Thanks for showing me around your building at the above - mentioned location. There did
not appear to be a third dwelling unit on the first floor of your building based on the fact
that there is no kitchen and no bedroom. There was no other evidence to indicate that the
space was being inhabited or had been recently inhabited.
As a reminder, you are not allowed to have people staying overnight in this space, even if
they are not paying rent. Thank you again for your cooperation in resolving this matter.

I conducted an inspection of the building at the above-mentioned location on January 7,
1998 to determine if there was an illegal third dwelling unit in the first floor of the
building. After the owner, Wayne Coleman, gave me a tour of the building, I determined
that there was not a third dwelling unit based on the fact that there is no kitchen and no
bedrooms in the first floor. However, Wayne stated that he occasionally lets out of town
guests spend the night there. I told him that practice was not allowed under the zoning
regulations.
Although the first floor of the building does not meet our definition for an additional
dwelling unit, it does contain a full bathroom (see the attached floor plan). If you need
any additional information, feel free to call me at extension 2361.

I have recently received some information indicating that your rental property at the
above mentioned location contains a third apartment. This is a violation of Kodiak Island
Borough Code section 17.19.020, which describes permitted uses in the R2 Two - family
Residential District.
Please contact me within the next 20 days (by December 31, 1997) to schedule an
inspection so I confirm that your property is not in violation of the zoning code. I will be
out of the office from December 23-26, 1997. Failure to allow an inspection of the
property will require that your file be forwarded to the Borough Attorney for further
zoning enforcement, potentially leading to legal action.
Please call me at 486 -9361 prior to the deadline mentioned above so that this matter can
be resolved.

Thank you for your cooperation during my investigation of a citizen complaint
regarding the use of the structure on Lot 1. The complaint alleged a
triplex use in a R2 zoning district which is prohibited. The inspection
determined the complaint to be invalid. The purpose of this letter is to
confirm our conversation of October 16, 1986 and to inform you of a follow up
inspection scheduled for October, 1987.
On October 16, 1986 a site inspection, at which you were present, revealed a
duplex use of the structure which is permitted in a R-2 zoning district.
Apartments A and B are both located on the second floor. The first floor of
the building contains individual storage rooms for each apartment, a furnace
room, a garage, and an unfinished room which you are finishing. There are
three electrical meter bases, one for each apartment and one for the first
floor of the building. I indicated that the three meter bases is probably
how someone got the idea that the building was being used as a triplex. Your
explanation for the three meter bases is as follows: The downstairs and
furnace room are separate because of the potential for freezing if one of the
tenants did not pay the electric bill. You stated that this is a very common
practice and it made sense to me.
The concern I expressed was with the downstairs on a separate meter, and the
room you are finishing already having the sink and cabinets for a kitchen, it
will be very tempting to either live there or rent it out. You agreed. You
said that that was not your intention, however. You said that your plan
included cutting in a spiral staircase to the apartment above and making it
part of one dwelling unit with only one kitchen. The finished structure will
still be two dwelling units, one large unit for you and your wife with a small
apartment that will be rented.
