I Call to Order
The meeting was called to order in the Magistrate's Courtroom, Donnelley Building,
Kodiak, Alaska, by Presiding Officer Russell Wright at 7:50 p.m.

minutes; and approximately 26 people in the audience.
III MINUTES OF PREVIOUS MEETING - May 5, 1966
Minutes were not read, since copies were available to the Assembly and the audience.
Mr. Lester moved to accept the minutes as received. Seconded by Mr. Brechan and
carried by unanimous voice vote.
IV OTHER MINUTES - School Board, April 18 and May 9, 1966
Mr. Lester moved that the minutes be mailed to the Assemblymen for information and
that any required action be taken at the next meeting. Seconded by Mr. Brechan and
carried by unanimous roll call vote.
V COMMUNICATIONS - CORRESPONDENCE - PEOPLE TO BE HEARD
A. Letter read from Mr. Joseph Fitzgerald, Chairman, Federal Field Committee for
Development Planning in Alaska. Chairman reported that neither Mr. Fitzgerald
nor his representative had been able to come to Kodiak, but that when a meeting
is held with them, it will be reported on.
B. Letter from T. T. Fuller concerning the hospital was not read since it had been
published in the paper, and Assemblymen had read it previously.
C. Chairman reported that the City precincts for the special election were being
set up, and that the Clerk had delivered ballots to all villages except Karluk.
VI PUBLIC HEARINGS
Rezoning R2 to Business - Erskine Blk 9 Lots 115 -117, Paul T. Walls; Lots 89-92,
Elaine Banks (Cases 132 -A and 134 -A)
Ordinance was read. Mr. Brechan moved for adoption of Ord. 66 -11 -0 in the second
reading. Seconded by Mr. Lester. Public hearing opened. Mr. Madsen, speaki+
as a property owner, objected to the rezoning of Lots 115 -117 on Carolyn Avenue,
since that was a residential street. Mr. Wallace questioned building plans.
After further discussion, public hearing was closed and motion died by a tied
roll call vote as follows: Yes - Brechan and Haakansen; No - Lester and Wrig t.
Further discussion was held. Mr. Welsh and Mr. Wallace objected. Mr. Lester
moved for adoption of Ord. 66 -11 -0 with the provision that the rezoning of Los
115 -117 be stricken. Motion died for lack of a second. In further discussio?,
Mr. Gransbury, representing Mr. Walls, stated that the building would be a low
one. Mr. Welsh still objected, and Mr. Wallace and the Christian Science Society
stated they had no objections if the building plans were adhered to. Mr. Gransbury
-suggested omitting Lot 15from the rezoning, and Mr. Wallace withdrew his objection
Mr. Brechan moved that the ordinance be amended to exclude- i,ot_115_and that the
ordinance be adopted as amended. Seconded by Mr. Lester and carried by roll call
vote as follows: Yes - Brechan, Haakansen, Wright; No - Lester.
B. Rezoning R2 to R3 - East Bik 30 Lots 15, 16, 17 - Louis Iani and Fred Brechan
(Case 128 -B)
Mr. Brechan disqualified himself. Ordinance was read. Mr. Lester moved for
adoption of Ord. 66 -9 -0. Seconded by Mr. Haakansen. Public hearing opened.
Mr. Eggemeyer presented a petition against the rezoning signed by various property
owners in the area. Petition read. Mr. Perez spoke for the rezoning, and Mr.
Jensen against. After further discussion, Mr. Madsen determined that in the
case of objections by owners of 20 percent of the area abutting the property to

Wildlife Service.
After graduation from

ton in 1952, Vega returned
to the Philippine Islands,

Mr. Barr's recommendation for approval was read. Mr. Best explained that this
is part of an overall plan of the entire area submitted previously. After
brief discussion of sewerage and street names, Mrs. Hajdu moved for approval of
the preliminary plat of Baranof Heights Subdivision, Addn #2. Seconded by
Mr. Brechan. Carried by unanimous voice vote.
D. £Lbdivision, USS 3100 Lot 18 - Marion Parker (Case #138 -A)
Mr. Barr's recommendations were read. After some discussion, Mrs. Hajdu moved
for approval of the final plat of Lot 18 USS 3100, subject to the recommendations
of the Borough Engineer being met, and that the Attorney be instructed to prepare
a resolution. Seconded by Mrs. Brechan. Carried by unanimous voice vote.
E. Rezoning R2 to R3 - Townsite Blk 1 Lot 10 - Robert C. King (Case #137 -A)
Application read. Mrs. Hajdu suggested that this rea be rezoned in its
entirety, rather than each request being . handled separately, and that the Assembly,
acting for P &Z, request this on its own initiative. It was also stated that
since it will take some time for the Comprehensive Plan to be prepared, some
rezoning will have to be accomplished in the meantime. After discussion on
what area should be included, Mrs. Hajdu moved that an ordinance be drawn up to
rezone the following lots from R2 to R3: USS 444, Tr. C; Townsite Blk 1, Lots
10, 12, 13, 17, 18, 19; USS 1995; and Alaska Game Reserve. Seconded by Mr.
Brechan. Carried by unanimous voice vote.

IX New Business - None
X Chairman's Report
A. Status - Borough Engineer. Mr. White reviewed the correspondence between himself
and the Borough Engineer, and stated that they were to meet to discuss the
termination of Mr. Barr's contract. There are no provisions for termination
other than by mutual agreement.
B. Sanitarian's Report. Mr. Carter reported that his office is catching up on all
existing violations. Also, a new dump site has been selected on the proposed
highway between Miller Point and Pillar Creek which should serve for about 20
years. In the meantime, arrangements are being made for a temporary one -year
dump site in the Miller Point area. Mr. Carter is in the process of working
with the State to determine what health powers the Borough will assume if the
takeover is approved by the election.
C. Board of Equalization. Mr. White reported that there are 18 applications so far
for the BOE, and that Mr. Cole expects about 40, which will total about 10 per
evening. An attempt will be made to schedule the cases by area.
D. Mr. Brechan moved to concur with the School Board in writing a letter of intent
to the J. B. Warrack Co. accepting their low bid for construction of Elem. School.
E. Mr. Brechan moved for acceptance of the Planning Board consisting of Richard G.
Berg, Chairman; Steve Collins, and Ole Johnson. Seconded by Mrs. Hajdu. Carried
by unanimous voice vote.

Various complaints were made that there are inequitities in the assessments. It
was brought out that it is possible for errors to be made, and that possible errors
should be checked out by talking to the Assessor. If an agreement cannot be
reached, an appeal should be made to the Board of Adjustment. If an agieement
still is not reached, an appeal may be made to the Superior Court.
In summarizing, Chairman White stated that the Assembly realizes that there is
a lot of dissatisfaction concerning the assessments, and that some action must be
taken to resolve it. He suggested that a board be created to act in an advisory
capacity both to the public and the tax assessor, which would assist him in
making the assessments. This board should represent a cross - section of the
property owners.
He emphasized that everyone who cannot come to an agreement with the Assessor
should apply for a *Board of Equalization hearing. According to the law, a visit
must first be paid to the Assessor. If agreement cannot be reached, then the
BOE forms should be filled out. But the discussion must be held with the
Assessor, not with the Chairman or the Assembly members. Those people who cannot
see the Assessor during working hours may call him at the Borough Office.
A comment was made that re- appraisals should be done. Mrs. Hajdu replied that the
overall values would remain the same. If there are inconsistencies, they should
be reported so that they may be adjusted.
III Minutes of previous meeting, April 7, 1966, were not read aloud since copies were
available to everyone.
IV School Board minutes of April 5 and April 11 were read. Mr. Schott explained to Mr.
Wright that the pension is an honorarium of one payment which is paid out of the
General Fund.
V COMMUNICATIONS - CORRESPONDENCE - PEOPLE TO BE HEARD
A. Letter from Supt. of Schools re Special Assembly Meeting on April 28 for elementary
school bid opening was read. Mr. Schott explained that if the bids are in order
on that day, the contract could be awarded if the Assembly is present, thus saving
time. Chairman White stated bhat the Borough has been advised that the bond market
is so depressed that interim financing had been suggested instead. After brief
discussion, it was decided that the bond matter would be checked into, and a
decision made then about Assembly attendance at the meeting on April 28.
VI PLANNING & ZONING ITEMS
A. Exception to Build Men's Dormitory in R2 Zone - Townsite Blk 1 Lots 7 & 8 - L. A.
Hopkins (Case #127 -A) - Public Hearing
Case was reviewed, and Mrs. Hajdu made a motion that the exception be granted to
Hopkins Construction for construction of a men's dormitory in the designated area,
Seconded by Mr. Haakansen. Public hearing declared open. The Metrokins and
Bortons stated that they wished to be removed from the petition in favor of
construction. It was pointed out that Walter Kraft, also on the petition, no
longer owns property in the area. There was an objection that there would be no
room for parking. Mr. Dunham, representing Hopkins, explained that the dorm
would have a live -in supervisor, and that there would be enough parking space.
There were other objections that this would open the area to other R3 dwellings;
and that a dorm should not be put in a residential area. It was suggested that
new petitions be drawn up, both for and against. Mrs. Hajdu withdrew her motion
and moved that a public hearing be scheduled for the next meeting. Mr. Haakansen
concurred. Motion carried by unanimous roll call vote.

Cases were reviewed. Mr. Welsh commented from the audience that if the ddor was
opened to business in that area, the whole area would become business. Mr.
Haakansen made a motion that an ordinance be drawn up to cover this rezoning.
Seconded by Mrs. Hajdu. Carried by unanimous roll call vote.

As we understand it Lots 84 and 89,
while they are and have been actively used
for business for sometime, are under a con-
ditional use zone. We hereby petition to
have Lots 84, 89, 9Q, 91, and 92 zoned for
business. We enclose our check in the amount
of $25 to cover the cost of the same.
Heretofore, we had requested Mrs. Joan
Boyd, that she file such a petition on behalf
of Elaine Banks. It may be that she has
accomplished this. If she has not, then we
will be pleased if you will treat this as
Mrs. Banks' application.for such rezone.

The reasons for the petition are
essentially the same as those of Mr. Paul
Walls with respect to Lots 115, 116, and
117. A business use of such property ought,
as a matter of good zoning, to indicate
similar use for the Banks' lots.
In addition, you are aware of the
fact that Lots 80, 82, 83, 118 and 119, are
already zoned for business, and have been
informed that they are to be used for a
Union Oil Company gas station.
Such 'a rezone would permit Mrs. Banks
to make the highest and best use of the lots
immediately adjacent to the store.
We know that the informality of the
petition will not militate against your care-
ful and considerate attention to this request.
