Lot 3, Block 2, Elderberry Heights Subdivision, 1st Addition. 514 Mozart Circle. (Craig M. Johnson and Patrick Cannon) Fifty-nine (59) public hearing notices were mailed on January 3, 1985. 1. Applicant: Craig M. Johnson, 514 Mozart Circle, Kodiak, AK 99615. 2. Land Owner: Craig M. Johnson and Patrick Cannon, 514 Mozart Circle, P.O. Box 569, Kodiak, AK 99615. 3. Request: A variance from Section 17.19.030(A) (Area Requirements) to permit the shifting of a lot line that will cause the area of a lot to fall 306 square feet below the 7200 square foot area requirement. 4. Purpose: To shift an existing lot line to create more usable lots. 5. Existing Zoning: R2-Two-Family Residential. 6. Zoning History: The 1968 Comprehensive Plan indicates the zoning of this area as "Residential Unclassified." In 1980, Ordinance 80-9-0 rezoned all unclassified land to RR-Rural Residential. In 1981, Ordinance 81-26-0 rezoned this area from RR-Rural Residential to R2-Two-Family Residential. 7. Location: 514 Mozart Circle. Lot 3, Block 2, Elderberry Heights 1st Addition. 8. Lot Size: 7200 square feet. 9. Existing Land Use: Single-family structure. 10. Surrounding Land Use and Zoning: North: Lot 2, Block 2, Elderberry Heights Subdivision 1st Addition. Zoning-R2, Use-R1. South: Block 18A, Russel Estates 3rd Addition. Zoning-R3, Use-R3. East: Unsubdivided portion of U.S. Survey 3468. Zoning-I, Use-Vacant. West: Lot 5, Elderberry Heights Subdivision 1st Addition. Zoning-R2, Use-R1. 11. Comprehensive Plan: The Comprehensive Plan designates this area as "Public and Open Space." 12. Applicable Regulations: Chapter 17.19 (Two-Family Residential District), Section 17.19.030(A) (Area Requirements), states: "A. Lot Area. The minimum lot area required for a single-family dwelling is seven thousand two hundred square feet. The minimum lot area required for a two-family dwelling is three thousand six hundred square feet per dwelling unit." COMMENTS: The parties involved are requesting a shift in the lot line to make each of their lots more usable. Presently the property line between Lot 3 and Lot 4 runs radially from the cul-de-sac. The proposed adjustment of the lot line will follow a rock berm that naturally separates the two properties. If approved, the property below the ridge will be in a separate lot and all property on top of the ridge will be owned by a single landowner. The variance is being requested because this proposed realignment would cause Lot 3 to fall 306 square feet below the 7200 square foot minimum lot area requirement. In order for the Commission to grant a variance, all of the following conditions must be satisfied: 1. Exceptional physical circumstances or conditions applicable to the property or intended use of development, which generally do not apply to other properties in the same land use district. The topography of this subdivision requires structures to be built in a stair-step fashion with each house progressively higher than the previous structure. This design makes subdivision difficult when the road access is a cul-de-sac and lot lines are required to extend radially from the cul-de-sac. 2. Strict application of the zoning ordinances would result in practical difficulties or unnecessary hardships. Strict application of the zoning code has created hardships and difficulties in this case. Due to the topography and radial nature of the lot lines, each landowner has to cross the other's property to gain access to their property. Case 84-137 -2- January 8, 1985 ( . The granting of the variance will not result in material damages or prejudice to other properties in the vicinity nor be detrimental to the public's health, safety, and welfare. The granting of a variance to allow a lot with less than the required 7200 square feet is a practical solution in this case to a problem that developed during the initial subdivision. The adjustment of the present lot line will better define the lines of property ownership that follow a topographic boundary and will not cause material damage or prejudice to adjoining properties. 4. The granting of the variance will not be contrary to the objectives of the Comprehensive Plan. The granting of the variance is in keeping with the residential nature of this area and not contrary to the objectives of the comprehensive plan. 5. That actions of the applicant did not cause special conditions or financial hardship from which relief is being sought by the variance. The applicant was not involved in the original subdivision; he has not caused conditions of financial hardship or inconvenience from which he is seeking relief. 6. That the granting of the variance will not permit a prohibited land use in the district involved. Residential use of property is a permitted use in this area. RECOMMENDATION: It is staff's opinion that the request meets all the conditionSnecessary for granting a variance under Chapter 17.66 (Variances) of the Borough code. Staff recommends approval of the variance.
