RECOMMENDATION
The Planning and Zoning Commission recommends approval of a
zoning change from Rural Residential (one acre) to Rural
Residential (two acre) and Public Use Lands for portions
of the Chiniak Subdivision.

First, I apologize for taking so long to reply to your letter, but we
have had a number of staff changes that have created a backlog of
correspondence.
The public hearing notice you received on Case 83-112 contained a
proposal to rezone Borough-owned land just outside U.S. Survey 3474,
and is designated as the Chiniak Subdivision. The property was recom-
mended for rezoning by the,Planning and Zoning_Commission- At their_
.November.9,..1983_meeting,-the.AsSembly---aptoVWthe recommended rezoning
by Ordinance 83-65-0 (copy attached) Property ih the subdivision was
from Rural Residential (RR1--minimum lot size of one acre) to
either Rural Residential (RR2--minimum lot size of two acres) or Public
Use Lands District (PL).
The Public Lands -deibalOn- was applied to land that has been dedicated.

to- Spruce- Creek.-
At the time that this rezoning was initiated, the Borough Assembly also
asked the Planning and Zoning Commission to consider the rezoning of
U.S. Survey 3474 from Conservation to Rural Residential with a minimum
lot size of two acres. Based on opposition by the property owners of
U.S. Survey 3474, this rezoning proposal was rejected by the Planning
and Zoning Commission.

This property has been zoned Conservation since early 1977, when the
Kodiak Island Borough rezoned all property not previously designated
Conservation. Your property is currently subject to all -the regulations
in the Conservation District, regardless of how it has been developed

of the Section of the Borough Code that pertains to the Conservation
District.

MS, FREED related her conversation with Mr. Frank Peterson, the current
Land Manager of KONIAG, who was unable to attend this meeting. Mr. Peterson
has been consulting with BLM regarding the title dispute. Ms. Freed further
stated that the Borough Assembly had tabled the award of the bid for the
removal of timber in the platted right-of-way for the proposed subdivision and
that these matters will be before the Assembly at their November 8, 1983
meeting.
MRS. CROWE MOVED TO REMOVE FROM THE TABLE Case 83-1I2, seconded by
Reonell, and themotimlARRlEU by unanimous voice vote. MRS. CROWE
MOVED T0 RECOMMEND- APPROVAL OF ORDINANCE 83465=0'tu rezone portions of

packets with the addition of Section 3, the proper verbiage that would
express the updating of the official zoning map. Section 3 would then
become Section 4. Mr. Rennell seconded the motion and the question was

This item was given to the Commissioners for their information.

14. CHAIRMAN'S REPORT
MR. HILL commented on an issue involving Dr. John J. Eufemio, Mr. Dave
Crowe, and Mr' Shealy. Mr. Hill recommended that an item tabled should be
tabled until the next regular meeting, not for 30 days. Mr. Hill also re-
lated a phone call from Shahafka Acres in complaint of the height of the
Brechan's batch plant. MS. FREED commented that the building permit had
been checked and the permit is authorized for the height of the building.
The batch plant is in violation of the Borough Code, if it is closer than
50' to a residential district.

The Assembly initiated Ordinance No. 83-65-0 at its September 1,
1983 meeting. The Planning Commission held a.public hearing
on the proposed ordinance at its September 21, 1983 meeting
and unanimousli, voted to table the item for one month. This
action was taken because of land ownership questions raised
by Koniag, Inc.

MR. BRIGGS AND MRS. CROWE concurred in their opinion that the entire
area should be planned at one time so people on Murphy ld know what
is going to happen, that proper access roads be put into the subdivision,
and that it is poor planning to consider pieces of a section. Mrs. Crowe
read Section 16.12.010 Familiarization of Subdivider with Requirements
from the Borough Code on Subdivision, alluding to the sub-
division request which wnuld.alm have to be tabled if this request were
tabled.
MR. GREGG MOVED TO TABLE CASE 83-118, a request to rezone Tract R-1,
Killarney Hills` U.S. Survey 3218 from RR1 to R2 and 8-Business, submitted
by the Archdiocese of Anchorage, to allow the applicant in the case to
discuss the comments and return in 30 days. We will remove this case from
the table to discuss further progress, not necessarily to take action at
that time. Mr. Gregg reserved a comment and Mrs. Strickert seconded the
motion. The motion CARRIED with a unanimous voice vote.
MRS. CROWE MOVED TO TABLE ITEM #18 which is the public hearing on the
preliminary subdivision of Tract R-1, Killarney Hills Subdivision, U.S.
Survey 3218 creating: Lots 7 through 19, Block 3; Lots 2 through 12,
Block 4; and Tract "X", Killarney Hills Subdivision, U.S. Survey 3218,
submitted by the Catholic Arch-Bishop Corporation/Saint Mary's Parish.
• Mrs. Strickert seconded the motion and the question was called. The motion
PASSED with unanimous voice vote.
A FIVE-MINUTE RECESS WAS CALLED at 9:30 p.m. The meeting resumed at
8. PUBLIC HEARING ON CASE 83-112. An ordinance rezoning s of
Chiniak Subdivision from RR1-Rural Residential Single Family Dwelling to
RR2-Rural Residential Two Family Dwelling or PL-Public Use Lands, sub-
mitted by the Community Development Office.
MR. WALTON gave an additional staff report on this Assembly-initiated
ordinance for portions of the fall land sale. The Assembly desired the
zoning to prevent further subdivision on a one-acre scale, minimizing
problems in the future. Mr. Walton felt this to be in line with the wishes
of the citizens of Chiniak and their comprehensive plan proposal of earlier
this year.
One lot, next to the school, has two residences on it and the
suggestion was to subdivide it into two portions, advised by the Borough
Engineer. There are two long-term residents living on these lots. The
Borough Engineer was advised to submit a subdivision of that one lot.

The staff report presented by Mr. Walton recommended rezoning U.S.
Survey 3474 from C-Conservation to RR2-Rural Residential. Mrs. Crowe
reminded the Commission that this request would be an unadvertised rezoning
and would be unfair to the general public. She recommended putting the
issue on the October agenda.
Mn. PHIL SHEALY, BOROUGH MANAGER, spoke before the Commission stating
the desire of the.Assemhly to put three lots up for the fall land sale to
straighten out a squatter situation in that nei9hborhuod. He reported
recent advise from Mr. Dale Tubbs, Land Consultant, not to put the land up
for sale due to a question of title to some of the prop,rty. Mr. Shealy
concurred with the Mr. Walton that the Commission proceed with the rezoning
and make the subdivision fit whatever zoning classification appropriate.
MR. HILL closed the Regular Meeting and opened the Public Heur1ny,
MR, FRANK PETERSON, representing Koniag, spoke before the Commission
of the possible boundary disputes on the land in questinn. He advised of
Koniag's intent to seek advice from the appropriate authorities on the
boundary question. Mr. Peterson requested that the Commission table this
item until further notice, or until sufficient time has allowed research to
the question. Mr. Peterson stated that 30 days would be sufficient time.
Mr. Peterson further stated that if the Commission should happen to rezone

the area without Koniag's finding answers to the questions, Koniag would be
back with a similar rezone request.
MR. HILL closed the Public Hearing and opened the Regular Meeting.
MR. BRIGGS MOVED TO TABLE CASE 83 -112, an ordinance rezoning portions
of Chiniak Subdivision from RR1 to RR2 or PL- Public Use Lands, submitted by
the Community Development Office for a period of 30 days. The question
was called and the motion CARRIED with unanimous voice vote.
9. PUBLIC HEARING ON CASE 83 -113. An ordinance rezoning certain
Borough -owned properties for Land Sale #8, Submitted by the Community
Development Office.
MR. WALTON gave additional staff report that one of the lots was
included in a previous action tonight.
MRS. STRICKERT MOVED TO APPROVE CASE 83 -113, an ordinance rezoning
certain Borough -owned properties for Land Sale #8, submitted by the
Community Development Office and Mr. Rennell seconded the motion. The
question was called and the motion CARRIED by unanimous voice vote.
10. PUBLIC HEARING ON CASE 83 -119. An ordinance revising Chapter 17.69,
Board of Adjustment to Chapter 17.80, Board of Adjustment, submitted by
Kodiak Island Borough Assembly.
MR. WALTON gave additional staff report stating the differences
between the original ordinance and the proposed one as being under Section
17.80.030 Procedure.
MR. JAMES recommended "and /or" Planning Commission member be added to
the ordinance under that section. MRS. CROWE added "ten minutes per
person" to present the decision.
MR. JAMES MOVED TO APPROVE the ordinance revising Chapter 17.69 on
Case 83 -119, submitted by the Community Development Office, with the
following amendments to Section 17.80.030: a) that Item #1 be changed to
read "Borough Staff and /or Planning Commission member;" b) "ten minutes
per person" to present the decision being appealed and the evidence and
reasons relied upon by the Commission. Mrs. Strickert seconded the motion
and the question was called. The motion CARRIED by unanimous voice vote.
11. PUBLIC HEARING ON CASE 83 -120. An ordinance revising portions of
Title 17 of Borough Code on zoning, submitted by the Kodiak Island Borough
Assembly.
MR. WALTON added that this ordinance was a combination of ordinances
previously presented to the Commission at a work session. The ordinances
had been combined for ease of review.
MR. HILL closed the Regular Meeting and opened the Public Hearing.
As there was no public opinion on the ordinance, Mr. Hill closed the Public •
Hearing and opened the Regular Meeting.
MR. RENNELL MOVED TO APPROVE CASE 83 -120, an ordinance revising
portions of Title 17 of Borough Code on zoning, submitted by the Kodiak
Island Borough Assembly and Mr. James seconded. The question was called
and the motion CARRIED by unanimous voice vote.
12. PUBLIC HEARING ON CASE 83 -126. An ordinance amending Chapter 17.21,
B- Business District to include radio stations as a permitted use, submitted
by the Community Development Office.
MR. JAMES posed a question to Mr. Walton asking at what point in time
and for what reason was the mention of residences added to an ordinance
that was passed in November. Mr. Walton answered that it was added by the
Borough Assembly and that it was a compromise at the Assembly meeting.

I have conferred with the BLM officials that are processing
the Leisnoi land selections in the Cape Chiniak area to determine
a time when the decision would be made to confirm or reject any
of the village selections. The BLM's action has been on hold
waiting for the State of Alaska's response to identify third
party interests they created. This includes approved Borough
land selections. I called Tom Hawkins, the Director of Land and
Water Management for the State, to determine the hold-up in his
department.
It looks like it will be safer to hold back on any land
sales for the Chiniak Subdivision until the dust settles. The
Borough T.A. received from the State was on or about January 22,
1973. Leisnoi (Woody Island) Natives applied for eligibility at
about this same time or in February, 1973. The BLM person
working the selection expects an appeal of the decision, which
ever way it goes. The Borough title, even though it will be
confirmed in the end by either Koniag, Inc. or the State, will be
up in the air. If you wish to gamble and play the edge, you
could make a disposal on the strength that the State reconfirmed
its T.A. to the Borough on 7/2/79 and neither Leisnoi Natives or
Koniag, Inc. successfully challenged that action.
The BLM does not necessarily accept the State's action as
final and will make their own interpretation. The State also
gave the Borough the okay to make disposals in the Chiniak
Subdivision based on the confirmed T.A. This letter should be in
the files. The letter and the law have a caveat that the dis-
posals are conditional. As long as this problem is this close to
being resolved, I am recommending you not include any Chiniak
parcels in the November sale.

Ordinance No. 83-65-0 was initiated by the Borough Assembly and has
been scheduled for an October 6, 1983 public hearing.
The Assembly is interested in rezoning the Chiniak Subdivision to
accommodate future public use needs and establish large residential
lots. This Assembly-initiated rezoning also points out the fact
that the adjacent subdivision, U.S. Survey 3474, is zoned Conservation.
The Commission should consider including that area in its rezoning
recommendation.
RECOMMENDATION
Staff recommends approval of Ordinance No. 83-65-0 and consideration
of rezoning U.S. Survey 3474 from C-Conservation to RR2-Rural Residential,
