A brief history of events from the Borough files on the subject runs 11ke ' this. Timberline, Inc. submitted the only, therefore the lowest, bid 1n a response to a bid offering by the Borough for the removal of timber in rights-of-way of the Chiniak Subdivision. The bid was $1401.39 and occurred 9/30/83. This was a reoffering of the project since the Borough Assembly rejected all bids the first time around. Provision #6 of the bid packlt titled "Chiniak Timber Sale". states: 6. Timber Sale Contract. A timber sale contract will be signed by the successful bidder within thirty (30) days of bid award. Payment of the bid amount shall be in full at the time the contract is executed. No refunds will be made for timber not removed. Penalties will be assessed for the removal of timber not covered by the contract,. After looking through our files, no where can I find a copy or any other indication that a contract was entered into with the Borough or a check in the amount of $1401.39 was received by the Borough. You stated to me that a contract had not been signed, but you think that a check had been written in the amount of $1401.39. In previous conversations over the year you had told me that your bookkeeper would find your cancelled, check and would supply me with a copy. Today you mentioned that the bank,is looking for a copy. You have stated that you would supply us with evidence. Without copies of either, I'm afraid that your claim to the trees is not valid. I'll double check our files, but if none of the documentation is found or should you not bring in any reasonable evidence substantiating your claims`by Friday, August 19, 1988, you have no claim to the trees. This sale was authorized by Borough Assembly Resolution Number 83-4-R on January 6, 1983. 2. Project Location. The timber to be harvested is located within the Chiniak Subdivision, near Mile 40, Cape Chiniak Road. A map is attached showing the property involved. 3. General Information. The successful bidder will fell and remove all unmarked, dead, standing trees in Tract C, Chiniak Subdivision. "Leave" trees are marked with a yellow paint stripe. Additionally, orange paint designates trees that are not suitable for saw logs and are to be left for firewood. All future road right-of-ways are marked on the centerline with florescent pink or orange surveying tape and stakes. It is the successful bidders responsibility to stay within the platted right-of-ways at all times. 4. Bid Form. Attached is the resolution required by Title 18 of Borough Code which will allow staff to proceed with a timber salvage sale on the Borough portion of the Chiniak area which experienced a wild fire in the summer of 1981. KODIAK ISLAND BOROUGH RESOLUTION NO. 83 -4 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY AUTHORIZING A TIMBER SALE ON TRACT C OF THE CHINIAK SUBDIVISION. WHEREAS, Chapter 18.70 of Borough Code provides for Timber Sales to salvage fire damaged timber; and WHEREAS, a wild fire did occur on Borough property described as Tract C of Chiniak Subdivision during the summer of 1981 which resulted in a large amount of dead and standing timber; and WHEREAS, the fire damaged timber needs to be salvaged before its . value is lost to the Borough as a resource. Timber on borough lands may be offered for sale when the timber is: A. Located in an area to be cleared for a right-of- way or development site; B. Salvage from windthrow, insect infestation, fire, or other causal agent; C. Made available as part of or all of the allowable cut,aa approved by the assembly. (Ord. 78-7-2 §2(part), 1978). 18.70.020 Negotiated sales. The manager may negotiate sales of timber without advertisement on the limitations, conditions, and terms approved by the assembly. Not more than two hundred fifty thousand board feet or equivalent other measure of timber may be negotiated to one applicant in a twelve-month period. Timber sales not exceeding two hundred fifty dollars shall be paid in full at the time the contract is executed. No refund will be made if the contracted volume is not removed. (Ord. 78-7-0 §2(part), 1978). 18.70.030 Volume determination. Measurements to determine the volume of timber sold may be by cubic volume or scribner decimal "C" long rule. (Ord. 78-7-0 §2(part), 1978). 18.70.040 Method of payment. A. Except as provided in Section 18.70.020, the apparent high bidder shall deposit not less than: 1. Ten percent of the purchase price for contracts valued ten thousand dollars or less; or 2. The equivalent value of three month's harvest, as prorated over a logging season, for contracts exceeding ten thousand dollars. B. Additional payments for the timber cut and removed from the sale area shall be stipulated in the timber sale contract. C. A minimum balance equivalent to two months' harvest, prorated over a logging season, shall be retained on deposit by the borough for the life of the timber sale contract. This balance may be applied to the final stumpage payments due but may not be applied to payments accruing earlier for timber harvested. (Ord. 78-7-0 §2(part), 1978). 18.70.050 Appraisal and reappraisal. A. All timber to be sold shall be appraised and in no case shall it be sold at less than the appraised value. B. Timber sale contracts extending more than two years shall provide for an adjustment in the unit- price at the end of the second year and each two-year period thereafter. (Ord. 78-7-0 §2(part), 1978). 18.70.060 Performance bond. The manager may require the purchaser to provide a performance bond in an amount he determines necessary to protect the borough's interest and ensure satisfactory compliance of the contract stipula- tions. (Ord. 78-7-0 §2(part), 1978). 18.70.070 Management agreements. The borough may con-' tract for forest management services to manage its forest resotrces..
