A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY RECOMMENDING THE
DISPOSAL OF CERTAIN BOROUGH PROPERTIES
WHEREAS, Title 18 of the Borough Code requires that the disposal of
Borough land be reviewed by the Planning and Zoning Commission, and
WHEREAS, Title 18 of the Borough Code requires. that the Planning
and Zoning Commission, by resolution, make a recommendation to the Assembly
regarding the proposed land disposal, and
WHEREAS, it is apprOpriate that the Kodiak Island Borough make
available publicly-owned lands to the private sector, and
WHEREAS, the Kodiak Island Borough owns land suitable for disposal
to the public.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly declares the following parcels excess to the Kodiak Island Borough's
needs and therefore available for disposal:
1. Lots 3 through 10, Block 1, Chiniak Alaska Subdivision
2. Lot 15, Block 2, Chiniak Alaska Subdivision

The presiding officer said that he had a request by the school
district for testimony by Dennis Murray.
Dennis Murray stated that the School Board met and discussed the
proposed actions by the assembly regarding this bid award. He
said they had some concerns that the motion was not to go with
the alternates which were part of the original proposal. He said
they understood the alternates were relatively expensive, however,
the School Board considered the alternates as meritorious and
hoped the borough would give them consideration at some future
point. He stated that the School Board was in agreement with
the action proposed but wanted the assembly to recognize that
the alternates such as domestic hot water replacement, the
bleachers, and the gym floor are important also.

CASE 86-018. Request for Planning and Zoning Commission review

At their regular meeting on March 19, 1986, the Planning and,Zoning
Commission held a public hearing on the above-referenced case. Please find
attached the maps and memorandum from the Resource Management Officer used
by the Commission in reference to the property proposed for disposal.
Following a public hearing, the Planning and Zoning Commission adopted
Resolution 86-01-R recommending the disposal of the identified lots in the
Chiniak Alaska Subdivision.

CASE 86-018 Request for Planning and Zoning Commission review of
the disposal of Borough property. Lots 3 through 10,-Block 1, and

Background
The Commission approved the preliminary subdivision for this area of Chiniak
at their January meeting. Review of the final subdivision is also before the
Commission at this meeting.
Lots in the Chiniak subdivision are scheduled to be disposed of at Borough
land sale scheduled for the fall of 1986. There is interest in land in the
Chiniak area, this disposal will help meet that demand.
Final Corps of Engineers approval has also been granted for this subdivision.
Recommendation
Recommend to the Assembly by approving Resolution 86-01-R, disposing of lots
in the.Chiniak AlaskaSubdivision.

The'propoaed home occupation will fulfill all other
requirements of the R1-- Single- Family Residential District .
(Chapter 17.18) such as parking and the definition of a home
occupation (Section 17.06.320).
3. That granting the conditional use permit will not be harmful
to the public health, safety, convenience and comfort.
The proposed use will not be harmful to the public health, -
safety, convenience and comfort because. the character of the
surrounding area will not change and there• will not be a
significant increase in- traffic resulting from the home
occupation.
4. That sufficient setbacks, lot area, - buffers or other
safeguards are being provided to meet the conditions listed
in subsections A through "C of.this_section.
As the home occupation will be conducted entirely within the
existing residence and because only au occasional customer
will call at the residence, provision of additional buffers
or other safeguards are not necessary in this instance.-
There-is sufficient area on the lot for four (4) off - street
. parking spaces. Should the nature of the home occupation
change over time, the Commission could review the
conditional use permit to determine if additional safeguards
are appropriate.

A discussion ensued amongst -the Commissioners, Engineering
Department staff, Community Development Department staff and Bud
Cassidy, Resource Management Officer concerning the rationale for
disposing Borough lands, the need to reserve adequate lands for
parka and public services such as "a sanitary landfill and a fire
hall and.the statue of a comprehensive plan for the Chiniak
Community. •
COMMISSIONER JAMES MOVED TO APPROVE RESOLUTION 86 -01 -R AND TO
RECOMMEND TO THE BOROUGH ASSEMBLY•the disposal of Lots 3 through
10, Block 1 and Lot 15, Block 2, Chiniak Alaska Subdivision. The
motion was seconded and CARRIED by unanimous roll call vote.
F) CASE 86 -019. Shuyak inland Comprehensive Plan. (Community
Development Department)
BUD CASSIDY presented 'a slide show and discussed the development
of the draft Shuyak Island Comprehensive Plan: The process
involved defining "why a Shuyak Island Comprehensive plan," the
purpose of the plan, how the plan was put.together, general
recommendations and recommendations specific to Borough - owned
lands.
A discussion ensued between Bud Cassidy and Dave Herrnstein.. Mr.
Herrnstein indicated'that he liked a lot of things about the plan
but he disagrees that the Borough should encourage development in
the Port Williams /Shuyak Straits areas. Bud Cassidy noted that
