security deposit or notified of any
deductions within two weeks. You did not do this
As I said before, I was adamant about cleaning the apartment knowing that I was leaving town.
Had you any problems at all, a simple phone call to me and I could've called a relative to go in
and take care of any problems.
Looking at this whole situation from the beginning, I feel that the conclusion is an obvious one,
you never intended on refunding my security deposit. Only because I have been determined to
get an answer from you did you respond.
I received your check in the amount of $34.96. I will expect to receive the remainder of $365.04
within-10 days of your receipt of this letter. 1 sincerely hope that this settles the matter as I do
not want to be forced to take it to a higher level. N.

enough of the deposit to repair each accidental
damage.
If the tenant bas purposely destroyed the landlord's'
property (by throwing a rock through the window, .
writing on the wells, or smashing the Arrniture, far •
azample), the tenant may be guilty at vandalism
end mould face up to one year in priaon and a $6,000 •
fine, and still have to pay for the damage.
Returning the deposit
If the tenant has given proper notice of moving out, '
the landlord must provide a written, 1temizedlist of
accrued rent and damages with any refund due the
tenant within 14 days of the date the tenant moves.

to the tenant's last known address. If the landlord
does not know the new mailing address of the

.contact the tenant, the landlord must make a
reasonable effort to deliver the notice and refund to

- Some landlords try to get around the law by
specifying that unlaoa the tenant stays for a certain
time period (six month; for example), the tenant
automatically forfeits a portion of the security

Termination of tenancy
You may have heard that tenants cannot be evicted
in the winter in Alaska or that tenants with smell
children cannot be evicted. Neither is true.
The term 'eviction' is often used to refer to the
landlord's action in ending a tanancy.and requiring
that the tenant mow. Bat only a court can order
the eviction cola tenant if he ar she refi es& to •
mow. (See: 'F.ED. Oases.") The Landlord and
TlanantAct"generally speaks of the landlord's action
ee 'terminating the tenancy.'
There are several different sate of circumstances '
under which a landlord may terminate a tenancy.
