Assembly, regular meeting -" May 15th, 1969 -• There were no comments . V COMMUNICATIONS AND CORRESPONDENCE A. Letter from Division of Lands re VFW Request for additional land. Mr.. .Tom Sweeney was present to represent the VFW in their request. The letter from Division,of..,..: Lands was read stating that The Veterans of Foreign Wars had been granted authority to develop 30 acres in the Monashka Bay area. On May 16, 1969, the VFW indicated that it would appear that they would need 90 acres . This 90 acres appears to have a common boundary with the Kodiak Island.;Borough's proposed sanitary fill site. Mr. Sweeney informed the Commission that most of the work has been completed on the thirty acres, the building is nearly finished and many other improvements have been accomplished. The additional 60 acres would provided additional public recreational grounds, such as skeet range, picnic areas, a ski -run, the area will make a good cross - country run and can be used also for snowmobiles; in the future it is hoped that a wdcii rig pool and swimming pool will be possible, also the Boy Scouts have been given an area to develop and use The additional acreage would have a common boundary with the water shed area and thereby afford better protection for that area. The VFW building is :almost completed for a cost of $65,000.00; over- all cost of $130,000, this extra includes volunteer help and equipment supplied by members of the VFW and of the community that have donated time and effort. Verbal commitment has been received from The Recreational Department, Division of Lands that they will help in establishing picnic areas. This area will be open to the Public. It was pointed out in the discussion that the area will be controlled, a caretaker will be living in the Vni building and maintaining the area Firs. Gellis moved that the Commission recommend to the Borough Assembly that the V7.1 be granted the total of 90 acres in the Monashka Bay area and . to _note that this will be for - public use, seconded by mn Welch. Conmissio4 had requested at the last meeting to have a check made with, the Department of Navy, Kodiak to see if they still needed the stock-pile location. A letter was received from the Commanding Officer to the effect that the Navy no longer had need, -. for the stock -pile area and in fact would have the material removed from the area by June 1, 1969 and would relinquish all claims to residual aggregate that may remain on Borough Lands. The file and plats were revie zed . Mr. Wallace moved that approval be given for the preliminary borrow site plat and that approval be iven on the final plat subject to the Borough Engineer's approval, seconded-19 Mir. (CASE- 203 -A) At their meeting on May 29, 1968, the Planning and Zoning Commission voted unanimously to grant this exception for the following reasons: 1. The use of this,land for borrow sites and stockpiling of aggregate, when used under the restrictions of the Borough Borrow Site Ordinance, will not endanger the public health, safety or general welfare, or be inconsistent with the general purposes and intent of Chapter 5, Sub - Chapter 2 of the Borough Code. 2. "Borrow sites and a location for stockpiling of aggregate are necessary for the progress and growth of the community. Referral from Assembly re: Miller Point Blk 7 Lot 7; A letter from Mr. Fields was read by Yin Waller requesting that this lot be reclassified and put up for sale. It is presently reserved for recreational use by the Borough in conjunction with the Old Russian Mill Site. Mr. Fields stated that he had bought the building on this lot in 1956. The building on this lot had been condemned and was vacated by the residing tenants. Mr. Best informed the committee members of the exact location of said property and after some discussion, it was moved by Mrs, Longmire and seconded by Din Welch that the Borough retain use of this land for recreation use in the future. Motion carried unanimously by roll call vote. VII SUVDIVISION, PREIDMIARY A. Approval of Advertising of Vacation & Replatting of Monashka Bay Subdivision Blk 1 Its 7&8; Hr. Best said that a provision should be made for another access to this subdivision. A Public Notice of Hearing was read by Mr. Waller to vacate and replat Sub-division Blk. 1 Lots 7&8 in order to provide a continuation of Bay View Drive through the bnashka Bay subdivision. This hearing will be heard at the P & Z Committee meeting on Wednesday June 26th, 1968. Mr. Haney moved to approve the final request of Vacating and Replatting of the Monashka Bay Subdivision Blk. 1 Lots 7&8, and was seconded by Hr. Welch. Motion carried unanimously by roll call vote. B. Corrected plats of 1onashka Bay Subdivision; A revision of the original plats of the Monashka Bay Subdivision was viewed by the committee members. vir. Best stated that the reason for a request for this newly revised plats presented to the Committee again was due to some drafting errors, and should be corrected. Mr. Haney made a notion, seconded by Mr. Welch, to approve the technical corrected replat of the Yonashka Bay Alaska Subdivigion. IX SUBDIVISION, FINAL NONE X OLD BUSINESS LIA. Request for Exception in Bells Flats for Borough Material Sites: (Case 203-A) Mr. Weller read a letter from the Commanding Officer of the Naval Station requesting permission to leave the stockpile aggregate where it now stands until such time that it can be transferred to Navy property. Mr. Waller also read Ordinance 68-8-0 re- garding Land Use. After discussion, Hr. Haney made a motion for the approval of stockpiling of aggregates, and the exceptions to allow Borough Material Sites in Bells Flats. Motion carried unanimously by roll call vote. XI PLANNING & STAFFING luMS A. Resolution 68-21-R revising Zoning Naps: A letter was read by Mr. Waller from James Barr informing the Borough that in order to utilize the revised zoning map it is necessary that a resolution be adopted. It was also stated that Mr. Barr expects to revise this inap at approximately six months intervals for which there will be no cost to the Borough. Resolution 68-21-R was then read. Mk. Haney moved, ' seconded by Mr. Welch that the Resolution be adopted as read. Motion carried by unanimous roll call vote. With permission of the Borough, we would like to leave this aggre- gate in place, using it on an "as needed" basis or until it can be transferred to Navy property. It is anticipated this can be accomplished within a two year period, however an option for renewal of the permit would be desirable. Your assistance in this matter would be very . much appreciated. Copy of Letter from Historical Society to City Council re Development of Near Island. The letter was read requesting that the Council exercise building restraints on the side of Near Island visible from the Baranof House, since the Park Service is concerned about possibly unsight/l)vtructures being located ? there. The minutes of the Assembly discussion of this matter were read, and the future land use map and present zoning map were studied. Mk. Best suggested that the Loundary of the heavy industrial area now located across the channel from the Baranof House on the future land use map be moved back. and that this i area be designata:, residential or for public use. The possibility of also changing the zoning on the present zoning map from industrial to residential or public use was discussed. The problem would be to detemine a metes and bounds description to use to describe the area in ouestion. Mt. They are already concerned about the present canneries and oil tanks nearby. It was pointed out that the land across the channel would not be suitable for an industrial site anyway, due to its steepness. 0 VI PUBLIC HEARINGS A. Request for Exception in Bell's Flats for Borough Borrow Sites and Stockpiling: Of Aggregate - Assembly (Case 203-A).' Nr. Welch moved, seconded by Nrs. Long- mire, that the exception be approved. The meeting was recessed and public hearing opened. There were no comments and the hearing was closed and meeting? reconvened. The map was studied and the two Navy material sites and the Highway site were pointed out. Nt. Best explained that one of the requirements of the borrow site amendment to the Lands Disposal Ordinance will be that the lessees of the borrow sites will have to stay back at least 10 feet from their boundaries. The Assembly is mow in the process of amending the Lands Disposal Ordinance to include borrow sites. V. :` 4101 410 C. .1J7 244;41 Request for Exception for Sanitary Fill Site at Monashka Bay - Assembly (Case 44 199-A). The case was reviewed. Mr. Welch moved, seconded by Mt. Wallace, that th4lexception be granted. The meeting was recessed and public hearing opened:. Mr. Erwin asked where the site was located, and it was pointed out on the map. Mt. Erwin stated that, as property owner of the area next door to the site, he is against it because it would create a rat problem and a health hazard. He stated that there have been many more rats in the area of the present dump than there were before. He thought that the fill area would drain through his property, polluting his water supply. He fo7t.that thi locatiom of the fill' site would lower the value of his property, and he felt that the garbage should either be barged out or incinerated. It was suggested that if the fill site were used, as much material as possible should be burned. However, Mr. Berg,v representing the VFW recreation site on the far side of the proposed fill site, objected to burning because it would get into the water and ruin the beach area. Otherwise, he had no objection to a land fill site as such, if it were maintained according to the best practices, including being filled every clay. The problOm with the previous sites is that they have not been properly maintained. After further discussion, the hearing was closed and meeting reconvened. Mt. Wallace asked if other sites had been investigated. It Best replied that they had, but that this site was the most suitable, since the alternatives would either be in the watershed or beyond the Navy Base, which is not feasible distance- wise. kir. Keiser felt that if the new site were properly maintained with the proper attendants present and the proper equipment, the rats and other probleMs could be sufficiently controlled. Mr. Waller was concerned about paper blowing around and being a nuisance. It was felt that all of these problems should be taken under consideration when writing the contract with the disposal company^ and that the proper requirements for maintenance should be included. Mr. Welch felt that the decision on the exception should be postponed pending further study and the possibility of coming up with a more agreeable arrangeMent. Welch moved, seconded by hr. Haney, that action be tabled until the next meeting to give the Commission time to look into the matter further. Motion carried by unanimous roll call vote. PLANNING & ZONING COMMISSION MEETING - April 10, 1968 VII ZONING ITEMS - PPELIMINARY REVIEW . Request for Exception for Borrow Sites in Bell's Flats - Borough Assembly (CAse • 203-A). The map of the proposed sites was studied. Mr. Best stated that the Nixons area would be eliminated. Mr. Waller pointed out that the area near the road had been misused and cluttered, and the river dammed up. Mt. Best stated that by issuing leases to the area, the contractors would be required to clean this up. Mr. Waller asked if the depth of the sites had been cleared with Fish and Game. ar. Best stated that the lessees would have to net these requirements, but that the Borough leases would not attempt to overlap the Fish and Game regulations. A question was raised as to the native claims, since they had objected to the sale of gravel as well as the sale of land. Mr. Best stated that the Borough already had T.A. to this land. Mr. Haney moved, seconded by Mr. W&lch, that a public hearing be held on this request on Hay 8. The Commissioners will look at the area involved in the meantime. Motion carried by unanimous roll call vote. VIII SUBDIVISIONS,_PRELIDUNARY A. Request for Approval of Advertising for Vacation of New Kodiak Subdivision, 131k 3, Lots 1-6 - ASH (Case 112-B). The plat was studied. The extension of Wilton White's lot toward the State Highway was discussed. It was thought that this was to allow access into the service station from the highway. Hr. Haney, moved, seconded by hr. Welch, that the advertising for the public hearing on the vacation be approved. Motion carried by unanimous roll call vote. B. Bell's Flats Alaska Subdivision - State Division of Lands (Case 196-A). ' C. Russian River Alaska Subdivision - State Division of Lands (CAse 198-B). The cases were reviewed and plats studied. It was decided to take care of the zoning later when the plats are finalized. Mr. Haney moved, seconded by Mr. Welch, to accept the State Division of Lands preliminary plats of these subdivisions. Motion carried by unanimous roll call vote. Mr. Royal Large from the audience inquired about opening up land near the rifle range in which he and others are interested. He would like to either buy or lease the property. he would be willing to pay for the survey costs. He would prefer the lots to be large ones. This area has been selected by the Borough, and Mr. Large was referred to the Assembly with his request. MANN= & ZONING COMMISSION MEETING - April 10, 1963 3 D. Port Lions Second Addition 7 State Division of Lands (Case 195-A). The case was reviewed and map studied.. kin Haney asked if any waterfront property was being set aside for more canneries. Mt. Best stated that the City Council had preferred residential tracts along the water. After further discussion, Dir. Haney moved, seconded by Mr. Wallace, that the Commission concur with the Assembly's approval of the Division of Lands preliminary plat. Motion carried by unanimous roll call vote. Kupreanof Strait Subdivision - State Division of Lands (Case 202-A). Case was reviewed and plat studied. Mr. Haney moved, seconded by Mr. Welch, to concur with the Assembly's acceptance of the Division of Lands plat and the road, easements. Motion carried by unanimous roll call vote. X OLD BUSINESS - Ncne >a PLANNING & STAFF ITFIS A. Zoning in Port Lions. hr. Waller asked if it would be possible for Port Lions to have a zoning advisory committee to recormend zoning there to the Commission. Mr. Best stated that he had suggested this arrangement to Port Lions, and that they will recommend the zoning that they desire. B. Road Easement in honashka Bay Subdivision. Mr. Best stated that two lots in the subdivision are temporarily being withheld from the over-the-counter sale to allow for them to be replatted to include the extension of Bay View Drive through to the Erwin Homestead. Letter. was read stating that it had been recommended to the Navy that they apply for a Special Land Use. Permit to use the area for temporary stockpiling purposes and that they plan to clear the area and release it within this ca1er year; The question was raised as to whether a public hearing would be reqded on this request. Action was tabled pending receipt of further information B. Letter from Ivor _Schott re Chiniak School Site The letter was read requestiw a review of this site designation with the Commission. Mt. Weller said that he would discuss this matter with Mr. Schott. VI PUBLIC HEARINGS A. Request for Rezoning from R2 to R3 - Erskine Blk 8 Lots 59-62, 65-67; Blk 7 Its 46-52 and 56-58; Blk 9 Lots 103-114 - Property Owners (Case 1-L). mr. Brothers =wed, seconded hyMr.-Wallace, that it be recommended to the AsseMbly that the rezoning be approved. The meeting was recessed and public hearing opened. The petition received against the rezoning was read. A letter fram the Saupes requesting that their name be removed from the petUion-in favor of the rezoning, that the assessments in the area be lowered, .4 aiy further attempts to rezone the area be stopped, and that the petition was misrepresented to them by Mr. Craw, representing Chris Berg, Inc., was read. The following individuals in the audience then spoke in favor of the rezoning:: Anita Mann for herself and Mts. Kraft; Mr. Slater; Clint Crow for Chris Berg, Inc; and Mr. Tusvik. The following people spoke against the rezoning: Mr. Sargent; Mks. Welch; Mrs. Saupe. The following reasons were given in favor of the rezoning: Apartments are needed in Kodiak and progress is going to come and will cause change in all areas. This is a logical place for apartments because it is within walking distance of the City. More reasonable apartment rents are also needed, and it was felt that construction of fourplexes would cut costs by 10 to 15 percent. Taxes in the area are high, but rentals fran apartment units would help people net the taxes. The lots are too small to allow large: multiple unit dwellings, and no high rises would be allowed because the ZoninT Ordinance restricts the height to three stories or 35 feet. Mr. Slater felt that he was being discriminated against in being requested to cease use of his' third unit because other families in it-1 and R-2 zones are boarding students in their homes. Boarding houses are allowed only in R-3 zones. Even if the area were rezoned to R-3, the Chris Berg apartments would still require a variance because their lots are too small to permit R-3 dwellings. The processed aggregate remaining as a result of this contract and stock- piled in areas delineated on the enclosure to the referenced letter, continues to be Navy property. lt,isthe desire of this command to retain ownership of the aforementioned aggregate and to ,continue the removal thereof on an as needed basis. it is hereby requested that, contingent upon final approval of land owner- ship in the Bell Flats area, the State of Alaska grant a peimit to.the U. Due to an apparent change in the Navy contract, the processed aggregate was not used. The State of Alaska now has tentative approval of land owner- ship on which these stock piles are located. In reference to the land ownership, it is now being questioned as to the rightful owner- ship of the processed'e8grsgate. Did S. S. Millen, Inc. pay for the source material or was it furnished by the Navy as part of the con- tract?
