Dated: this 49 day of , 1966. KODIAK ISLAND BOROUGH ASSEMBLY CHAIRMAN PUBLISH: r4L, (0, /gt r - April 26, 1966 Mt. Paul T. Walls Butler and Walls . 4719 Brooklyn Avenue N.B. Seattle, Washington 98105 Dear :Mr.. Walls: Thank you for your letter of April 22 to Nt. Wright. I am very sorry but I'm afraid there has been • a misunderstanding concerning your request for rezoning of your lots in the Erskine Addition. At their meeting on April 21, the Borough Assembly merely requested the Borough Attorney to draw up an ordinance to cover the rezoning. This is in no way an approval, but rather a step in the procedure for rezoning which consists of the following: 1. Request is presented to AsSembly. If they feel that request is valid, they ask the Attorney to prepare an ordinance, the means by which rezoning must be. accomplished., • 2. The ordinance is prepared and presented At the next Assembly meeting, at which time it is given a "First Reading" which- is formally approved by the Assembly, 3. .Notice is then published in the paper, and notices sent to residents within 300 feet of the boundaries of the lots involved, that there is to be a public hearing on the Ordinance. 4. At the next meeting, the Ordinance is given a "Second • Reading," and a public hearing is held at which time all objections to the, rezoning may be voiced. If the Assembly feels that the objections are valid, they will disapprove the rezoning; if they do not, they will approve the rezoning • and the Ordinance. To- further complicate matters in your case, our-Attorney is presently in'the States and will not be backuttil after May 5, which may mean that the First' Reading could not be schedUled until Hay 19' and the Second Reading and-publit bearing on June 2.: Rowever,-we are going to tryand-have the ordinance written in the Attorney'.s absence, in -which case the First Reading would be May 5 and the Second Reading and public hearing on May 19. Mt . Paui T. Walls 2 April 26,. 1966 I am sorry that 1 did not have a*chance to speak to Mr. Gransbury after the meeting, but it adjourned very late and he left before it was over. SEATTLE, WASHINGTON 98105 LAKEVIEW 3-1414 April 22, 1966 Russell Wright, Presiding Officer Kodiak Island Borough Assembly Kodiak, Alaska Dear Mr. Wright:' REAL ESTATE APPRAISERS AND CONSULTANTS Mr. Gransbury informed me today that the Borough acted favorably upon my request to rezone Lots 115, 116 and 117 from R-2 to Business. We understand that there are other formalities to finalize this action, which I believe will be May 19th. I wish to take this opportunity to express my appreciation to you and the other members of the Borough. I am confident that as this property is developed, it will be a favorable improvement to the business district of Kodiak. You may be assured that we will be extremely careful in our design and planning to upgrade the aesthetic values of Kodiak. 1p Very truly y/ours, eyeed,c)7 --Paul T. Walls Kodiak Wand Borough KODIAK, ALASKA RECEIVED ,,APP 2 6 1966 AM 7,8,9zr Al211121314i5i6 ASSEMBLY MEETING - April 21, 1966 Various complaints were made that there are inequitities in the assessments: It was brought out that it is possible for errors to be made, and that possible errors should be checked out by talking to the Assessor. If an agreement cannot be reached, an appeal should be made to the Board of Adjustment. If an agreement still is not reached, an appeal may be made to the Superior Court. In summarizing, Chairman White stated that the Assembly realizes that there is a lot of dissatisfaction concerning the assessments, and that some action must be taken to resolve it. He suggested that a board be created to act in an advisory capacity both to the public and the tax assessor, which would assist him in making the assessments. This board should represent a cross- section of the property owners. He emphasized that everyone who cannot come to an agreement with the Assessor should apply for a Board of Equalization hearing. According to the law, a visit must first be paid to the Assessor. If agreement cannot be reached, then the BOE forms should be filled out. But the discussion must be held with the Assessor, not with the Chairman or the Assembly members. Those people who cannot see the Assessor during working hours may call him at the Borough Office. A comment was made that re- appraisals should be done. Mrs. Hajdu replied that the overall values would remain the same. If there are inconsistencies, they should be reported so that they may be adjusted. III Minutes of previous meeting, April 7, 1966, were not read aloud since copies were available to everyone. IV School Board minutes of April 5 and April 11 were read. Mr. Schott explained to Mr. Wright that the pension is an honorarium of one payment which is paid out of the General Fund. V COMMUNICATIONS - CORRESPONDENCE - PEOPLE TO BE HEARD A. Letter from Supt. of Schools re Special Assembly Meeting on April 28 for elementary school bid opening was read. Mr. Schott explained that if the bids are in order on that day, the contract could be awarded if the Assembly is present, thus saving time. Chairman White stated hhat the Borough has been advised that the bond market is so depressed that interim financing had been suggested instead. After brief discussion, it was decided that the bond matter would be checked into, and a decision made then about Assembly attendance at the meeting on April 28. VI PLANNING & ZONING ITEMS A. Exception to Build Men's Dormitory in R2 Zone - Townsite Blk 1 Lots 7 & 8 - L. A. Hopkins (Case #127 -A) - Public Hearing Case was reviewed, and Mrs. Hajdu made a motion that the exception be granted to Hopkins Construction for construction of a men's dormitory in the designated area. Seconded by Mr. Haakansen. Public hearing declared open. The Metrokins and Bortons stated that they wished to be removed from the petition in favor of construction. It was pointed out that Walter Kraft, also on the petition, no longer owns property in the area. There was an objection that there would be no room for parking. Mr. Dunham, representing Hopkins, explained that the dorm would have a live -in supervisor, and that there would be enough parking space. There were other objections that this would open the area to other R3 dwellings; and that a dorm should not be put in a residential area. It was suggested that new petitions be drawn up, both for and against. Mrs. Hajdu withdrew her motion and moved that a public hearing be scheduled for the next meeting. Mr. Haakansen concurred. Motion carried by unanimous roll call vote. Request for Rezoning Erskine Addn Blk 9 Lots 115 -117 from R2 to Business - Paul T. Walls (Case #13.-A) C. Request for Rezoning Erskine Addn Blk 9 Lots 89 -92 from R2 to Business - Elaine Banks (Case #134 -A) Cases were reviewed. Mr. Welsh commented from the audience that if the ddor was opened to business in that area, the whole area would become business. Mr. Haakansen made a motion that an ordinance be drawn up to cover this rezoning. Seconded by Mrs. Hajdu. Carried by unanimous roll call vote. t ASSEMBLY MEETING - April 7, 1966 VII Old Business A. Rezoning R3 to R2, Townsite Blk 14, hots 1 -6, Bik 19, Lots 1640 (Case #70) Public Hearing Case reviewed and ordinance read. Mr. Lester moved for adoption Of Ord. 66 -6 -0. Seconded by Mrs. Hajdu. Public hearing declared open. Mr. Costello, owner of Lots 5 -9, Blk 14, spoke against rezoning of Lot 6 since he wishes to build apartments there. Mr. Saupe agreed to Lot 6 remaining R3 if remaining lots were rezoned to R2. Mrs. Kessler spoke against the rezoning since she wants to build apartments later. Mr. Cornelius, representing several people in the area, spoke in favor of the rezoning. After further discussion, public hearing was closed and motion was amended with concurrence of second to approve adoption of Ordinance with the deletion of Lot 6, Blk 14. Carried by roll call vote as follows: YES NO Mr. Wright Mr. Lester Mrs. Hajdu Mr. Haakansen B. Rezoning Clinic Property (Townsite Blk 8 Lot 1 and USS 444 Tract D) from R3 to Business (Case #71 -A) - Request withdrawn and ordinance cancelled. C.= Rezoning Townsite Bik 16 Lots 5 -8 and 12 -17 from R3 to Business (Case #101 -B) Second Reading and Public Hearing Ordinance was read. Mr. Lester moved for adoption of Ordinance 66 -7 -0. Seconded by Mrs. Hajdu. Public hearing declared open. Ken Brandenburg, speaking for ASHA, objected to rezoning since part of these lots will be included in Urban Renewal area. Rezoning to Business might affect the acquisition of these lots since the value of them might be higher if they were zoned business. Mrs. Springhill and Mr. Craig objected because they feared taxes would be raised. Mrs. Kessler, in favor of rezoning, objected to waiting for takeover by Urban Renewal. Mr. Best spoke of necessity of establishing a line between the Business and R3 areas. After considerable further discussion, public hearing was closed and motion defeated by unanimous roll call vote. Mr. Lester made a motion that the ordinance be rewritten to include only those lots presently cut in half by different zoning, specifically Lots 15 and 17. Seconded by =.- Mrs. Hajdu and carried by unanimous voice vote. D. Appeal to P &Z Decision on Rezoning of Erskine Addn, Various Lots Blks 5 -9, from R2 to R3 (Case Nos. 1D and 1E) - Public Hearing and Board of Adjustment Notice of public hearing read. Public hearing declared open. Mr. Harry Wallace, Mr. Rohn Welch, and Mr. Harold Heglin spoke against rezoning. Mr. James C. Merves, Attorney, representing Chris Berg and those appealing, spoke for rezoning. Mrs. Hajdu brought out that there was a previous Attorney's opinion against spot zoning. Mr. Starbird stated that he thought some of the people for rezoning were already in violation of the ordinance. Mr. Gransbury spoke of advantage of rezoning Mr. Walls' lots to Business. Representative of Kafluk Co. stated that they are in favor of rezoning. Jim Stansbury stated that violations of the ordinance do exist in the area. Mr. Wright spoke against rezoning. ANCHORAGE, ALASKA Gentlemen Re: Request for Zoning Change Phone BR 2.1935 135 EAST FIFTH AVENUE In accordance with Ordinance #64 -5, I as agent for land owner, Paul T. Walls, here- by apply for zoning change on certain lots located in the Kodiak Island Borough and enclose your required $20e herewith in the form of our check. Mr. Walls is the owner of Lots 117 and 118 and has an option on Lots 115 and 116, all in Block 9, Erskin Subdivision, Kodiak, Alaska. C Our first choice of zone change is to have all of said Lots 1 116 and 117' zoned Commercial Business. This choice is more fully described on plat herewit marked "FIRST CHOICII: ", which shows all of Lots 115 and 116 used for parking only. This will allow a larger building to be built on the rear of Lots 117 and 118. The second choice would be to zone Lot 117 only Commercial Business and thus allow a much smaller building which would require a daylite basement, first and second floors. This would bebdilt back to allow parking in the front of the lots. This is more ful- ly described on the enclosed plat herewith and marked "SECOND - CHOICE ". The planned building will have a daylite basement for storage. The ground level flo- or will be used for offices and business. Said space has been spoken for. The total plan is for a low, modern, attractive flat top type of building which will be a credit to the city and area. All parking areas will be black topped. Commercial Business Zoning requested for the subject Lots for the following reasons: (1) Before architecural design for construction can be accomplished for subject Lots they must be zoned Commercial Business. This will allow a building designed for these lots to be set in an area most suitable to meet the parking need. We feel that this zoning must be accomplished for best planning and use of these hillside lots. Lots 115 and 116 will be used for parking only, thus nothing in our construction area will block the present view of existing properties. (2) The adjoining area Lots 81, 82, 83, 118 and 119 are now zoned commercial business. (3) The City Market Lots 84 and 89 have been used for business for a long time and their present zone is R -2. We understand that they also own Lots 90, 91 and 92 and are hopeful of using these lots for parking, which they are in need of. (4) The Kodiak City Hall is located in this area and it is reasonable to beleive that, our request is in keeping with good planning for the area in general. (5( In our opinion and knowledge there should be no neighborhood objection to our type . of construction and request. Your very truly F. Ernest Gransbury J FEG /s Agent for Paul T. Walls "Whether you rent or buy, you pay for the home you occupy" 1966 Mr. Paul Walls . 4719 Brooklyn Avenue N.S. Seattle, Washington Dear Mr. Wall In regard to our telephone conversation of this morning, there are two courses of action that you may follow in order to use your Lot 117, Bik 9, Erskine Addition, for a parking area. Since this lot is presently zoned Residential R2, a parking area would not be permitted (see Ordinance, p. 6, Sec. 4- A-2).. The simplest and fastest method to change the use of the lot might be to apply for an exception under Sec. 1O -A -11 of the Ordinance (p. 25). To do this, a letter from the owner of the lot should be addressed to the Planning and Zoning Commission stating the reasons for the request (p. 24 -25).. At the next meeting following receipt of the letter, the Commission will set a date for a public hearing on the case. The property owners within 300 feet of the lot boundaries will be notified, and following the hearing the Commission will grant or deny the request. The other method would be to apply for a rezoning of the lot from R2 to Business, which might require a public hearing by both Planning and Zoning Commission and the Borough Assembly (pp. 45-48, Sec. 23). In eigher case, a fence around the parking lot will be required (p. 31). I learned this morning that a similar request for an exception for a parking area was recently denied, but it would appear that the circumstances of your case would enable you to obtain the exception without any difficulty. Of course, it would depend upon any possible objections of nearby property owners. If the exception request was denied, a re- zoning may not be too difficult to obtain, since the property is backed by City Market (the store you mentioned) and that might logically also be re - zoned to Business (it is presently zoned R2, but the store is permitted there because it existed at the time of the adoption of the Borough zoning ordinance (p. 27). I am enclosing a list of meeting dates for your information. If you have -any further questions, we will be glad to be of assistance. Sincerely, Sally : Hendrix, Encs.
