COMPREHENSIVE LAND USE PLAN AND THE OFFICIAL ZONING MAP AND REZONING CERTAIN

BE IT ORDAINED by the Kodiak Island Borough Assembly that:
, Section 1. The Comprehensive Land Use Plan effecting the property described in
Sect1oo 2 of this ordinance is hereby classified Industrial.
Section 2. The tract of land located immediately adjacent to Tmct-N-18.

Change to Comprehension Plan and Request for Rezoning
Madam Mayor and Assembly Members:
Thank you for the opportunity to comment on this subject.
We would like to request this item be tabled for further study. We further
request another public hearing be held and that we be notified.
Secretary
We received notification July 3, 1979 of the public hearing to be held on
July 5, 1979. Prior to that scheduled hearing we talked with the City
Manager, Mr. Harmony, and he assured us it would be used as is at the
present time. At that time we decided this would not conflict with the
Elks and were not proceding further on the subject. After the July 5th
meeting was cancelled we decided further study could be made. During
this study several discrepancies have been found. No formal request from
the City for rezoning has been filed; the property is larger than the
present legal description; a new plot has been made but in not completed; and
a memo from the planning and zoning board states use of the property is for
a warehouse and other commercial use such as a restaurant. (This is not as
we were advised by Mr. Harmony.)
Our concern remains the type of zoning due to height restrictions and the
view from our club.
We sincerely feel this is an important issue and we appreciate your
consideration for further study: Thank you.

E. Borough General Counsel Report on Kodiak Livestock Property.
Mr. Peotter moved to aCknowledge receipt and refer to the July
work session. by Mrs, Kavanaugh. Mrs. Kavanaugh moved
to amend that a special meeting be held the day of the regular
work session to include an executive session on this matter; the
Kodiak Livestock Cooperative. Seconded by Mr. Peotter. Amend-
ment carried by unanimous roll call vote. Special meeting, in-
cluding an executive, session, to be July 21,. 1979 at 9:00 A.M.
in the Borough Assembly Chambers. Main motion carried by un-
animous roll call vote.
F. Letter from Yeshi Benyamin. Mayor Wallin read the corres-
pondence.. Mr. Peotter moved this item be sent to the P & Z
Commission. Seconded by Mrs. Kavanaugh. It was stated that
only the rezoning section of the letter should be sent to the
P & Z. Mayor Wallin requested a letter be sent to Mr. Benyamin
advising him that the present citizen's committee for Service
District 1 is self-appointed and that if and when the, borough
•forms such a committee, he will be considered for membership.
Motion failed 3-1; Mrs. Kavanaugh, Mr. ,Ogg and Mr. Peptter,
voted YES with Mr. Hansen casting one NO vote. Mr. Peqtter
moved to refer to the Planning Department for appropriate
action. Seconded by Mrs. Kavanaugh. Motion failed 2-2; Mrs.
Kavanaugh and Mr. Peotter voted YES with Mr. Hansen and Mr. Ogg
casting NO votes. A copy of the letter to Mr. Behyamin will be
sent to the present citizen's committee.
G. Jan Siebert Presentation, Alderwood. Mr. Jim Payne repre-
sented Mr. Siebert, giving an update on the Alderwood situation.
Stated they now have certificates of occupancy and that finan-
cing at this point is a prime factor. Feels that replatting
would aid in securing financing and should result in much lower
interest rates to the individual owners. Mr. Phil Anderson
stated this is scheduled to come before P & Z at their next
meeting and everything seems to be in order. No action
necessary.
H. Public Use Easement (Doubt). Mr. Phil Anderson reported
that Mr. Doubt now has a letter of public conveyance across the
Lnd. Mr. Peotter moved- that the notice attached to Resblution
79-29-R concerning the plat of Mr. Doubt be removed. Seconded
by Mr. Hansen. Motion 'carried by unanimous roll call vote.

During the regular meeting on the P & Z Commission held on May 22, 1979
the Commission adopted Resolution No. Z-79-023 which recommends rezoning of
,a tract of land adjacent to the City of Kodiak small boat harbor from Conser-
vation to Industrial.
In early March 1979, Mr. Milligan was contacted by Mr. Harmony the Kodiak
City Manager about possible use of that land adjacent to the Boat Harbor. In
reviewing the matter it was discovered the original plan proposed a finger
breakwater. Thus no provision for land use classification was made in the 1968
Comprehensive Land Use Plan. Nor was the land ever zoned prior to 1977. When
. you zoned all lands in the Borough not otherwke classified Conservation.
Adoption of proposed K.I.B. Ordinance No. 79-21-0 will properly classify
this tract adjacent to the Boat Harbor for industrial harbor support uses.
Representatives of the P &.Z Commission and the Administration will be avail-
able to answer questions on this matter during your June 7th and July 5, 1979
Regular Meetings.

A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING.AND ZONING
!COMMISSION RECOMENDING AN AMENDMENT TO THE COMPREHENSIVE LAND USE PLAN AND
:REZONING-FROM CONSERVATION TO INDUSTRIAL A TRACT OF LAND ADJACENT TO THE CITY
OF KODIAK SMALL BOAT HARBOR.
WHEREAS, in response to a request for information from the city of
I Kodiak, the Kodiak Island Borough Department of Planning and Community Develop-
Iment has requested this amendment to the Comprehensive Land Use Plan and
Official Zoning Map. And;
WHEREAS, the Commission found. the Comprehensive Land Use Plan indicated
• the subject property as a finger breakwater on the East side of the City of
Kodiak Small Boat Narbor.—And;
WHEREAS, the amount of fill placed between the Boat Harbor and the
Near Island Channel resulted in a net area of three (3) plus acres. And;
WHEREAS, the Commission found the area is presently zoned Conservation
which is not consistent with the best utilization of land at this location.
NOW THEREFORE BE IT RESOLVED by the Kodiak Island Borough Planning and
Zoning Commission that the Commission recommends the Borough Assembly ammend
1 the Comprehensive Land Use Plan and rezone the property described in the
proposed Kodiak Island Borough Ordinance 79-21-0 from Conservation to Indust-
rial.

Chairman Busch opened the= Public Hearing a request for variance
to encroach 3' 6" into a.required side yard on Lot 14, Block 54,
East Addition. Robert A. Walker. Hearing .'none 'Chairman Busch..
closed the Public Hearing and opened the-Regular Meeting.
Mr. Anderson moved to grant the request for variance encroached
2 1/2 feet into required side yard on Lot 14, Biock 54. Mr.
Pugh seconded. Motion passed by four votes, with Mr. Busch
voting against.
Chairman Busch opened the Public Hearing.a request to permit a
15' rear yard encroachment, variance for Lot 2B, Block 2, U.S.S.
2843. Chris P. Magnussen. Hearing none Chairman Busch closed
the Public Hearing and opened the Regular Meeting.:.
Mr. Pugh moved that we grant a variance to Lot 2B, Block 2,
U.S.S. 2843 topermit a 15 "foot rear yard encroachment. Mrs.
Crowe_ seconded. Motion carried by unanimous roll call vote.
VII. REZONING
Z -79 -022. An amendment -to the Comprehensive Land Uses Plan from

STAFF REPORT: Mr Milligan presented the staff report based on a
memorandum prepared by the Planning Department Staff. The
Borough Assembly asked in initiating this comp. plan amendment
that you take another look at Mr. Zimmer's property and deter-
mine whether or not the' "arendrnent"to the.comp plan from residentia
to,..business should be_ extended to -a- nclude,: his property.
Mr. Pugh moved to put before Public Hearing at our next regular
meeting an amendment to the Comprehensive LandUse Plan from.
Medium Density Residential 'Public and Open Space and Mobile Home
Courts to business to include Lot 2A, USS 3218. Mr. Ball seconded.

I had met with Mr. Haakanson last fall and the City of Old Harbor .
is'interested in proceeding with implementation of-the zoning
sketch plan that was prepared in 1977 for the City of Old Harbor.
Presently the new housing subdivision is zoned R -1, there would
be no change in that area..

RE: Lands adjacent to the Boat Harbor
The City of Kodiak requested information regarding the status
of zoning on the spit adjacent to the boat harbor. A review of Kodiak
Island Borough zoning records indicates this land was not zoned prior
to 1977.when the Borough Assembly rezoned all land conservation which
were not otherwise definitively classified.
The 1968 Comprehensive Plan does not reflect any land use classifica-
tion for this property. However it is immediately adjacent to land
which have been designated for business and industrial use.
The City of Kodiak is interested in developing this land with a ware-
house for fishermen and possibly a resturant. They have had inquiries
from the private sector on developing this site.
In the absence of any clear land use classification for this site, we
have prepared an ordinance for your consideration which if adopted
would rezone the site from Conservation to Industrial.
